PA UC wage protest taking forever - employer didn't report my quarterly income

I submitted a wage protest with PA UC about 6 weeks ago because my former employer didn't include my full quarterly earnings when they reported to unemployment. They completely left out my commission pay which was about $3,200 last quarter! My weekly benefit amount is way lower than it should be because of this. The UC rep I talked to when filing said it would take 'a few weeks' to resolve, but it's been over a month and a half with no updates. Has anyone gone through the wage protest process? How long should I realistically expect to wait? I'm getting worried because bills are piling up and I'm getting less than I should be each week.

Wage protests in PA can take anywhere from 4-12 weeks to process, unfortunately. The system is backed up right now. I went through this last year when my employer misreported my wages. Make sure you've uploaded all your paystubs and W-2 documentation to your dashboard to speed things up. You should also call and check on the status - sometimes they need additional info but don't notify you properly.

Thanks for the info. I did upload my paystubs but I've been trying to call for 3 days straight and can't get through. It just keeps saying 'all agents are busy' and disconnects me. Do they ever actually answer?

OMG same thing happend to me!! My old boss didnt report my overtime hours and it took FOREVERRR to get fixed!! I swear PA unemployment is designed to make ppl give up. I waited like 9 weeks and then out of nowere got a letter saying they fixed it and would pay me the diference. Hang in there!

9 weeks?! That's so frustrating. Did they at least backpay you for all the weeks you were getting the lower amount?

Yeah they did backpay everything but took another 2 weeks after the determination letter to actually get the money on my card. The whole thing is a mess honestly

I know this doesn't directly answer your question about wage protests, but I had a similar issue with getting through to PA UC last month. I found this service called Claimyr (claimyr.com) that got me connected to an agent in about 20 minutes after trying for weeks on my own. They have a video showing how it works: https://youtu.be/CEPETxZdo9E?si=WL1ZzVZWG3KiHrg2. The agent I spoke with was able to check on my claim status and tell me exactly what was happening. Might be worth trying since you've been waiting so long.

is that service legit? sounds too good to be true considering i cant even get thru after calling 60+ times

It worked for me. I was skeptical too but was desperate after trying for two weeks straight to get through. The video on their site shows exactly how it works. You still talk directly with the same UC agents, they just help you get through the phone system.

I work for a company that deals with unemployment issues and here's what you need to know about wage protests in PA: 1. Standard processing time is 6-8 weeks under normal circumstances 2. Current backlog is pushing that to 10-12 weeks in many cases 3. They will backpay you for the full amount once resolved 4. The determination letter will come by mail AND show in your dashboard One thing that might help: ask for a partial wage redetermination while you wait. Sometimes they can adjust your WBA based on the wages they've already verified while the full investigation continues. Call and specifically request this - it's not automatic.

Thank you so much for this detailed info! I didn't know about asking for a partial redetermination - that would be a huge help while waiting. I'm going to try calling again tomorrow morning right when they open.

my freind had this EXACT SAME PROBLEM!!!! her boss didnt report like $5000 of her income and it took almost 3 months to fix!!!! the system is BROKEN!!! she kept calling and they kept saying "its in process" but wouldnt give her any real info. unemployment is a JOKE

While the system certainly has its flaws, 3 months is unusually long. Did your friend regularly follow up? Sometimes claims get stuck in the system if certain information is missing. Regular contact with UC can help flag these issues.

she called like every week but they just gave her the runaround every time. finally she had to get her state rep involved and then magically it got fixed in like 3 days. typical government BS

Have you tried completing an Inquiry Form through your UC dashboard? Sometimes the written requests get processed faster than phone calls because they go directly to a claims examiner. Also, be sure to check your dashboard's "Correspondence" section daily - they might have requested additional information that you missed, which would delay the process further.

I didn't know about the Inquiry Form - I'll definitely try that right now. And I've been checking my correspondence every day but there's nothing new there. Thanks for the suggestions!

UPDATE: I tried the Claimyr service that someone mentioned above and actually got through to a UC rep today! They told me my wage protest is still "in review" but should be completed within the next 10 business days. They also found that there was a flag on my account requesting additional proof of income that was never sent to me! I'm uploading my bank statements showing the commission deposits now. Thanks everyone for your help with this!

Great news! This is exactly why it's so important to follow up persistently. The system often fails to notify people when additional documentation is needed. Glad you're making progress!

Make sure those bank statements clearly show the deposits were from your employer and identify them as commission. Adding a note explaining each deposit can help the examiner process your claim faster. Good luck!

Anybody else think its crazy that we have to jump thru all these hoops just to get the money we DESERVE??? like we paid into this system with our taxes and then they make it impossible to actually use it when we need it!! the whole things rigged to save the government money by making it too hard for us to collect what were owed!!

It is frustrating for sure. I understand they need to verify everything but the communication could definitely be better. I just wish they'd sent me that request for additional documents weeks ago instead of letting my claim sit there.

For anyone else dealing with wage protests in PA, here's a pro tip: While waiting for the protest to be resolved, make sure you're still filing your weekly claims! Even though your benefit amount is wrong, continue claiming each week. When the wage protest is resolved, they'll adjust all previous payments automatically, but only for weeks you properly claimed. Missing weekly claims can cause major headaches later.

Yes! I've been making sure to file every week even though the amount is wrong. Good reminder for anyone else in this situation.

I'm dealing with a similar wage protest situation right now - my employer underreported my overtime hours by about $2,800. It's been 5 weeks and I'm getting really anxious about the delay. Reading through all these responses is both helpful and terrifying! The fact that some people waited 3+ months is just insane. I'm definitely going to try that Inquiry Form suggestion and maybe look into the Claimyr service if I can't get through by phone soon. Thanks everyone for sharing your experiences - at least now I know I'm not alone in this mess!

Welcome to the wage protest club - nobody wants to be here! 😅 I feel your pain about the anxiety. One thing that helped me was keeping a detailed log of all my calls, uploaded documents, and any communication with UC. It made me feel more in control and helped when I finally got through to an agent. Also, if you do try Claimyr, do it early in the morning - seems like that's when they have the most success getting people connected. Hang in there, and definitely keep filing your weekly claims even with the wrong amount!

I'm going through the exact same thing right now! My previous employer didn't report about $4,500 in bonuses I received last quarter, so my weekly benefit is way too low. I filed my wage protest 7 weeks ago and still nothing. It's so frustrating because I know I'm entitled to more money but the system is just broken. I've been trying to call every single day but like everyone else said, I just get disconnected after being on hold forever. I'm definitely going to try that Inquiry Form through the dashboard that someone mentioned, and maybe look into the Claimyr service too. This whole process is making an already stressful situation so much worse. At least reading everyone's experiences here makes me feel less alone in dealing with this nightmare!
