Was a bit nervous or untrusting at first, but my calls went thru. First time the wait was a bit long but their customer chat line on their page was helpful and put me at ease that I would receive my call. Today my call dropped because of EDD and Claimyr heard my concern on the same chat and another call was made within the hour.

UPDATE: I just got off the phone with ESD (finally!!) and they explained that they think I worked during two weeks in February when I was still claiming benefits. The problem is I didn't start my new job until March 2nd, and I definitely reported that correctly on my weekly claims. The agent I spoke with said I need to gather pay stubs, my official hire letter, and anything else showing my actual start date, then file an appeal ASAP since I only have about 2 weeks left in my appeal window. Wish me luck!

Good work! Definitely file that appeal right away - don't wait until the last day. In addition to your hire letter and pay stubs, see if your employer can provide a simple statement confirming your start date. If you filed your weekly claims online, you might also want to take screenshots of your claim history showing you reported your new employment correctly when it actually started. anyone know if they can take the money from your bank account directly??? i just got a overpayment letter too (for $1890) and im worried they'll just take it from my checking account which would literally overdraft me by like $1500 😱

They typically don't take money directly from bank accounts without going through a formal garnishment process first, which requires additional legal steps. If you're concerned, you should contact ESD right away and set up a payment plan or file an appeal if you believe the overpayment is incorrect. They're usually willing to work with you on reasonable payment arrangements.

One more important tip: While waiting for your appeal or correction, make sure you're meeting the job search requirements each week (3 job search activities). Document everything carefully in your job search log. Even though your claims show as disqualified now, if the disqualification is overturned, they'll check that you were meeting all other requirements during that time.

Based on your last comment about the employer contesting the reason for separation, your claim is definitely in adjudication. When there's a discrepancy between your stated reason for separation and your employer's, ESD has to investigate before making a decision. This will typically add 3-6 weeks to the process. Since you provided documentation about the department restructuring, that's helpful. If you haven't already, make sure that documentation is uploaded to your eServices account. Continue filing weekly claims, and remember that if approved, you'll receive payment for all eligible weeks you've claimed.

Thank you so much for confirming. I did upload the documentation, including the layoff notice that mentioned the restructuring and emails from HR about the layoff affecting multiple people in my department. I'll keep filing and hope for the best!

Glad to see you got some good information here. One last thing I'll add - if you end up waiting more than 6 weeks total, you might want to contact your state representative or senator. They often have staff dedicated to helping constituents with ESD issues, and they can sometimes speed things up. But for now, it sounds like your claim is following the normal (though frustratingly slow) process for a contested separation reason.

ESD is such a joke in this state. they take MONTHS to review anything then demand you pay back thousands with barely any notice. the whole system is designed to frustrate people into giving up. and don't get me started on their "improved" website that crashes every other day.

So true! My cousin works for the state (not ESD) and she says they're severely understaffed. Apparently they lost like 40% of their experienced staff after COVID and haven't been able to replace them. Not excusing it, but explains why everything takes forever now.

Whatever you do, make sure you keep responding to the overpayment notice even if you can't reach anyone by phone. I ignored mine thinking I'd get it sorted out later and they ended up garnishing my tax return without warning! The 1099-G issue is less urgent but still important to fix before next tax season. I'd recommend a dual approach: 1. Schedule the in-person appointment as others suggested 2. Submit a formal appeal through eServices immediately 3. Contact your state representative (seriously - this worked for me when nothing else did) Good luck! Let us know how it goes.

Yes, I called my state representative's office and explained the situation. Their staff took my information and said they'd reach out to their ESD liaison. Within a week, I got a call directly from someone at ESD who had reviewed my case. Representatives often have dedicated contacts at agencies that can help constituents with problems that seem impossible to resolve through normal channels.
