ESD approved my job transfer in music industry - adjudicator ruled it's a bona fide reason to quit!
Just got the BEST news from ESD this morning! After 6 weeks in adjudication, they actually ruled in my favor!! The adjudicator determined I had a "bona fide occupational reason" to leave my part-time retail job for a position at a recording studio, since it's directly related to my career field (music). I was so stressed they'd deny me for voluntarily quitting, even though the new job fell through after just 2 weeks (the studio lost their main client). My benefit year is almost over anyway (just 3 more weekly claims) and honestly I cannot WAIT to be done with all this unemployment stuff. The constant stress of wondering if I've filled something out wrong or if they're going to randomly decide I owe them money has been exhausting. For anyone facing a similar situation where you left one job for another in your actual career field - don't give up hope! Document EVERYTHING about why the job change was necessary for your career progression. It actually worked for me!

congrats!! thats actually kinda surprising, ESD is usually super strict about voluntary quits. did they call u for a fact finding interview or just decide based on your written statement?

•They called me twice! First interview was super basic questions, then a different adjudicator called back a week later with more specific questions about my music background and why the studio job was better aligned with my career goals. I had my resume and a letter from the studio manager explaining the position ready to go, which I think really helped my case.

This is a good reminder about the "bona fide occupational reason" qualification for voluntary quits! According to ESD regulations, leaving a job to accept other work can be considered non-disqualifying if the new position offers definite advancement in terms of skills, ability, or earnings in your established career field. For others reading this who might be in similar situations: make sure you can clearly document how the new position relates to your established career path. ESD typically wants to see evidence that: 1. The new job was in your established field 2. It represented genuine advancement (skills, wages, hours, etc.) 3. You had reasonable assurance the new job would continue Just be aware that if you quit for a completely different field, it's much harder to qualify under this provision.

•Is this still true if you quit to start your own business? My cousin left her accounting job to start a bookkeeping service and ESD denied her claim when her business didn't generate enough income. She thought it would count since it was the same field!

I'm honestly surprised they approved this! In my experience working with unemployment cases, leaving for another job that doesn't work out is one of the trickier scenarios. The key factor working in your favor was definitely the occupational connection between the jobs. For anyone dealing with adjudication for voluntary quits, I strongly recommend using Claimyr (claimyr.com) to get through to an ESD agent quickly. They can check on your adjudication status and sometimes even expedite it. I've seen their video demo (https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3) and it's pretty straightforward - helps you bypass those frustrating busy signals and dropped calls when you really need to speak to someone.

THIS IS EXACTLY WHY THE SYSTEM IS BROKEN!!! Some people get approved for VOLUNTARILY quitting while others who get laid off have to wait MONTHS with no income! My neighbor was laid off from Boeing and has been waiting 11 WEEKS for a decision while you quit your job and get benefits???? The whole system is completely arbitrary and depends on which adjudicator you get. I was denied because I couldn't work overtime at my warehouse job due to childcare issues - they called it "misconduct" even though I NEVER agreed to mandatory OT when hired!!!!

•I understand your frustration, but I didn't just quit on a whim. I left for another position that was supposed to be permanent but the studio lost funding. And I wasn't approved immediately - I was in adjudication for almost 7 weeks with no income while they investigated. The system definitely has problems, but your neighbor's situation and mine are different circumstances that fall under different eligibility rules.

•Yes! Once they approved me, all my pending weeks switched to paid status the next day. I had been submitting my weekly claims the entire time I was in adjudication (which is super important - don't stop filing weekly!). The lump sum payment hit my account about 2 business days later.

I'm currently in adjudication for a similar reason but I left my job in healthcare to take a position with higher pay at another facility, but then was let go during the probation period. My claim has been pending for 5 weeks now and I'm SO stressed! Did you do anything specific to help your case? Did you submit additional documentation or just answer their questions during the phone interviews? I'm worried they're going to deny me and I'll have to appeal...

•Your healthcare situation actually has an even stronger case than OP's situation. Healthcare-to-healthcare transitions with increased pay clearly meet the bona fide occupational reason standard. Make sure you have documentation ready showing: - The pay increase at the new position (offer letter) - Confirmation it was in the same field (job descriptions of both positions) - Any communication about why you were let go during probation When they call for fact-finding, emphasize that you left for career advancement in your established field, not just higher pay. The distinction matters for ESD's determination.

my cousin had almost the exact same situation last year!!! left his job at a retail music store to work at a recording studio and then got laid off. ESD denied him tho because he'd only been in the music industry for like 6 months before the switch. how long have u been working in music?

•I've been working in music-related jobs for about 8 years (mostly part-time while also doing other work to pay the bills). I have a music production degree too, which probably helped prove it's my established career field. Your cousin's situation is exactly what I was afraid of - I've heard they're really strict about proving it's your established field and not just a casual interest.
