ESD claim denied after quitting job that required serving alcohol against my religious beliefs - can I appeal?
I'm in a really tough spot and don't know what to do. I was on unemployment for about 8 weeks when I found what seemed like a perfect job at a retirement community as an activities coordinator. Nothing in the job description or interviews mentioned alcohol service. On my FIRST DAY, my supervisor handed me the schedule showing I'd be required to serve alcohol at resident happy hours and help coordinate casino nights (both against my religious beliefs). When I explained my religious restrictions, they basically said 'that's part of the job' and wouldn't accommodate me. I resigned immediately since this violated my religious principles. Now ESD has denied my claim saying I voluntarily quit without good cause. But I never would've accepted the position if they'd been honest about the job duties! The denial letter says I should have 'tried to resolve the situation before quitting' but how could I when it was a direct religious conflict from day one? Has anyone successfully appealed something similar? I have documentation showing the original job description and can get a letter from my religious leader confirming these restrictions. My benefits have stopped and I'm getting desperate.

ESD ALWAYS denies everything first!!! I swear they do this to everyone hoping we'll just give up!!! They denied my claim when my boss lied about my hours and I appealed and WON. The system is rigged to make us struggle but DON'T GIVE UP!!! Religious discrimination is ILLEGAL and they can't force you to do things against your faith!!!!

wait i'm confused... why didn't u just ask them if u could skip the alcohol parts of the job? seems extreme to quit on day 1 without trying to work it out first.

When I told my supervisor about my religious restrictions, she said serving alcohol at happy hour and running the casino nights were 'non-negotiable' parts of the job that everyone in activities had to do. She told me they couldn't make exceptions because they were short-staffed. I offered to take on other duties during those times but was told no.

i had a kinda similar thing happen but it was about having to work sundays when i couldnt for church. my boss wouldnt change the schedule so i quit and esd denied me too. wish id known to appeal back then. now im working at a place that respects my religion. good luck!

Make sure you specifically use the term "misrepresentation of job duties" in your appeal letter as well as "failure to provide reasonable religious accommodation" - these are specific legal terms that the ESD judges will recognize. OMG I had almost EXACT same thing happen!!! Got hired at hotel front desk, then they wanted me to deliver alcohol to rooms which is against my faith too! I quit and got denied but didn't know I could appeal and just gave up. Don't make my mistake!!! APPEAL APPEAL APPEAL!!!
