How long after being fired do you have to file for unemployment - Washington ESD deadline?
Got terminated from my job yesterday and I'm freaking out about the timeline. I know there's some kind of deadline for filing unemployment claims but I can't find clear info on Washington ESD's website. Is it like 30 days or something? I'm worried if I wait too long I'll miss out on benefits entirely. Also does it matter that I was fired vs laid off? My manager said it was performance related but I think it was really just downsizing. Should I file right away or wait to see if they contest it?

You need to file as soon as possible! Washington ESD doesn't have a hard deadline but your benefits are calculated from when you file, not when you lost your job. So every week you wait is basically money lost. Being fired vs laid off doesn't change the filing timeline, just potentially affects whether you'll be approved.

•Oh wow I didn't realize I was losing money by waiting. I thought there was like a cooling off period or something. Filing today then!

•Yeah this is super important - I waited 3 weeks thinking I needed to 'sort things out' first and lost those benefit weeks forever

File immediately but be prepared for adjudication if they fired you for performance. Washington ESD will investigate misconduct claims and that can take 4-6 weeks. You won't get paid during adjudication but if you're approved you'll get backpay to your filing date.

•What exactly is adjudication? And how do I know if they're going to contest it?

•Adjudication is when Washington ESD reviews the circumstances of your job separation. Your employer will get notice of your claim and can respond with their side of the story. If there's a dispute about misconduct, ESD investigates before deciding eligibility.

I've been trying to call Washington ESD for weeks about my own claim status and can never get through. The phone system is absolutely terrible. Someone told me about this service called Claimyr that actually gets you connected to a real person at claimyr.com - they have a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works. Might be worth checking out if you need to talk to someone about your specific situation.

•Never heard of that but honestly anything is better than spending 4 hours on hold just to get disconnected

•Thanks for the tip! I'll probably need to call them once I figure out what's happening with my claim

UGHHH the whole system is so confusing! I got fired 2 months ago and STILL don't have a clear answer on my eligibility. They keep saying 'under review' and I'm about to lose my apartment. Why can't they just tell us yes or no???

•Two months is way too long for adjudication. Have you tried calling or filing an appeal? There might be additional information they need from you.

•I've called probably 50 times and never gotten through to a human. The automated system just tells me to wait for a decision.

•This is exactly the situation where Claimyr helps - they can get you connected to actually talk to someone about what's causing the delay

File within a week if possible. I'm not sure about Washington specifically but most states have better outcomes when you file quickly. Also keep all your paperwork from the termination - you might need it.

•Good advice about the paperwork. Washington ESD may ask for termination letter, final pay stub, or other documentation during adjudication.

File NOW. I waited 2 weeks thinking I needed to have my story straight and regretted it. Even if they deny you initially, you can appeal. But you can't get back those weeks of benefits you lose by waiting.

•That's what I'm realizing - better to file and deal with problems later than miss out completely

•Exactly! I tell everyone this now. File first, ask questions later.

Being fired doesn't automatically disqualify you from unemployment in Washington. They have to prove you were terminated for misconduct, not just poor performance. Document everything about why you think it was really downsizing.

•That's encouraging. I do have some emails that suggest they were looking to reduce headcount in our department.

•Keep those emails! That could be crucial evidence if they try to claim it was misconduct rather than economic reasons.

Washington ESD is backed up like crazy right now. I filed in January and just got my first payment last week. The sooner you file the better because the waiting period is going to be long regardless.

•January?? That's insane. What was the holdup?

•Adjudication for misconduct claim. Took them 6 weeks to even contact my employer, then another 4 weeks to make a decision. But I got backpay for the whole period.

Don't overthink it - just file. The worst thing that happens is they deny you and you appeal. But if you don't file at all you definitely get nothing.

•True, nothing to lose by trying. Going to file this afternoon.

Make sure you have all your employer info ready when you file - full company name, address, supervisor name, dates of employment, reason for separation. Washington ESD's online system will ask for all this and you can't save a partial application.

•Good point, I'll gather all that info first. Do I need my W-2 or pay stubs?

•You don't need them to file but have them ready in case ESD asks for wage verification later. They can usually get your wage info from the employer directly.

I used Claimyr when I couldn't get through to Washington ESD about my pending claim. Worth every penny to actually talk to someone who could explain what was happening. The phone system is just impossible otherwise.

•How much does something like that cost? I'm already broke from being unemployed

•It's not free but way cheaper than losing weeks of benefits because you can't get answers. Plus they actually get you connected instead of wasting hours on hold.

File online at secure.esd.wa.gov if you can. The phone system for filing new claims is even worse than the general customer service line. Online is much faster.

•Perfect, I'll use the online system. Thanks for the direct link!

Whatever you do, don't wait. I have a friend who waited a month thinking she needed to find another job first, then learned she missed out on $1,400 in benefits because you can't backdate claims in Washington.

•Wait you can't backdate at all? That seems harsh

•Nope, your claim starts the Sunday of the week you file. Any weeks before that are just lost money.

File today! I'm dealing with the same situation and wish I'd filed sooner. Even if there's adjudication, at least the clock starts ticking on your claim date.

•Thanks for the encouragement. Definitely filing today after reading all these responses.

The key thing is that Washington ESD pays benefits from your filing date, not your separation date. So every day you wait is literally money out of your pocket. Performance-related terminations can still qualify for benefits if it wasn't willful misconduct.

•That's reassuring about performance vs misconduct. I really don't think what I did rises to the level of misconduct.

•Most employers know this and won't contest unless it was really egregious. It costs them time and money to fight it.
