Claim STILL in adjudication after both Governor's office AND Legislator escalations - is this normal??

I'm seriously at my wit's end with ESD. My claim has been stuck in adjudication for what feels like forever, with ZERO pending issues showing on my account. A month ago I managed to get the governor's office to escalate my claim (which was a whole ordeal in itself), and absolutely NOTHING happened. Then about 10 days ago, my state legislator's office stepped in to help after I practically begged them, and still NOTHING has changed! My claim status remains exactly the same - perpetually "in adjudication" with no explanation of what they're even adjudicating! I've tried calling countless times but either can't get through or am told someone will "look into it" with no results. I'm drowning in bills and about to miss my rent payment. Is this level of bureaucratic paralysis normal even after TWO government escalations? How much longer am I supposed to wait? Anyone had similar experiences with escalations that went nowhere?

Unfortunately this is becoming the new normal with ESD. My claim was stuck in adjudication for 11 weeks even after my legislator's office got involved. The system is completely broken. The frustrating part is they won't tell you what the issue is or give any timeline. Keep calling EVERY DAY and document everything. I finally got through to someone who could actually help after weeks of trying.

11 WEEKS?! I'm already going crazy after just 5 weeks total. Did you ever find out what the holdup was? I can't understand how they can leave people with no income and no explanation for months!

I've tried 8am, 10am, 1pm, 4pm... any hour they're open. Either can't get through or get someone who just says they'll "note my account" and nothing happens.

I work with unemployment cases regularly, and here's what's likely happening: when multiple escalations occur close together (like your governor's office and legislator), it can sometimes create confusion in their workflow system. Each escalation creates a separate tag on your claim, but doesn't necessarily push it ahead in the queue. Your best approach now is to: 1. Contact the legislative assistant who helped you and ask them to specifically request a "priority adjudication review" (use those exact words) 2. Make sure you've uploaded all possible documentation to your account that might relate to your separation reason 3. Continue filing weekly claims without fail 4. Check if you have any action items in your eServices account that need response The current adjudication backlog is running 6-8 weeks for standard cases, even with escalations.

Thank you for this detailed explanation. I had no idea the multiple escalations might actually be causing confusion. I'll contact my legislative assistant tomorrow with that exact wording. Is there any way to figure out what they're even adjudicating? My account shows no pending issues at all.

Sometimes the pending issue doesn't show in your eServices portal even though it exists in their internal system. This is often due to a verification flag that was triggered during their automated review process. When you speak with your legislative assistant, ask them to request that ESD provide you with the specific adjudication issue(s). That information should be available to them even if it's not visible to you.

OMG are you me?? My claim has been in adjudication since JANUARY!!! I've had the governor's office, my senator, AND my representative all try to help. They just keep saying "it's in process" whatever that means. I'm about to lose my apartment and had to borrow money from family just to eat. The whole system is designed to make people give up.

Since January?? That's completely unacceptable! Have you tried filing a complaint with the state ombudsman's office? That finally worked for my brother after 3 months of runaround.

After months of being stuck in adjudication hell last year, I finally got through to an actual ESD agent who could see my file using Claimyr (claimyr.com). Total gamechanger - they connect you directly to an ESD agent instead of waiting on hold forever just to get disconnected. You can see how it works in their video demo: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 Once I got through, the agent saw that my claim had been flagged for a verification issue that wasn't even showing in my online portal. They fixed it on the spot and my benefits started flowing the next week. Might be worth trying since even your government escalations aren't moving things along.

Thank you for the suggestion. At this point I'm desperate enough to try anything. Did the agent actually have the authority to fix your adjudication issue? I'm worried I'll just get another person who can only "make a note" on my account.

Not all agents can fix adjudication issues, but getting through to a real person is the first step. When I used Claimyr, I specifically asked if I could speak to a claims specialist or adjudicator. The first agent transferred me to someone who could actually see the details of my adjudication and resolve it. The key is getting past the initial automated system, which is what Claimyr helped with.

This happened to me last year, and I discovered my issue was due to an employer dispute that I didn't even know about. My former employer had contested my claim, but ESD never notified me. I only found out after weeks of confusion. One thing that might help - call your former employer's HR department and ask if they've received any communications from ESD about your claim or if they've contested it. Sometimes the logjam is happening because they're waiting for employer responses. In my case, once I contacted my former employer directly and sorted things out with them, my claim was processed within a week.

That's a great suggestion I hadn't thought of. I left on good terms with my employer, but maybe there's been some miscommunication between them and ESD. I'll give them a call tomorrow to see if they've received anything. Thank you!

The ULP is great, but they typically only help with appeals after a decision has been made. They probably can't do much while a claim is still in adjudication with no decision. That said, it's good to have their contact info ready for if/when a determination is made.

Just a follow-up on my earlier comment - make sure you're still submitting your weekly claims during this adjudication period. I've seen many claimants miss out on backdated benefits because they stopped filing weekly claims while waiting for adjudication to complete. Even if you're not receiving payments now, you must continue filing to be eligible for backpay once your claim is approved.

Yes, I've been diligently filing every week despite not receiving anything. At least if it does eventually get approved, I'll get backpay for all these weeks. Though at this rate, I might be employed again before they figure this out!

Last year I was in adjudication for 8 weeks, and what finally worked was sending a direct email to the ESD Commissioner's office explaining my hardship situation. I'm not saying it will work for everyone, but within 3 days of sending that email, my claim was suddenly processed. Sometimes going straight to the top can shake things loose when the normal channels are backed up. I included details about facing eviction and having medical needs that couldn't wait. If you're in a genuinely dire situation, it might be worth trying.

Do you still have the email address you used? I'm definitely in a hardship situation at this point - about to miss rent and car payment, and I have medication I need to refill next week.

I believe I sent it to commissioner@esd.wa.gov but that was last year so maybe double-check their website to make sure it's still current. Keep your email concise but include specific details about your hardship situation and all the steps you've already taken (governor's office, legislator, etc). Good luck!

Just checking back - any updates? Did any of the suggestions help move your claim forward?

Small progress! I finally got through to someone at ESD using Claimyr (definitely worth it after weeks of trying on my own). The agent confirmed there's an employer verification issue that's not showing on my portal. My former employer apparently hasn't responded to ESD's requests for information. I've contacted my ex-employer and they're going to submit the required info today. The agent also noted the hardship on my account and said it should expedite things once the employer responds. Fingers crossed, but at least now I know what the holdup is!
