NYS Department of Labor unemployment tax break refund - when should I expect it?
I got unemployment benefits for about 8 months last year and paid taxes on all of it when I filed my return in March. Now I keep hearing about some kind of unemployment tax break refund but I haven't seen anything yet. Does anyone know when NYS Department of Labor or the state is supposed to send these refunds out? I could really use that money right now since I'm still looking for steady work.

The unemployment tax exclusion was a federal thing, not NYS Department of Labor. If you're talking about the $10,200 exclusion from 2021, most people got those refunds automatically from the IRS back in 2021-2022. If you haven't gotten it yet, you might need to check your IRS account or call them directly.

•Wait so this isn't something new? I thought I heard people talking about getting refunds recently.

i think youre mixing up different things. the big unemployment tax break was like 3 years ago. if you didnt get it then you probably missed the window

You need to be more specific about what year you're referring to. The American Rescue Plan Act excluded the first $10,200 of unemployment compensation from federal taxes for 2020 tax year only. This applied to regular UI benefits paid by NYS Department of Labor. If you received benefits in 2020 and filed before the law changed, the IRS should have automatically adjusted your return. For any other years, unemployment is fully taxable.

•I got benefits in 2024, not 2020. So there's no tax break for recent unemployment?

•Correct, there's no tax exclusion for 2024 unemployment benefits. All UI payments from NYS Department of Labor are fully taxable income for recent years.

This is so confusing! I've been trying to get through to someone at NYS Department of Labor for weeks about my tax documents and can't reach anyone. The phone lines are always busy and when I do get through I get disconnected. Has anyone found a way to actually talk to a real person there?

•I had the same problem until I found Claimyr. It's a service that helps you get through to NYS Department of Labor agents by phone. You can check it out at claimyr.com - they even have a video demo at https://youtu.be/qyftW-mnTNI showing how it works. I was able to get my 1099-G sorted out in like 20 minutes after being on hold for weeks trying to call myself.

Just to clarify for everyone - unemployment benefits from NYS Department of Labor are taxable income. You should have received a 1099-G form showing how much you received. The only exception was the 2020 tax year federal exclusion that's already been processed. Make sure you're not missing any important tax deadlines!
