How long can I wait to file unemployment claim in Washington state?
I got laid off from my job at a manufacturing plant two weeks ago but haven't filed for unemployment yet because I was hoping to find something quickly. Now I'm realizing this job search might take longer than expected. Is there a deadline for filing my initial claim with Washington ESD? I don't want to miss out on benefits I'm entitled to, but I also wasn't sure if there were any penalties for waiting. Has anyone else waited a while before filing their unemployment claim?

You should file as soon as possible! Washington ESD typically allows you to backdate your claim up to one week from when you file, but you can't get benefits for weeks you don't claim. The sooner you file, the sooner your waiting week starts and the sooner you can start receiving payments.

•So I've already lost out on two weeks of potential benefits by waiting?

•Not necessarily lost, but you'll need to request backdating when you file. Washington ESD evaluates each backdating request individually.

There's no specific deadline to file your initial unemployment claim in Washington, but there are important time limits you need to know about. You have to file weekly claims to get paid for each week, and you can only backdate so far. I'd recommend filing your initial claim immediately and then requesting backdating for the weeks you missed.

•This is exactly right. I waited 3 weeks to file and was able to get backdating approved for 2 of those weeks.

•How do you request backdating? Is that something you do when filing the initial claim?

•Yes, there's usually an option during the filing process to request an earlier claim start date. You'll need to explain why you delayed filing.

I was in a similar situation last year and kept putting off filing because the Washington ESD phone system was impossible to get through to ask questions. Ended up costing me about $800 in benefits I could have received. Don't make my mistake - file online at esd.wa.gov even if you have questions.

•The phone situation is still terrible. I've been trying to call for days about my adjudication status and can't get through.

•Have you tried Claimyr? Found out about it at claimyr.com - they help you get through to actual Washington ESD agents. There's a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works. Saved me hours of calling.

•Never heard of that but willing to try anything at this point. The hold times are insane.

just file already!!! every week you wait is money you're losing. washington esd doesn't care about your reasons for waiting unless you have a really good excuse like being in the hospital or something

•I get that, I just didn't know if there were any downsides to filing if I might find a job soon.

•You can always stop claiming if you find work. Better to have the claim active and not need it than need it and have to wait for processing.

One thing to keep in mind - even if you file your initial claim today, it can take 1-2 weeks for Washington ESD to process it before you can start filing weekly claims. And then there's the waiting week where you don't get paid. So the longer you wait to start this process, the longer before you see any money.

•I didn't realize there was a waiting week. So even if I file today I won't see benefits for at least 3 weeks?

•Probably closer to 3-4 weeks realistically. Initial claim processing, then waiting week, then payment processing time.

•This is why the system is broken. People need help immediately when they lose their jobs, not a month later.

From my experience, Washington ESD is pretty reasonable about backdating if you have a legitimate reason for the delay. 'Looking for work and hoping not to need benefits' is actually a pretty common reason they accept. Just be honest when you file.

•That's reassuring. I was worried they'd think I was trying to game the system somehow.

•They're used to people not knowing the rules. The important thing is that you're filing now and being upfront about the timing.

Pro tip: even if you're actively interviewing and think you might get hired soon, file the claim anyway. You can always close it if you get a job, but if those interviews don't pan out, you'll already be in the system. I learned this the hard way after a 'sure thing' job offer fell through.

•This is exactly my situation - I have a few interviews lined up but nothing guaranteed.

•Then definitely file now. You're not committed to anything by filing, you're just protecting yourself in case those don't work out.

•Agree 100%. I waited for an interview process to play out and it took 6 weeks, then they hired someone else. Could have been collecting benefits that whole time.

Does anyone know if there are different rules for different types of layoffs? I was laid off due to company restructuring, not performance issues or anything.

Keisha Williams
•The type of layoff doesn't affect the filing timeline, but it can affect whether your claim gets approved. Layoff due to restructuring is usually straightforward - no fault on your part.

QuantumQuester
•Mine was also company restructuring. They eliminated my entire department.

•That should be pretty clear cut then. At least we don't have to worry about the approval part, just the timing.

Washington ESD's website actually has a whole section about when to file. Basically says file immediately after your last day of work or when your hours are reduced below full-time. Waiting just complicates things and potentially costs you money.

•I should have looked at their website first instead of overthinking it.

•Don't beat yourself up about it. The system isn't exactly user-friendly and it's not like they make this information super obvious.

I waited almost a month to file because I was embarrassed about being unemployed and kept thinking I'd find something. Biggest financial mistake I made that year. File now, deal with the paperwork, and focus your energy on job searching instead of worrying about the benefits process.

•Yeah, I think part of it was not wanting to admit I might be unemployed for a while.

•Totally get that. But unemployment benefits are something you've paid into through your taxes. You've earned the right to use them when you need them.

•This is such an important point. It's not charity, it's insurance you've been paying for.

Question about backdating - do you have to provide proof of when you actually lost your job, or do they just take your word for it?

Keisha Williams
•They can ask for documentation like your final paycheck stub or termination letter, especially if you're requesting significant backdating.

QuantumQuester
•I have my termination paperwork, so that shouldn't be an issue.

•Keep all your employment documentation handy. Washington ESD loves their paperwork.

PSA: If you're having trouble getting through to Washington ESD to ask questions about filing, there are services that can help. I used something called Claimyr after being on hold for literally 4 hours one day. They basically call for you and connect you when they get through to an agent.

QuantumQuester
•How does that work exactly? Do they charge for that service?

Anastasia Sokolov
•Yeah there's a fee but honestly worth it when you need answers and can't get through. Saved me probably 10+ hours of calling attempts.

The bottom line is there's no benefit to waiting and potential downsides. File your claim online at esd.wa.gov today, request backdating for the weeks you missed, and start your weekly claims as soon as the system lets you. Don't overthink it.

QuantumQuester
•You're right. I'm going to file as soon as I get home from work searching today.

•Good plan. And remember you still need to do job search activities even while collecting benefits, so you can count today's job searching toward those requirements.

QuantumQuester
•Oh right, I forgot about the job search requirements. At least I've been actively looking already.

One more thing - make sure you file your weekly claims every week once your initial claim is processed, even if you're still waiting for adjudication or have questions about your claim. You can't go back and claim weeks you missed filing for.
0 coins
QuantumQuester
•So I need to file weekly claims even if my initial claim isn't fully approved yet?
0 coins
Luca Esposito
•Exactly. The weekly claims establish your eligibility for each week. If your initial claim gets approved later, you'll get paid for all the weekly claims you filed.

•This is super important. I know someone who missed filing weekly claims and lost out on $2000+ in benefits.

Thanks everyone for all the advice. This thread convinced me to stop procrastinating and just file. Hopefully I can get approved for backdating and minimize the damage from waiting two weeks.

•Good luck! Two weeks isn't that bad in the grand scheme of things. The important thing is you're filing now.

I'm in a very similar boat - lost my job three weeks ago and kept putting off filing because I was optimistic about some leads that didn't pan out. Reading through all these responses has been really eye-opening. I had no idea about the waiting week or how long the processing actually takes. Sounds like we both need to get our applications in ASAP. The backdating option gives me some hope that we haven't completely screwed ourselves by waiting. Thanks to everyone who shared their experiences - this is exactly the kind of real-world advice you can't get from the official websites.

•Glad this thread helped you too! It's crazy how many of us are in the same situation - waiting and hoping things will turn around quickly. I think there's definitely a psychological barrier to filing for unemployment, like admitting defeat or something. But everyone here is right that it's just insurance we've paid into. Three weeks is still manageable for backdating from what others have shared. We should both file today and then focus our energy on the job search instead of worrying about whether we should have filed sooner.
