ESD claim stuck in adjudication after identity theft and employer denial - what's next?

I'm at my wit's end with this ESD nightmare! My employer laid me off in November saying they couldn't afford my position anymore, but then they DENIED my unemployment claim when ESD contacted them?! Makes absolutely no sense. I filed on December 2nd and was told it would take 4-6 weeks for a decision. It's now February and I just called again - they said my case is 'in adjudication' but wouldn't explain what that means. Does adjudication mean I'm getting denied? On top of this mess, someone was somehow filing claims using my SSN while I was still employed (Aug-Nov). ESD had to investigate that from September through December before they would even process my legitimate claim. How does that even happen when my employer was submitting payroll taxes the whole time?? I've been picking up gigs through TaskRabbit to survive, but it's nowhere near steady enough to cover rent and bills. I'm applying everywhere but need something that pays at least $25/hr to make ends meet. Today I tried logging in and the system said my "identity could not be verified" even though I've submitted every document they asked for TWICE now. I contacted my state rep who just said they'd "escalate" it, whatever that means. Does adjudication mean rejection? Will I ever see any benefits? Is there ANY way to talk to a real person who can help?

Adjudication doesn't automatically mean denial! It means ESD is investigating the conflict between what you reported and what your employer reported. Since they said they couldn't afford your position but then contested your claim, ESD needs to determine who's telling the truth. The identity theft issue definitely complicates things. ESD has to be extra careful with your claim now because of the previous fraud. Unfortunately, their verification systems can sometimes lock you out if there's any hint of identity issues. Keep filing your weekly claims even while in adjudication. If you get approved, they'll pay retroactively for all eligible weeks you've filed. The identity verification problem is separate - you'll need to call the technical support line specifically for account access issues.

Thank you for clarifying! The ESD rep wasn't helpful at all when I asked what adjudication meant. Do you know how long adjudication typically takes? We're already way past their original 4-6 week estimate.

Something similar happens to me last year and my claim was denied cuz my employer said i quit when i was actually laid off!!!!!! ESD just believes whatever the employer says and you have to FIGHT to get them to actually investigate for real. they'll send u some letter with the decision and then u only have like 10 days to appeal it so check ur mail everyday!!!

That's exactly what I'm worried about! I don't understand how they can just take my employer's word for it when I have text messages showing they laid me off because of budget cuts. Did you end up appealing your denial?

Adjudication means ESD is investigating the discrepancy between your claim that you were laid off and your employer's claim that you should be denied benefits. This happens a lot - employers often contest claims even for legitimate layoffs because it can affect their unemployment insurance rates. The identity theft situation is likely causing additional verification delays. When someone has already fraudulently claimed under your SSN, ESD puts extra scrutiny on any new claims with that number. They're required to verify everything multiple times. Regarding your login issues - this is a separate technical problem. You'll need to call the technical support line specifically, not the regular claims line. When you call, immediately say "technical account access issue" when prompted. For the adjudication issue, unfortunately, the representative escalation is actually the best approach right now. I'd follow up with them in a week if you don't hear anything.

I had the exact same problem last year and found a service called Claimyr that helped me get through to an actual ESD agent in about 20 minutes instead of spending hours on hold. Changed everything for me because I finally talked to someone who could explain what was happening with my claim and fix the identity verification issue on the spot. They have a video showing how it works at https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 and their website is claimyr.com. Seriously worth it when you're dealing with both adjudication AND identity verification problems at the same time.

adjudication just means theyre looking into it. i was in adjucation for 9 weeks last year. they ended up approving me but it took FOREVER. keep calling every few days.

9 weeks?! I'm already going on 10 weeks since I first applied. Did they eventually pay you for all those weeks you were waiting?

THE WHOLE SYSTEM IS BROKEN BY DESIGN!!! They WANT you to give up and not get benefits you're entitled to. I had THREE separate adjudications last year and each one took 8+ weeks. Meanwhile they expect us to just magically pay rent?? The identity theft thing is just their excuse to delay even longer. I've seen so many people in your situation and ESD just drags their feet until people are literally homeless.

While I understand your frustration, adjudication is actually a legal requirement when there's conflicting information. ESD has to determine if the claimant qualifies under the law. They're required to investigate when an employer contests a claim. That said, the timeline has gotten much worse in recent years. Before COVID, adjudications typically took 3-4 weeks. Now they often take 8-12 weeks. The identity verification process is separate and should be handled more quickly through the technical support team.

I went through this exact situation in November! Employer laid me off then contested my claim. Make sure you're keeping detailed records of your job search activities (minimum 3 per week) while you wait. Also, try clearing your browser cache and cookies before logging in again - the ESD website has weird technical issues sometimes. For the adjudication, I recommend writing out a clear statement explaining exactly what happened with your separation from employment. Include dates, names, and any documentation you have (emails, texts, termination letter). You can upload this to your account under "Upload Documents" or have it ready when you finally speak to someone. The identity theft complication is frustrating but common. ESD is being extra cautious with your claim because of the prior fraud. Keep trying to log in every day - sometimes the system randomly works after failing repeatedly.

Thank you for the advice! I've been keeping track of my job search activities in a spreadsheet with screenshots of applications. I'll try the browser cache thing right now. Did your claim eventually get approved after adjudication?

Yes, my claim was approved after about 7 weeks in adjudication. I received backpay for all the weeks I had claimed during that time, so don't stop submitting your weekly claims! For the identity verification issue, I finally had success when I called the technical support line (not the regular claims line) first thing in the morning right when they opened. Asked specifically for the identity verification team.

Ugh I know this feeling! My identity was stolen last year and it was a NIGHTMARE getting ESD to sort it out. Took me three months and I had to send in my passport, birth certificate, AND utility bills twice because they "lost" the first set. The adjudication is actually separate from the identity verification - they're two different departments. For the identity issue, you might need to go to a WorkSource office in person with your documents. That's what finally worked for me.

Going to WorkSource is great advice. I'd also recommend checking if your local library offers free notary services. When I had identity verification issues, sending in notarized copies of my documents seemed to speed things up. Call your local WorkSource ahead of time though - some require appointments now.

Thanks everyone for your help and advice. I'm going to try that Claimyr service tomorrow morning. I called WorkSource and they said they could see me next Tuesday for help with the identity verification, so at least that's something. I'm still submitting my weekly claims even though I can't log in (using the phone system). This whole experience has been so demoralizing - I've never needed unemployment before and had no idea it would be this complicated. I'll update once I hopefully get through to someone who can help.

Good plan! One more thing - document every call you make to ESD. Write down the date, time, who you spoke with, and what they told you. This can be super helpful if you end up needing to appeal anything. Hang in there!
