Social Security payment after death - Was my mom's January check for December benefits?
My mom passed away on January 8th, 2025 at age 79. I'm trying to figure out if the Social Security payment that was deposited to her account on January 15th needs to be returned or not. Someone told me that SS payments are for the previous month, so the January payment would actually be for December 2024 when she was still alive. Is this correct? The funeral home said they would notify Social Security about her passing but now I'm worried about what happens with this final payment. Does anyone know the official rule on this? I don't want to get hit with an overpayment notice later.

You're absolutely correct. Social Security benefits are paid in arrears, which means the payment received in January is for December benefits. Since your mother was alive for all of December, that payment is rightfully hers (and now her estate's). You do NOT need to return that payment. However, she would not be entitled to any payment for January (which would normally arrive in February) since she passed away during January. The SSA's rule is that a person must live through the entire month to receive benefits for that month.

sorry for your loss... my dad died last year and yes the jan payment is for december so your mom was entitled to it. the funeral home will notify SSA and they'll stop future payments automatically.

•This is mostly right but not completely. The funeral home MIGHT notify SSA but it's not guaranteed! When my husband passed, I had to call SSA myself because the funeral home dropped the ball. Better to make sure yourself than assume it's taken care of.

When my aunt died last month we had to return HER payment but that's because she died on December 28th and then a January payment still came through. The bank actually froze her account when they found out she passed and then the social security office contacted us about returning the funds. I think as long as the person was alive the whole month of December the January payment is legitimately theirs. But I'm not 100% sure!

•You need to apply for the death benefit - it's not automatic. You can call SSA directly to both report the death and apply for the death benefit in the same call. Do this sooner rather than later as there's a time limit on claiming the death benefit (generally 2 years, but better to handle it promptly).

I've been trying to reach SSA to report my father's death for TWO WEEKS and can't get through! The phone lines are always busy or I get disconnected after waiting for an hour. This is ridiculous! I found this service called Claimyr that got me through to a real person at SSA in about 20 minutes instead of waiting on hold for hours. IMPORTANT! Make sure you don't spend that January money until you're 100% certain you can keep it! The SSA has been known to demand money back months or even YEARS later if they think there was an error. Document everything and maybe even call them to confirm what others here are saying about it being for December. I've seen too many people get hit with surprise overpayment notices.

•No, that's not how it works. The January 15th payment was for December benefits (when she was alive the entire month). She wouldn't be entitled to the February payment (which would cover January) since she didn't live through all of January. But the payment already received in January is correctly paid since it covers December.
