Can you get Washington ESD unemployment if you're on social security benefits?
My situation is a bit complicated and I'm not sure if I can even apply for unemployment benefits through Washington ESD. I've been receiving social security disability payments for the past 2 years, but I was also working part-time at a grocery store until they laid me off last month due to budget cuts. I earned about $800/month from that job and now I'm wondering if I can file for unemployment benefits while still getting my social security? I don't want to mess anything up with either program. Has anyone been in a similar situation?

Yes, you can absolutely receive both social security and unemployment benefits in Washington state. The key thing is that you have to meet the basic unemployment requirements - you need to be able and available for work. Since you were working part-time while on disability, that shows you're capable of working. You'll need to report your social security income when you file your weekly claims with Washington ESD.

•That's a relief! Do I report the full amount of my social security or just a portion of it?

•You report the full gross amount you receive from social security. Washington ESD will calculate any offsets based on their formula.

I was in almost the exact same boat last year. Getting through to Washington ESD to ask questions about this was nearly impossible though - spent hours on hold just to get disconnected. Finally found this service called Claimyr (claimyr.com) that helped me get through to an actual agent. They have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works. Made the whole process so much easier.

•How did that work out for you? Were you able to collect both without any issues?

•Yeah, no problems at all. The Washington ESD agent explained everything clearly once I could actually talk to someone. The key is being honest about all your income sources.

•I've heard mixed things about those phone services. Did they actually help or just get you in the queue?

Wait, I thought if you're on disability you can't work? How were you working part-time while getting social security disability payments? Doesn't that disqualify you from both programs?

•Social Security has work incentive programs that allow people on disability to work and earn up to certain amounts. It's called the Trial Work Period and Substantial Gainful Activity rules.

•Exactly what they said. I was approved to work part-time within the SGA limits. That's why I'm hoping I can still get unemployment now that I lost that job.

This is getting confusing. So you can get unemployment AND social security at the same time? That seems like double dipping to me...

•It's not double dipping - they're completely different programs with different purposes. Social Security is based on disability status, unemployment is based on losing work through no fault of your own.

•My cousin collects both and has for months. It's totally legal as long as you report everything correctly to both agencies.

The trick is making sure you can meet the 'able and available for work' requirement for unemployment. If you're on disability, Washington ESD might question whether you're truly available for work. You'll need to be able to explain how you can work despite your disability.

•That makes sense. Since I was already working, I should be able to demonstrate that I'm capable of working within my limitations.

•Make sure you have documentation from your doctor about what kind of work you can do. Washington ESD might ask for that during the application process.

I tried this exact thing 6 months ago and got denied initially. Took forever to get through to someone at Washington ESD to appeal it. The system is so backed up with claims.

Felix Grigori
•Oh no, what happened with your appeal? Did you eventually get approved?

•Yeah, after 8 weeks of waiting I finally got a hearing and they approved me. Just had to prove I was actively looking for work within my physical limitations.

•That's exactly why I used Claimyr - avoided all that waiting and got my questions answered right away. Saved me weeks of stress.

Don't forget you'll need to register with WorkSource Washington and do your job searches every week. They might have accommodations for people with disabilities in their job search requirements.

•Good point. Do I need to register before I file my unemployment claim or can I do it after?

Lindsey Fry
•You can register after filing, but don't wait too long. They'll start requiring job search activities pretty quickly after your claim is approved.

Just be really careful about how much you earn if you find another part-time job while collecting. The earnings limits are tricky when you're getting both social security and unemployment.

•True - you have to consider both the social security SGA limits AND the unemployment partial benefit calculations. It can get complicated.

Felix Grigori
•Ugh, this is getting overwhelming. Maybe I should just stick with my social security and not complicate things.

•Don't give up! You paid into unemployment insurance through your work. You deserve those benefits if you qualify.

SSDI and unemployment are totally compatible in Washington. I've been doing it for almost a year now. The key is being transparent with both agencies about your income from all sources.

•That's reassuring to hear from someone who's actually doing it successfully. Any tips for the application process?

•When they ask about your availability for work, be specific about what you can do. Don't just say 'yes' - explain your capabilities and any accommodations you might need.

Make sure you understand how social security counts unemployment benefits too. Sometimes it can affect your disability review if they think you're working more than you should be.

•Wait, unemployment benefits could affect my disability status? Now I'm worried again.

•Unemployment benefits themselves don't count as work activity for social security purposes. But if you're collecting unemployment, it shows you're looking for work, which they already know since you were working part-time.

honestly this whole system is so confusing. why can't they just make it simple to understand what you can and can't do when your on different programs

•I know right? I spent three days trying to figure out if my part time work would mess up my benefits. Ended up calling like 10 different numbers.

•That's exactly why services like Claimyr exist - to cut through all the confusion and get you straight answers from the people who actually make the decisions.

You should file ASAP because there's a waiting week for unemployment benefits in Washington. The sooner you get your claim in, the sooner you can start receiving payments.

Felix Grigori
•Is there still a waiting week? I thought they eliminated that during COVID.

Arnav Bengali
•They brought it back in 2023. So your first week is unpaid, then you start getting benefits for subsequent weeks if approved.

I'm curious about the job search requirements too. If you're limited in what work you can do because of your disability, how does that work with the WorkSource requirements?

•Washington ESD has to make reasonable accommodations for job search activities. You might be able to limit your search to certain types of jobs that fit your restrictions.

Felix Grigori
•That's good to know. I was worried I'd have to apply for jobs I physically can't do.

One thing to watch out for - if your unemployment claim gets denied initially, don't panic. A lot of these dual benefit situations get flagged automatically and require manual review. Just be prepared to provide documentation about your work history and disability status.

•What kind of documentation should I gather before I apply?

Rachel Tao
•Your social security award letter, any work authorization from your doctor, pay stubs from your part-time job, and your termination notice from the grocery store.

Bottom line - you have every right to apply for unemployment if you lost your job through no fault of your own. Being on disability doesn't automatically disqualify you, especially since you were already working. Just make sure you can honestly say you're able and available for work within your limitations.

•Good luck! The worst they can do is say no, but it sounds like you have a solid case for approval.

•And remember, if you need to talk to someone at Washington ESD directly, don't waste hours on hold. That Claimyr service I mentioned earlier really does work.
