Can you file unemployment if you resign in Washington - confused about eligibility
I'm thinking about quitting my job because my boss has been making work conditions really difficult lately. Before I do anything stupid, can you actually file for unemployment benefits with Washington ESD if you resign? I know it's different than being laid off but I'm not sure what the rules are. I've been at this company for 2 years and really need to know if I'd qualify for UI benefits before I make this decision. Has anyone been through this situation?

Generally speaking, you can't get unemployment if you quit voluntarily. Washington ESD considers that a disqualification. However, there are some exceptions for 'good cause' situations like unsafe working conditions, harassment, or significant changes to your job duties or pay. You'd need to prove the circumstances were beyond your control.

•What counts as 'good cause'? My situation is more about a toxic manager making my life miserable but I'm not sure if that qualifies.

•Toxic management can qualify if you can document harassment, discrimination, or unsafe conditions. Keep records of everything - emails, incidents, witnesses if possible.

I quit my last job and got denied initially but won on appeal. The key is having documentation. Washington ESD will want proof that you had no reasonable alternative but to quit.

•How long did the appeal process take? I'm worried about being without income for months.

•Mine took about 6 weeks total. The hearing was actually pretty straightforward once I had my documentation together.

I had to use Claimyr to get through to someone at Washington ESD when I was dealing with a quit situation. Couldn't get anyone on the phone for weeks trying the normal way. Their service at claimyr.com helped me reach an adjudicator who explained exactly what documentation I needed. There's a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works.

•Never heard of that service. Is it legit? Washington ESD phone lines are definitely impossible to get through to.

•Yeah it's real, they basically keep calling until they get you connected to an actual person. Saved me probably 50+ hours of redialing.

•That might be helpful if I decide to file. The thought of trying to reach Washington ESD by phone is already stressing me out.

Before you quit, try talking to HR or filing a complaint internally first. Washington ESD wants to see that you tried to resolve the issue before leaving. Also consider if you might qualify for FMLA or other protections.

•We don't really have HR, it's a small company. The owner is basically my boss and he's the problem.

•That makes it tougher but document everything anyway. Even small companies have legal obligations about workplace conditions.

whatever you do dont just quit without having another job lined up!!! unemployment is never guaranteed especially if you quit voluntarily

•I know that's the smart thing to do but this situation is really affecting my mental health. Sometimes you have to prioritize your wellbeing.

•I understand that completely. Mental health is important too. Just make sure you understand the financial risk you're taking.

Here's what Washington ESD specifically looks for in 'good cause' quit situations: 1) Unsafe working conditions 2) Harassment or discrimination 3) Significant reduction in hours or pay 4) Major changes to job duties 5) Employer violating labor laws. Document everything and be prepared to prove your case.

•This is really helpful. I had no idea there were specific categories they look for.

•My situation might fall under harassment. Boss has been making comments about my appearance and gives me impossible deadlines while others get easy assignments.

•That could definitely qualify. Start documenting dates, times, witnesses, and any written communication about these incidents.

I tried to file after quitting due to unpaid overtime and got approved after adjudication. Took about 3 weeks for them to investigate but they agreed the employer was violating labor laws.

•Good to know it's possible. Did you have to provide a lot of documentation during adjudication?

Javier Morales
•Yeah, timesheets, emails, pay stubs showing the unpaid hours. The more evidence the better.

Just remember that even if you quit for good cause, you still have to meet all the other unemployment requirements - actively searching for work, being able and available, etc. It's not just about proving you had a good reason to quit.

•Right, I'd definitely be looking for work immediately. How many jobs do you have to apply to each week in Washington?
0 coins
Malik Robinson
•It's 3 job search activities per week minimum, but they can be applications, networking, job fairs, etc. Check the WorkSourceWA website for details.

ugh the washington unemployment system is so complicated. why cant they just make it simple - if you need help you get help

•I agree it's confusing but the rules exist to prevent fraud and make sure benefits go to people who lost jobs through no fault of their own.

•i get that but when you're dealing with a terrible work situation you shouldnt have to become a lawyer to figure out if you qualify

Another thing to consider - even if you think you have good cause, Washington ESD might initially deny your claim and you'll have to appeal. That's where having all your documentation ready becomes crucial. And honestly, being able to talk to someone there helps a lot with understanding exactly what they need.

•You mentioned that calling service earlier - do they help with appeals too or just initial claims?
0 coins
Natasha Petrova
•They just help you get connected to Washington ESD staff on the phone. But that's super valuable during appeals because you can ask specific questions about your case.

One more tip - if you do quit and file, be completely honest on your application about why you left. Don't try to make it sound like you were fired or laid off. Washington ESD will verify with your employer anyway and lying will disqualify you permanently.

•Definitely won't lie about it. Just trying to figure out if my situation actually qualifies before I make any decisions.

•Smart approach. Maybe consult with an employment attorney too if you're unsure. Many offer free consultations.

I was in a similar situation last year and ended up staying at my job while looking for something else. Sometimes the devil you know is better than the uncertainty of unemployment, even if you might qualify.

•How did you handle the stress of staying in a toxic environment? I'm worried it's going to affect my work performance and make things worse.

•It was rough but I focused on my exit strategy and tried to document everything just in case. Having a plan helped me feel more in control.

whatever you decide, make sure you understand that unemployment benefits in Washington max out at like $844 per week. thats not a lot to live on so factor that into your decision

QuantumQuest
•Good point. That's definitely less than I make now but might be enough to get by temporarily.

Malik Robinson
•The actual amount depends on your earnings history. Washington ESD calculates it based on your highest quarter in the base period.

If you're dealing with harassment or discrimination, you might also want to file a complaint with the Washington State Human Rights Commission or EEOC. That documentation could help support your unemployment claim too.

QuantumQuest
•I hadn't thought about that. Would filing a complaint with them strengthen my case with Washington ESD?

Emma Davis
•It shows you took formal steps to address the problem, which Washington ESD likes to see. Plus it creates an official record of the issues.

been following this thread and just wanted to say good luck with whatever you decide. toxic workplaces are the worst and nobody should have to put up with that

Final advice - if you do decide to quit and file, make sure you file your initial claim right away. There's no waiting period for quit situations to file, and you want to get the process started as soon as possible since adjudication can take several weeks.

Just remembered - when I was going through my quit situation, the Washington ESD person I finally got connected to through Claimyr mentioned that they prefer when people call to discuss their specific circumstances before filing. Might be worth trying to get through to someone first.

•That's a great suggestion. Better to know for sure before I make any big decisions.

•Agreed, talking to someone there can save you a lot of time and stress if you don't actually qualify.

i quit my job without good cause and got denied. now im working retail making way less than before. should have just stuck it out and found something else first. learn from my mistake

One last thing - even if you qualify for unemployment after quitting, most employers will fight it because it affects their unemployment tax rate. Be prepared for them to contest your claim and have all your evidence ready.
0 coins
QuantumQuest
•Good to know. My employer definitely seems like the type who would contest it just to be difficult.
0 coins
Malik Robinson
•That's pretty common unfortunately. But if you have legitimate good cause and proper documentation, you should be fine even if they contest it.
