One important thing to prepare for your misconduct appeal hearing: PA uses a two-part test for attendance-related misconduct: 1. Did you violate a known and reasonable employer policy? 2. Was the violation deliberate/willful or was it due to good cause? The burden of proof is initially on the employer to show there was a policy and you violated it. Then the burden shifts to you to show you had good cause. Childcare emergencies generally count as good cause, especially if you made efforts to find alternatives and communicated properly. Make sure you're prepared to clearly explain the circumstances of each absence, what you did to try to resolve it, and how you communicated with your employer. Bring any evidence showing you tried to find alternative childcare. This can make a big difference in how the referee views your case.
This is SO helpful. I've been stressing about how to present my case. I did search for backup childcare and I have screenshots of conversations with other potential sitters who couldn't help on those days. I'll definitely organize all of this for the hearing. Do they record these hearings? I'm nervous about speaking clearly when I'm anxious.
after my appeal got approved i got backpay for all the weeks i was waiting which was like $6200!!! make sure u keep filing every week during the wait even tho they'll all say 'appeal pending' or whatever. its a pain but worth it if u win
That's not always true though. My brother won his appeal but only got backpay for some weeks because he missed filing two weeks during the appeal period. They're super strict about the weekly claims even during appeals.
One more thing worth mentioning - while you're waiting for your card to arrive, you can log into your PA UC dashboard and verify that payments are actually being processed. Look for the "Payment History" section. If you see payments listed as "sent" or "processed," that's a good sign that the card is on its way with funds already loaded. If nothing shows there, you might have another issue that needs addressing.
I waited 9 days for my card then realized it got delivered to my neighbor's mailbox by mistake! Maybe check with your neighbors if it's been longer than 10 business days. The envelope is pretty plain looking and doesn't obviously say it's your benefits card.
This is a good reminder for everyone that when your claim status changes unexpectedly, reaching an actual representative should be your top priority. System glitches happen fairly regularly with PA UC, especially with multiple separation situations. For anyone else in a similar situation, keep these points in mind: 1. Always document any changes to your employment status immediately 2. Continue filing weekly claims without interruption 3. If your status says "under review" for more than 2 weeks, be proactive about reaching a representative 4. Keep copies of all communications with employers regarding scheduling, hiring agreements, or separation 5. I wouldn't recommend contacting the restaurant manager directly at this point. Since you already have text messages documenting your availability conflicts, focus on those. Additional contact might just complicate things or even antagonize the employer. Let the UC process work now that you've completed the information request form. The texts you have should be sufficient evidence for your case.
That makes sense. I'll hold off on contacting them and just focus on the UC process now that it's moving forward. Really appreciate everyone's help and advice!
ur supposed to keep filing weekly claims even while waiting for appeal decision!!! my cousin didnt know this and lost 6 weeks of backpay when she won her appeal!!! they only pay u for weeks u actually filed claims for
One more important tip: When you go to your appeal hearing, bring a timeline of events written out clearly. Include: - Your clean work history (performance reviews if you have them) - Exact time of the alleged incident (8:15am) - Normal work activities you completed after the incident (shows they had no immediate safety concerns) - Time you were called to HR (5pm) - When you recommended the witness (in your email statement) - Date of termination Referees handle multiple cases every day and appreciate clear, organized information. Also, Pennsylvania is a two-party consent state for recordings, so don't secretly record any conversations with your employer or the witness as that could hurt your case.

UPDATE: It finally worked! I followed the advice to try early morning (5:30am) using Safari instead of Chrome, and turned off my ad blocker. The verification went through in seconds!
