ESD adjudication stuck for over a month after business closure - can't contact former employer
I'm really frustrated and getting worried about bills. My former employer (a small tech startup) completely shut down operations about 6 weeks ago. I filed for unemployment right away and uploaded the separation letter they provided stating the business was closing permanently. My claim has been stuck in adjudication for over a month now. The problem is that my former employer can't be reached anymore - their phone is disconnected and the business email addresses bounce back. I've tried explaining this in my weekly claim notes, but nothing seems to move forward. Does anyone know what I should be doing to help this adjudication process along? Should I be uploading additional documentation or trying to contact someone specific at ESD? I'm worried they're trying to verify with an employer that literally doesn't exist anymore.

have you tried going to worksource? sometimes they can help you navigate stuff like this. i had a similar issue when my restaurant closed down last yr

OMG I went thru the EXACT same thing when my company folded in January!!! The adjudication took like 6 WEEKS and I was so stressed I couldn't sleep. What finally worked was I used Claimyr to get through to a real person at ESD. It's this service that gets you a callback from ESD instead of waiting on hold for hours. •Yes!! It was the only thing that worked after I spent literally DAYS trying to call their regular number. The ESD rep told me they can override the employer verification requirement if they can see evidence of the business closure, but someone has to actually LOOK at your file first.

I'm an employment attorney and can confirm that business closures create a specific verification problem for ESD. Their system is designed to reach out to employers for verification, and when that fails, claims often get stuck in limbo. One additional step you should take: file a request for expedited processing. You can do this by uploading a letter to your eServices account specifically stating: 1. The business has permanently closed 2. You have financial hardship due to the delay 3. You've already provided all available documentation Mark this letter as "Request for Expedited Processing - Business Closure" when uploading. This flags your claim for special handling. Also, remember that if you eventually receive a denial, you have the right to appeal within 30 days - but let's hope it doesn't come to that.

The ESD system is COMPLETELY BROKEN when it comes to business closures! They expect verification from companies that don't exist anymore!! I waited SEVEN WEEKS in adjudication after my employer went bankrupt. The only thing that finally worked was getting my state representative involved - I contacted their constituent services office and they reached out to ESD on my behalf. Had my claim approved within 48 hours after that. They have some kind of special ESD liaison who can actually get things done. Don't waste your time with the regular phone lines!

UPDATE: I wanted to let everyone know what finally worked! I used Claimyr to get through to ESD yesterday (thanks for that suggestion!), and explained the business closure situation. The agent could see all my documentation but said the claim was stuck because there was a verification flag that needed manual override. She processed it right there on the phone and said I should see payments for all my backed-up weeks within 48 hours! I'm so relieved - this has been incredibly stressful. The agent also mentioned that business closure claims often need special handling and recommended that others in this situation specifically mention "business closure verification" when they call in.
