NYS unemployment penalties withdrawn - false work search violations cancelled, $280 overpayment reduced to $0, 16 forfeit days removed, and all benefits to be paid
Got hit with penalties and forfeit days because a career center agent claimed I refused to provide work search records. This was totally false - I had all my records! They tried saying I refused to give info but I had proof of everything. Career center supervisor tried helping but said determination letter was already sent. Had to request a hearing but after sending them all my proof (screenshots of interactions and work search records) they cancelled everything! I just received a notice from the NYS DEPT [PO BOX 15130, ALBANY NY 12212-5130] dated 02/22/2023 that says "The determination dated 02/21/2023 stating you are not eligible for unemployment insurance benefits because: you failed to provide work search records The other determination suspending you indefinetely because you did not report in a timely manner has also been withdrawn is withdrawn." The letter confirms that "The overpayment dated 02/21/23 in the amount of $280 has been revised to $0.0 the 16 forfeit days penalty has been cancelled; there is no longeramonetary penalty of $200; you will be paid whatever money you are owed. There is no longerared for a hearing." This is such a relief! The effective date shown on the letter is 09/13/2022. The letter also states "The disqualification which was imposed effective has been withdrawn You will receive a payment covering all benefits that may be due you." They also noted that "Further investigation is being made. A disqualifying determination may be issued if the results of the investigation warrant" but I'm not worried because I have all my evidence. The letter was signed "For the Commissioner of Labor, By: Unemployment Insurance Division" and has a notice at the bottom saying "Auxiliary Aides and Services are Available Upon Request and Free of Charge to Individuals with Disabilities." No more penalties or forfeit days, and they're paying what they owe me. If you're in the right, don't give up!
