Can I get PA UC approved if employer never returned fact-finding sheet?
So frustrated right now. Back in January, I got laid off from my warehouse position after the company downsized. Filed for unemployment right away and thought everything was fine until my claim status changed to "pending" with an "open issue." Called PA UC and eventually got through to someone who said they sent a fact-finding questionnaire to my employer over a month ago but haven't received anything back. The UC rep wouldn't tell me much else. It's been 5 weeks now and I still see that open issue on my portal. My rent is due next week and I've gotten exactly $0 in benefits. Does anyone know if I can still get approved if my former employer never bothers to respond to UC's fact-finding sheet? Do I just keep waiting or is there something I should be doing?

yes u can get approved even if they dont respond. employer has like 10 days to respond or UC just makes decision without their input. happened to me in 2025 and i still got approved, but was delayed like 6 weeks total. keep filing ur weekly claims even tho ur not gettin paid yet!!!

The law actually states that the employer has 15 days to respond to the fact-finding questionnaire. If they don't respond within that timeframe, PA UC is supposed to make a determination based on the information they have available (mainly what you provided in your initial application and any follow-up interviews). However, with the current backlog at UC, these determinations are taking longer than they should. The good news is that once your claim is approved, you will receive all back payments for the weeks you properly certified. Make sure you're completing your weekly certifications and work search activities (applying to at least 2 jobs and completing 1 work search activity each week) while you wait so you'll be eligible for those back payments.

From my experience working with PA UC claims, you should definitely call and specifically request that they make a determination on your claim since the employer response period has elapsed. Reference the 15-day employer response requirement when you call. Sometimes claims get stuck in the system and need a manual push. They likely won't tell you over the phone what the determination will be, but they can at least confirm they'll move your claim forward to the next step instead of leaving it in limbo waiting for a response that's not coming. Be prepared with your claim number, last 4 of SSN, and employment details when you call.

I had the EXACT same situation last year!! My former employer (retail store) never responded and my claim was stuck for 7 WEEKS!! I was so angry because I had bills piling up. I called UC every single day for two weeks straight and could never get through - busy signals or disconnects every time. It was INFURIATING!!! •I'm suspicious of any service charging to connect to a government agency. Is this even legal? The PA UC phone system is terrible but if you call right when they open you can usually get through.

It's totally legal - they don't answer for you or anything, just help you skip the busy signals. I tried calling at opening for 2 weeks with no luck. Worth it to me after almost 2 months with no income, but everyone's situation is different.

not my experience! my employer never sent anything back and i got DENIED!!!! had to file appeal and wait ANOTHER 6 weeks for hearing. system is completely broken and they ALWAYS side with employers. good luck getting any help from anyone there.

•While some claims are initially denied, it's not accurate that they always side with employers. The PA UC decision-making process is based on state law and the specific circumstances of each case. If an employer doesn't respond, determinations are supposed to be made based on claimant information, but the specific details of your separation (quit vs. layoff, etc.) still matter.

I'm going to try calling again tomorrow morning. If they sent the fact-finding sheet over a month ago, that's well past the 15 days the employer had to respond. Really hope I don't get denied like @profile5 mentioned. This was a clear layoff situation - they eliminated my entire department.

•Since yours was a layoff situation, you should be in good shape once they actually process the determination. Make sure you specifically mention that the employer response period has elapsed and request they move forward with a determination based on the information they have. Good luck!

just went thru this!! call call call and ask for a supervisor if the reg person wont help. took me 8 weeks total to get paid but got everything backpaid. keep doing weekly claims!!!!
