TWC appeal hearing - employer no-show. Does this help my case?

Had my TWC appeal hearing this morning after getting denied benefits initially. The weird thing is my former employer didn't show up at all! The hearing officer went through with it anyway, asking me questions about my termination and why I felt it wasn't my fault. I answered everything honestly, but I'm super nervous about the decision. Does anybody know if an employer no-show typically helps the claimant's case? This is my first time dealing with unemployment and I really need these benefits to come through. The hearing officer said I'd get a decision by mail in 7-10 days but that feels like forever when I've got bills due next week.

This is actually really good news for you! When an employer doesn't show up for the appeal hearing, they can't present any evidence against your version of events. The hearing officer only has your testimony to go on. In my experience (I've been through two TWC appeals), if you presented a reasonable explanation for why you shouldn't be disqualified and the employer isn't there to contradict you, your chances improve dramatically. Just make sure you check your correspondence inbox on the TWC portal daily - sometimes the determination letter shows up there before you get the physical mail.

Thank you! That makes me feel a bit better. Did it take the full 7-10 days to get your decision? I'm checking my TWC portal obsessively.

My employer skipped my hearing last year and I STILL got denied!! The hearing officer claimed my employer submitted "sufficient written evidence" beforehand so they didnt NEED to show up. THE SYSTEM IS RIGGED AGAINST US!! TWC just sides with employers most of the time no matter what. They don't care that I couldn't pay my rent for 2 months while waiting for their stupid decision.

While it's generally favorable when an employer doesn't appear at a TWC appeal hearing, it doesn't automatically guarantee approval. The outcome depends on a few key factors: 1. Did your employer submit documentation before the hearing? 2. Is your reason for separation clearly eligible under TWC rules? 3. Did you provide specific, detailed testimony during the hearing? If your employer didn't submit any evidence beforehand and you gave a convincing explanation of why your separation wasn't disqualifying (like it wasn't misconduct or a truly voluntary quit), your chances are very good. In my experience handling multiple appeals, decision letters often arrive faster than the quoted timeframe - usually 5-7 business days.

They did submit the separation paperwork where they claimed I was terminated for performance issues, but I explained that I never received any written warnings and was never put on a performance improvement plan. I have 5 years of good performance reviews until this new manager came in 2 months ago. I think I made a good case, just hoping it's enough.

When I had my appeal last month, I spent HOURS trying to reach TWC to confirm some details about my hearing. Kept getting busy signals and disconnects. Finaly used a service called Claimyr (claimyr.com) that got me through to an actual TWC agent in about 20 minutes instead of days of trying. They have a video showing how it works: https://youtu.be/V-IMvH88P1U?si=kNxmh025COIlIzKh Totally worth it for the peace of mind before my hearing. As for your question - my employer showed up to mine so I can't say for sure, but I did win my appeal even with them there because I had documentation proving my side.

Yeah it worked for me when I was desperate to talk to someone before my hearing. Much better than the constant busy signals I was getting before.

4 days would be amazing! Did they direct deposit the backpay right away or did that take longer?

To answer your follow-up question - in my case, the decision letter appeared in my correspondence inbox after 6 days. Once approved, it took another 3 business days for the backpay to hit my account. Make sure your payment method is set up correctly in the system. If you're approved, you'll also need to continue submitting your payment requests on your regular schedule for any weeks going forward.

This is correct. Also make sure you keep doing your work search activities (minimum 3 per week) and documenting them even while waiting for the appeal decision. If you win, you'll need to have those ready when you request payment for the waiting weeks.

quick question - did anyone have to do those stupid work search requirements during the appeal process? i thought we didn't have to do that until after getting approved but my friend said i should be doing them now just in case??? so confused

Yes, you absolutely should continue your work search activities (minimum 3 per week in Texas) and document them even while your appeal is pending. If you win your appeal, TWC will ask for your work search information when you request payment for those weeks. If you haven't been doing them, you could potentially lose benefits for those weeks even after winning your appeal.

Got my decision today - APPROVED!!! Only took 5 days instead of the 7-10 they said. The letter specifically mentioned that "claimant's testimony was found credible and employer failed to appear to provide contradicting evidence." Thank you all for the support! Now waiting for the backpay to hit my account.

That's fantastic news! Congratulations! The backpay usually processes within 3-5 business days. Be sure to continue your regular payment requests and work search activities going forward.
