What happens if I miss my NYS Department of Labor phone interview - will my claim be denied?

I have a phone interview scheduled with NYS Department of Labor next Tuesday at 2pm for my unemployment claim that's been in adjudication for 2 weeks. The problem is I just realized I have a mandatory work training that day that I can't reschedule (I'm working part-time while collecting partial benefits). What exactly happens if I miss this phone interview? Will they automatically deny my claim or do I get another chance? I'm really stressed about this because I need these benefits to cover my rent. Has anyone been in this situation before?

You need to call NYS Department of Labor IMMEDIATELY to reschedule. Don't just miss it - they will likely make an adverse determination against you if you're a no-show. The number should be on your interview notice. If you can't get through, keep trying or look for an online rescheduling option in your my.ny.gov account.

Thank you! I've been trying to call but keep getting busy signals. Do you know if there's a specific time that's better to call?

I missed mine last month because I was in the hospital and they did deny my claim initially. BUT I was able to appeal it and explain the circumstances. You have to file the appeal within 30 days though. Still better to reschedule if you can.

Oh no, how long did the appeal process take? I really can't afford to have my benefits stopped even temporarily.

It took about 6 weeks total but I did get all my back pay once it was approved. The key is having documentation for why you missed it.

Have you tried using Claimyr? I was having the same problem getting through to NYS Department of Labor to reschedule my interview. Claimyr basically calls for you and gets you connected to an actual agent. Check out claimyr.com - they even have a video demo at https://youtu.be/qyftW-mnTNI that shows exactly how it works. Saved me hours of trying to get through on my own.

Is this legit? Never heard of using a service like this for unemployment stuff.

Yeah it's totally legitimate. They don't ask for any personal info about your claim or anything like that. They just help you get through the phone queue to reach an actual NYS Department of Labor representative.

Same thing happened to my brother - he missed his interview because he was working (ironic right??). They denied his claim but he was able to get it reversed by showing his work schedule and explaining he couldn't take time off. Document everything about why you can't make it!

Good point about documenting everything. I'll make sure to get something in writing from my employer about the mandatory training.

This whole system is ridiculous. They schedule these interviews during normal business hours when most people are trying to work or looking for work, then penalize you if you can't drop everything. I swear NYS Department of Labor makes it as difficult as possible on purpose.

definitely try to reschedule but if you absolutely cant make it write down exactly what happened and why you missed it. keep records of everything in case you need to appeal later

I went through this exact same situation last year! First priority is definitely calling to reschedule - try calling right when they open at 8am, that's when I had the most luck getting through. If you absolutely cannot reach them in time, make sure you document EVERYTHING about your mandatory work training (get it in writing from your supervisor, take photos of the notice, etc.). When I missed mine due to a work conflict, I immediately sent a fax explaining the situation with documentation attached. They still initially denied my claim, but I appealed with all my documentation and got it overturned within about 4 weeks. The key is showing you made every effort to contact them beforehand and that you had a legitimate work-related conflict. Don't panic - this is fixable!

This is really helpful advice! I'm curious - when you sent the fax, did you send it to a specific department or just the general NYS DOL number? And did you get any confirmation that they received it? I'm worried about documentation getting lost in their system.

I was in a similar situation a few months ago and ended up missing my interview despite trying everything to reschedule. Here's what I learned: if you absolutely can't reach them before Tuesday, call immediately AFTER you miss the interview to explain what happened. I called within an hour of my missed appointment and was able to get it rescheduled for the following week. The rep told me that calling right after shows good faith effort and they're more likely to work with you. Also, if you're collecting partial benefits while working part-time, make sure to emphasize that the training is mandatory for your current employment - they understand work obligations better than personal conflicts. Keep trying those early morning calls though, 8am sharp seems to be the sweet spot!

This is great advice about calling right after the missed interview! I'm wondering though - when you called within an hour, were you able to get through immediately or did you still have to deal with busy signals? I'm trying to figure out if I should keep my phone free for that hour after the scheduled interview time in case I need to call multiple times. Also, did they ask you to provide any documentation about why you missed it when you called right after?

I've been through this exact scenario twice with NYS DOL. First time I panicked and just missed it - big mistake, they denied my claim. Second time I was smarter about it. Here's what worked: I called the main line at 7:58am and kept hitting redial until I got through (took about 20 minutes but worth it). When I explained I had mandatory work training, they were actually pretty understanding since I'm on partial benefits. They rescheduled me for the next day at 10am. The key things that helped: 1) I called BEFORE the interview, not after 2) I had my training documentation ready 3) I explained I was actively working part-time (they seem more flexible when you're working). If you truly can't get through, send an email to the address on your interview notice AND call immediately after the missed appointment. Don't give up - I know people who've gotten rescheduled even after missing their first interview if they can prove work conflict.
