Can you get unemployment and disability at the same time in Washington?
I'm really confused about this and getting mixed information online. I've been on temporary disability through L&I for a back injury from work, but my doctor says I might be able to do some light work soon. My disability payments are ending next month but I'm not sure if I'll be physically ready to return to my old job yet. Can I apply for unemployment benefits from Washington ESD while I'm still technically on disability? Or do I have to wait until disability completely ends? I don't want to mess up either benefit by applying wrong.

You generally can't collect both at the same time because they have conflicting requirements. For unemployment, you have to be able and available for work. For disability, you're saying you can't work. Washington ESD will deny your claim if you're receiving disability payments.

•That makes sense but what about when disability is ending? Like if I'm cleared for light duty but my employer doesn't have light duty work available?

•That's a different situation. Once disability ends and you're cleared to work but your employer can't accommodate, you might qualify for unemployment. You'd need to be fully able and available though.

I tried calling Washington ESD about this exact situation last year and could never get through to anyone who could give me a straight answer. Spent hours on hold.

•Have you tried using Claimyr? It's a service that helps you get through to actual Washington ESD agents. They have this system that calls repeatedly until they connect you with someone. Check out claimyr.com - there's even a demo video at https://youtu.be/7DieNd3C7zQ showing how it works.

•Never heard of that but might be worth trying. Getting through to Washington ESD is impossible otherwise.

The key thing is timing and your medical clearance status. If you're still on disability, Washington ESD considers you not able to work. But once you're medically cleared and disability ends, you can potentially qualify for UI if you meet the other requirements like job search.

•So I should wait until my disability payments completely stop before filing for unemployment?

•Yes, and make sure you have documentation that you're medically cleared to return to work. Washington ESD will want proof you're able and available.

This is so confusing! Why can't they just have clear guidelines somewhere?? I'm in a similar boat and nobody can give me a straight answer.

•The rules are actually pretty clear - you just can't collect both simultaneously. The confusion comes from the transition period when disability is ending.

•Well it's not clear to me! And calling Washington ESD is useless.

I had success with Claimyr when I needed to talk to someone at Washington ESD about a complex situation like this. They got me connected within a couple hours instead of me trying to call for days. Really worth the cost when you need actual answers.

•How much does something like that cost? I'm already tight on money with disability ending.

•I don't remember the exact amount but it was reasonable considering how much time it saved me. Way better than losing hours trying to get through myself.

There's also the issue of work search requirements if you do qualify for unemployment. You'll need to be actively looking for work that accommodates any restrictions you might still have.

Ali Anderson
•Good point. My doctor cleared me for light duty only, so I'd need to find jobs that match that restriction.

Donna Cline
•Exactly. And you'll need to document those job searches in WorkSourceWA just like any other unemployment claimant.

I think there might be some exceptions for certain types of disability but I'm not sure. Maybe vocational rehab situations?

•You're thinking of different programs. Regular disability and unemployment are still mutually exclusive in Washington state.

•OK thanks for clarifying. I wasn't sure about the specifics.

The timing is really important here. Don't file for unemployment while you're still receiving disability payments. Wait until disability officially ends and you have medical clearance.

Ali Anderson
•Should I file immediately when disability ends or wait a bit?

Kelsey Hawkins
•File as soon as you're able and available for work. There's a waiting week anyway so don't delay if you meet the requirements.

Just went through this myself. Had to wait until L&I disability completely ended before Washington ESD would even process my unemployment application. They made me provide documentation proving I was cleared to work.

Ali Anderson
•What kind of documentation did they want?

Dylan Fisher
•Medical clearance letter from my doctor and the final L&I closure paperwork showing disability benefits had ended.

Be careful about the work search requirements too. If you have restrictions, you need to be looking for jobs that accommodate those restrictions. Can't just apply anywhere.

Ali Anderson
•That makes sense. I'll need to focus on office jobs or other light duty positions.

•Right, and document everything in your job search log. Washington ESD will want to see you're making genuine efforts.

ugh this whole system is so complicated. why cant they just make it simple??

Lucas Parker
•It's complicated because they're different programs with different purposes. Disability is for when you can't work, unemployment is for when you can work but can't find a job.

•I guess that makes sense when you put it that way

Another thing to consider is whether you have enough work history to qualify for unemployment. If you've been on disability for a long time, you might not meet the base period requirements.

Ali Anderson
•I only been on disability for 3 months, so I should be ok on work history I think.
0 coins
Alfredo Lugo
•Yeah, 3 months shouldn't be a problem. They look at your work history over the past 18 months.

If you need to talk to someone at Washington ESD about your specific situation, I'd definitely recommend trying Claimyr. I used them last month when I had questions about my claim and they got me through to an actual agent who could review my case.

•I keep hearing about this service. Might be worth trying since I can't get through on my own.

•It really is. So much better than sitting on hold for hours or getting disconnected.

Make sure you understand the difference between being medically cleared for work and being able to do your previous job. Washington ESD cares about whether you can work at all, not whether you can do your specific old job.

Ali Anderson
•So even if I can't do my old construction job, as long as I can do some type of work I might qualify?
0 coins
Kaitlyn Jenkins
•Exactly. If you're cleared for light duty work, you're considered able and available for employment purposes.

I was in almost the exact same situation. The key is having everything documented properly when you apply. Medical clearance, end date of disability benefits, all of it.

Ali Anderson
•Did you have any problems with your unemployment application?
0 coins
Caleb Bell
•No problems once I had all the documentation. They processed it normally after that.

Don't forget about the job search requirements. You'll need to be making at least 3 job contacts per week and logging them in WorkSourceWA.
0 coins
Ali Anderson
•3 per week? That seems like a lot when I have restrictions on what I can do.
0 coins
Danielle Campbell
•It's the standard requirement for everyone. But you can focus your search on jobs that match your abilities.

The important thing is being honest about your situation. Don't try to collect both benefits at the same time - that's fraud. Wait until you're legitimately able and available for work.
0 coins
Ali Anderson
•Definitely don't want to get in trouble. I'll wait until disability officially ends and I have medical clearance.
0 coins
Rhett Bowman
•That's the smart approach. Better to wait a few extra days than risk benefit fraud charges.

Good luck with everything! The transition from disability to unemployment can be tricky but sounds like you're asking the right questions.

•Happy to help. Just remember - wait for disability to end, get medical clearance, then apply for unemployment if you meet all the other requirements.
