What if I get a job while waiting for NYS Department of Labor unemployment approval?
I applied for unemployment benefits about 6 weeks ago and my claim is still in adjudication with NYS Department of Labor. I've been doing my weekly claims and job searches like I'm supposed to. Now I might have a job offer coming through next week. What happens if I accept the job while my claim is still pending? Do I need to tell NYS Department of Labor right away? Will this mess up my claim or do I still get paid for the weeks I was unemployed while waiting? I'm worried about doing something wrong and having to pay money back later.

You absolutely need to report the job immediately when you start working. Continue filing your weekly claims until you actually start the job, marking that you're still unemployed and available for work. Once you start working, you'll report your work hours and earnings on your weekly claim. NYS Department of Labor will still process and pay you for the weeks you were legitimately unemployed while waiting for adjudication.

same thing happened to me last year! i got hired while my claim was still pending. just make sure you report the work on your weekly claim when you start. they paid me for all the weeks i was unemployed before starting the job

The key is accurate reporting on your weekly claims. When you start working, you'll answer 'yes' to the work question and report your hours and gross earnings. NYS Department of Labor calculates partial benefits if you're working part-time, or stops benefits if you're full-time. Your pending claim will still get processed for the period you were unemployed. Make sure you keep documenting your job search efforts until you actually start working! NYS Department of Labor still requires proof of job searches for the weeks you're claiming benefits, even if you know you have a job starting soon.
