Can I collect Washington ESD unemployment if I get fired for poor performance?
Got terminated last Friday from my retail job after 8 months. My manager said it was due to 'performance issues' - mainly that I was too slow during busy periods and made some register errors. I never got any formal write-ups though, just verbal warnings. Can I still file for unemployment benefits through Washington ESD? I'm worried they'll deny my claim since I wasn't laid off. Has anyone been in a similar situation?

Yes, you can absolutely file! Performance issues usually don't disqualify you from unemployment benefits in Washington. The key distinction is whether you were fired for 'misconduct' versus just not meeting performance standards. Poor performance alone typically doesn't constitute misconduct under Washington ESD rules.

•That's reassuring, thank you. Should I mention the verbal warnings when I file my claim?

•Be honest about everything when you file. Verbal warnings for performance actually help your case - it shows they were trying to help you improve rather than disciplinary action for misconduct.

I got fired for performance issues at my warehouse job last year and still got approved for UI benefits. Took about 3 weeks for adjudication but they approved it no problem.

•That gives me hope. Did your employer contest your claim at all?

GalacticGladiator
•They didn't contest it. I think most employers don't bother unless it's clear misconduct like theft or something.

File your claim ASAP - you have a good case. Washington ESD looks at whether the termination was for 'misconduct connected with work.' Poor performance, inability to meet standards, or lack of skills generally don't qualify as misconduct. The fact that you received warnings shows they were trying to help you improve.

•Already started my application online. How long does the adjudication process usually take?

•Typically 2-4 weeks for performance-related terminations. They'll contact both you and your employer to get the full story.

I had a similar situation trying to reach Washington ESD about my claim status. Couldn't get through on the phone for weeks. Finally used claimyr.com to get connected to an actual agent - they have this service that calls you back when an agent is available. There's a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works. Made the whole process so much easier.

•Is that legit? Sounds too good to be true with how impossible it is to reach them.

•Yeah it's real. I was skeptical too but it actually worked. Saved me hours of trying to call.

•I might need that if my claim goes into adjudication. Thanks for the tip!

MAKE SURE you document everything about your termination. Write down exactly what they told you, any warnings you received, dates, etc. If they try to fight your claim you'll need that info.

•Good point. I should write down what happened while it's still fresh in my memory.

Performance issues vs misconduct is the key. I work in HR and we don't contest UI claims for performance unless there was clear policy violation or insubordination involved.

•That's helpful insight. I never violated any policies, just struggled with speed during rushes.

•That's classic performance issue, not misconduct. You should be fine for benefits.

•What about attendance issues? I got fired for being late too many times.

•Attendance can be trickier - depends if it's excessive and whether you had valid reasons. Still worth filing though.

ugh the whole system is so confusing. i got fired from my last job too but was too scared to file because i thought they'd automatically deny me

•You should still file! Even if you think you might get denied, let Washington ESD make that determination. The worst they can say is no.

•maybe i will. how long do you have to file after getting fired?

Ethan Brown
•You should file within the first week after becoming unemployed to avoid any delays in benefits.

Been through this exact situation. Filed my claim online and got approved within 2 weeks. No issues at all. The employer didn't even respond to Washington ESD's inquiry.

Mateo Rodriguez
•That's encouraging. Did you have to do anything special during the application process?

Jamal Anderson
•Nope, just answered all questions honestly. Be straightforward about what happened.

Make sure you understand the difference between being fired for cause vs poor performance. Cause usually means theft, harassment, policy violations - stuff that's your fault. Poor performance is different and usually doesn't disqualify you.

Mateo Rodriguez
•Yeah, I was just slow and made some mistakes. Nothing dishonest or against policy.

•Then you should be good to go. File that claim!

Also remember you'll need to do job searches every week once you start claiming. Washington ESD requires 3 job search activities per week.

•Good to know. What counts as job search activities?

•Applying for jobs, networking, job interviews, job fairs, etc. They have a list on the website.

I've been following this thread and it's really helpful. I'm in a similar boat but was fired for 'attitude problems' according to my boss. Think that's misconduct?
0 coins
Ethan Brown
•That's borderline. Depends on what specifically happened. If it was just personality conflicts, probably not misconduct. If you were insubordinate or violated policies, might be different.

Liam McGuire
•It was mostly that I didn't get along with my supervisor. No policy violations though.

Aisha Hussain
•Personality conflicts usually aren't misconduct. Still worth filing your claim.

Quick update - I mentioned claimyr.com earlier and just wanted to say it really does work. Used it again this week to check on another issue and got connected within an hour instead of spending all day redialing.

The Washington ESD adjudication process can be nerve-wracking but most performance-related terminations get approved. Just be patient and honest in your responses.

One thing to watch out for - some employers will try to claim it was misconduct even when it wasn't, hoping you won't appeal. If you get denied, definitely appeal if you know it was just performance issues.

Mateo Rodriguez
•Good to know. How do you appeal if needed?
0 coins
NeonNomad
•You get appeal instructions with any denial notice. Usually you have 30 days to file the appeal.

Performance terminations are pretty common in retail. Most of the time Washington ESD approves these claims because it's not willful misconduct.

Mateo Rodriguez
•That's reassuring since I was in retail too.

Just remember to file your weekly claims even if your initial claim is under review. You don't want to miss any weeks.
0 coins
Mateo Rodriguez
•Will do. I assume they tell you about that during the application process?

Dylan Mitchell
•Yes, they'll give you all the details once you submit your initial claim.

I got fired for performance at my call center job and had no issues getting approved. Just took a few weeks for them to review everything.

The system actually works pretty well for legitimate claims. Don't let fear stop you from filing if you were terminated for performance reasons.

Best of luck with your claim! Performance issues are totally different from misconduct in Washington ESD's eyes. You should be fine.

One more tip - if you do need to contact Washington ESD directly about your claim, that claimyr service I mentioned earlier has been a lifesaver. Way better than trying to get through on your own.
