Waiting 2 months for NY unemployment with no payment - need help for baby and bills

I lost my job 2 months ago and still haven't received a single NY unemployment payment. Everything just says 'pending' in my account. I'm completely broke and falling behind on all my bills. I have a 7-month-old baby that I need to provide for, and I'm running out of food and baby supplies. I've called NYSDOL before and actually got through to someone, but they just tell me the same thing every time - 'it's pending, just wait for a letter.' HOW MUCH LONGER do I have to wait??? I'm desperate at this point. Has anyone dealt with this kind of delay and actually got it resolved? I need to feed my baby and I don't know what to do anymore.

Ava Harris

I'm so sorry you're going through this. Unfortunately, the 'pending' status can sometimes take a while, but 2 months is definitely excessive, especially with a baby depending on you. Have you tried contacting your local state representative's office? They can often help speed things up by making inquiries on your behalf. Also, call 211 right away - they can connect you with emergency assistance for food and baby supplies while you wait for unemployment to come through.

There's likely an identity verification or eligibility issue that needs to be resolved. When you call, are you asking specifically what's causing the pending status? The general reps often just read what's on the screen, but you need to speak with a claims specialist who can actually review your case in detail and tell you exactly what's holding things up. After working in the system for years, I can tell you that these long delays are almost always due to specific issues that need addressing - not just random waiting periods. Keep calling until you get someone who can tell you the EXACT reason for the hold.

I keep trying to ask for details but they just say it's "under review" and can't tell me anything specific. Is there a special number to reach claims specialists directly? The regular line just leaves me on hold forever.

I was in your exact situation last month - pending for 7 weeks with a young child at home. What finally worked for me was using Claimyr to get through to an actual claims specialist. I was skeptical at first, but I was desperate like you. The service connected me to a real NYSDOL agent in about 15 minutes when I'd been trying for weeks on my own. The agent found that my identity verification had failed but nobody had notified me. Fixed it right there on the call and my back payments came through 4 days later. Check out their demo video at https://youtu.be/Rdqa1gKtxuE to see how it works. The website is claimyr.com - seriously saved my sanity and helped me get my money.

Thank you so much, I never heard of this before. I'm willing to try anything at this point. Did they actually solve your problem on that first call?

Yes, they solved it on that first call. The NYSDOL agent could see exactly what was wrong (in my case it was a failed ID verification that nobody told me about). Once I got to the right person, they fixed it right away. Just make sure you have all your claim info ready when you call.

LISTEN the unemployment system is DESIGNED to be frustrating!! they WANT you to give up so they dont have to pay you! its been like this for YEARS. i waited THREE MONTHS in 2025 before getting my first payment. the whole system is broken on purpose!!

That's not entirely accurate. While the system is definitely backlogged and inefficient, there's usually specific issues causing delays. Most claims with complete documentation are processed within 2-3 weeks. Extended delays typically indicate missing information or verification problems that need addressing.

Dealing with NYSDOL nearly made me lose my apartment in February this year. The anxiety was unbearable. I started applying for any job I could find - even stuff way below my pay grade - just to get SOME income. Also check with local churches and community centers. Many have emergency assistance programs for families with small children. St. Vincent de Paul helped me with formula and diapers when I was in a similar situation with my 9-month-old. Don't wait for unemployment to come through before seeking emergency help.

Thank you for the advice. I've been looking for any job too, but nothing yet. I'll check out St. Vincent de Paul - there's one near me I think.

There are a few specific steps you need to take to resolve this: 1. Request to speak specifically with a Tier 2 claims specialist when you call. The frontline representatives cannot resolve complex issues. 2. File for emergency case review by submitting Form LE 33.1 (Request for Expedited Determination). You can download this from the NYSDOL website under Forms. 3. Document all your calls - date, time, representative name, and what was said. This creates a record showing your due diligence. 4. Contact your state assembly member AND state senator (not just one). Their constituent services can escalate cases effectively. For immediate needs, apply for emergency SNAP benefits - the application process is expedited for families with children under 12 months and can provide food assistance within 5 days.

Thank you so much for this detailed advice. I've never heard of Form LE 33.1 - will download it today. And I'll try asking for a Tier 2 specialist specifically next time I call.

I just want to follow up - were you able to make any progress with your claim? Did you try any of the suggestions here?

UPDATE: I finally got through using that Claimyr service someone recommended. It actually worked! The agent found that there was an employer dispute about my termination reason that nobody told me about. They expedited my case since I have a baby, and said I should get a determination letter within 5-7 days. Also applied for emergency SNAP and got approved yesterday! Thank you everyone for your help - still waiting for the money but at least now I know what's happening.
