TWC claim stuck 'under review' for 4 weeks after sudden termination - right before bonus payout
Has anyone else had their TWC claim sitting in limbo forever? I was fired without warning from my remote job on July 8th. My employer claimed 'performance issues' but conveniently terminated me just TWO DAYS before I was supposed to get a $4000 sign-on bonus. Seems super sketchy right? 🙄 I filed for unemployment on July 23rd and have now submitted 4 payment requests. I've completed the ID.me verification already but when I log in, it still shows my claim is 'under review' and shows $0.00 deposited. I've tried calling TWC but just get the busy signal every single time. This is getting ridiculous! I have bills piling up and can't get anyone to tell me what's happening. How long does TWC typically take to either approve or deny benefits when there's a termination involved? Is there anything I can do to speed things up?

unfortunately this happens ALL THE TIME with TWC. they take FOREVER with termination cases because they have to contact your employer and get their side of the story. if your employer is dragging their feet responding (which they probably are since they fired you right before a bonus), TWC will just keep your claim on hold. it sucks but that's how they operate.

For termination cases, TWC has to conduct a fact-finding process that typically takes 3-6 weeks. Since your employer claimed performance issues, TWC needs to determine if you were fired for misconduct (which would disqualify you) or just general performance issues (which usually qualifies for benefits). The timeline is longer right now because of high volume, but here's what you should do: 1. Keep submitting your payment requests even while under review 2. Make sure you're doing your 3 required work search activities each week 3. Check your correspondence inbox daily for any fact-finding questionnaires they might send 4. i had kinda same thing happen with me they fired me saying i wasnt good fit but really my boss just didnt like me lol... my claim said review for like 6 weeks n then suddenly money showed up in my account one day with all the back pay. so keep checking ur bank account

I'd be concerned about the timing of your termination right before that bonus payout. That's something you might want to mention specifically during any fact-finding interview with TWC. If they fired you to avoid paying the bonus, that could strengthen your case. In my experience helping several people with their claims, termination cases take longer because TWC has to determine if misconduct was involved. They define misconduct as 'mismanagement of a position of employment by action or inaction, neglect that jeopardizes the employer's interests, deliberate violations of standards of behavior, or disregard of the employer's interests.' If your employer just claims you weren't meeting performance expectations but can't prove actual misconduct, you should eventually be approved. But the waiting is brutal, I know.

Also document any positive performance reviews or lack of formal warnings. If you have any emails or messages praising your work, save those too.

I had a similar situation last year. My employer fired me claiming I wasn't meeting standards, but they couldn't provide any documentation of warnings. My claim was stuck on review for almost 5 weeks, and I was panicking about bills. What finally worked was contacting my state representative's office. I filled out their constituent services form explaining my situation with TWC, and someone from their office called TWC on my behalf. My claim was processed within 3 days after that. my cousin works at TWC and she says there super backlogged right now. July is always busy with new claims. just keep requesting ur payments even tho ur getting $0 because when they finally approve u, they'll pay all the weeks u requested. good luck!!!

UPDATE: I took several of your suggestions and finally got some answers! I used Claimyr to reach TWC (after 30+ failed attempts calling directly) and found out my employer is claiming I was fired for not meeting performance metrics. The TWC agent scheduled a fact-finding interview for next week. I also contacted my state rep's office and they said they'd follow up on my claim. Between these two actions, things are finally moving! The agent confirmed that if approved, I'll get backpay for all the weeks I've been requesting payment. I'll update again after my interview.
