Washington ESD denied unemployment now what - need advice on next steps
Just got my determination letter from Washington ESD yesterday saying my unemployment claim was denied. The reason they gave was 'voluntary quit without good cause' but I had to leave my job because my supervisor was creating a hostile work environment and making racist comments. I documented everything but apparently it wasn't enough for them. I'm completely lost on what to do next - do I have any options to fight this? I really need these benefits to pay rent and bills. Has anyone successfully appealed a denial like this?

You absolutely have the right to appeal this decision! You have 30 days from the date on your determination letter to file an appeal with Washington ESD. The appeal process involves a hearing where you can present your evidence and testimony about the hostile work environment. Make sure you have all your documentation ready - emails, witness statements, any HR complaints you filed, etc.

•Thank you! I do have screenshots of text messages and emails. Should I also try to get statements from coworkers who witnessed the behavior?

•Yes, witness statements can be very helpful. Just make sure they're willing to participate in the hearing if needed.

same thing happened to me last year, had to quit because of harassment and they denied me too initially

•Did you end up appealing? How did it go?

•yeah I appealed and won but it took like 3 months total. The hearing officer actually listened to my side of the story unlike the initial determination

The appeal process can be challenging, but hostile work environment is definitely considered good cause for quitting in Washington. You'll need to prove that the situation was so severe that a reasonable person would have quit. Document everything chronologically and be prepared to explain why you didn't file complaints with HR first (if you didn't).

•I actually did file an HR complaint but they basically ignored it and said they couldn't substantiate my claims. Would that help my case?

•That could actually strengthen your appeal - shows you tried to resolve it through proper channels first before quitting.

Hey, I know how frustrating it is trying to get through to Washington ESD for help with appeals. I was in a similar situation and couldn't reach anyone by phone for weeks. A friend told me about this service called Claimyr (claimyr.com) that helps you actually get connected to Washington ESD agents. They have a video demo showing how it works: https://youtu.be/7DieNd3C7zQ. Saved me so much time and stress when I needed to discuss my appeal options.

•Interesting, I hadn't heard of that. I've been trying to call Washington ESD for days with no luck.

•Is this legit? Sounds too good to be true honestly

•I was skeptical too but it actually worked. Way better than spending hours on hold or getting disconnected.

Don't give up! The initial determination is often wrong, especially in hostile work environment cases. Washington ESD adjudicators sometimes don't fully understand the nuances of workplace harassment. The appeal hearing is your chance to tell your full story to someone who will actually listen.

•That gives me hope. I was starting to think I had no chance.

•The system is rigged against workers honestly. They deny first and ask questions later.

Make sure you file that appeal ASAP - the 30 day deadline is strict. You can do it online through your Washington ESD account or mail it in. Also, keep filing your weekly claims even though you were denied because if you win the appeal, you'll get backpay for those weeks.

•Wait, I should keep filing weekly claims even though I was denied? That seems weird.

Arnav Bengali
•Yes, it's called 'continued claiming' and it protects your right to backpay if your appeal is successful. Just make sure you meet all the eligibility requirements.

•This is correct advice. Always continue filing weekly claims during the appeal process.

ugh this is exactly why I hate dealing with unemployment. they make it so hard for people who actually need help

•It's definitely frustrating. I'm just trying to survive while looking for a new job.

•Hang in there, the appeal process exists for a reason and hostile work environment is a valid reason to quit.

I went through this exact same situation two years ago. Racist supervisor, hostile environment, quit for my own sanity and got denied initially. The key for my successful appeal was organizing all my evidence chronologically and having a clear timeline of events. Also had my doctor write a letter about how the stress was affecting my health.

•A doctor's letter is a great idea! I have been having anxiety and sleep issues because of all this.

•Definitely get that documented. It shows the measurable impact the hostile environment had on you.

Just want to add that if you can't get through to Washington ESD by phone to ask questions about your appeal, that Claimyr service someone mentioned earlier really does work. I used it last month when I needed to talk to someone about my adjudication issues. Worth checking out their demo video if you're tired of busy signals.

•I might try that if I can't get through the regular way. These phone lines are impossible.

•I've been trying to reach them for two weeks straight, might have to look into this too.

Whatever you do, don't miss that 30-day appeal deadline! I learned that the hard way when I waited too long thinking I could figure it out myself. Once that window closes, you're basically out of luck unless there are extraordinary circumstances.

•Good point, I got the letter 3 days ago so I still have time but I shouldn't wait.

Anna Kerber
•Exactly, start working on it now. The appeal form isn't complicated but gathering all your evidence takes time.

Also remember that even if your employer contests your appeal (which they probably will), you still have a good chance if your evidence is solid. Employers often don't show up to the hearings or don't present their case well.

•I hope they don't contest it but knowing my old company they probably will.

•Most employers contest appeals automatically, don't take it personally. Focus on your evidence.

Been there with hostile work environment quit. Key things for appeal: 1) Show you tried to resolve it internally first (which you did with HR) 2) Document specific incidents with dates 3) Prove it would be unreasonable to stay 4) Show you looked for solutions before quitting. Sounds like you have most of this covered.

Leo Simmons
•This is really helpful, thank you. I think I do have most of these elements documented.

•Good! The hearing officer will want to see that pattern of behavior and your reasonable response to it.

Just curious - did Washington ESD give you a specific reason code on your determination letter? Sometimes understanding exactly why they denied it can help you target your appeal better.

Leo Simmons
•It says something about RCW 50.20.050 - voluntary quit without good cause. Not sure what that means exactly.
0 coins
Kristin Frank
•That's the standard voluntary quit statute. Your appeal needs to prove you had 'good cause' which hostile work environment definitely can be.

One more thing - if you win your appeal, make sure Washington ESD processes your backpay correctly. Sometimes they mess up the calculation or don't include all the weeks you should get paid for. Double-check their math!

Leo Simmons
•Good to know, I'll definitely keep track of everything if I win the appeal.

•Yeah they screwed up my backpay calculation and I had to call them like 5 times to get it fixed.

•That's another situation where Claimyr helped me get through to actually talk to someone about payment issues.

Update us on how your appeal goes! A lot of people are in similar situations and it helps to hear success stories. You've got a strong case from what you've described.
