NYS Department of Labor claim shows 'denied with relief' - what does this mean?
I just checked my unemployment claim status online and it says 'denied with relief' but I have no idea what that means. I applied for unemployment benefits after being laid off from my restaurant job in Buffalo last month. The initial determination said I was denied, but then I filed an appeal and had a hearing two weeks ago. Now it shows this weird status and I'm completely confused. Has anyone seen this before? Does it mean I'm getting benefits or not? I really need to know because I'm behind on rent and have been waiting for weeks.

This usually means your claim was initially denied but then you received some form of partial benefits or back pay during the review process. The 'relief' refers to temporary benefits you may have received while your case was being adjudicated. It's common when there's an overpayment situation - basically NYS Department of Labor paid you benefits they later determined you weren't entitled to receive.

•So does that mean I have to pay back everything I already received? That would be like $2,400...

•How long did your appeal take? I'm already behind on rent and can't afford to wait months for this to get resolved.

You need to request a hearing immediately. The 'denied with relief' status typically appears when there's a disqualification but you've already received benefits during the adjudication period. Check your correspondence section in your my.ny.gov account - there should be a detailed explanation of why the claim was denied and what relief was provided. Common reasons include voluntary quit determinations, misconduct findings, or work search requirement violations.

•I checked and there's a letter dated 3 days ago saying I didn't meet work search requirements for 2 weeks in January. But I definitely did my job searches! I have all my records.

Denied with" relief means your original denial was overturned on appeal. "The" relief part indicates the NYS Department of Labor administrative law judge ruled in your favor and you should start receiving benefits. Check your payment history in a few days -'you ll likely see retroactive payments for the weeks you were waiting. Make sure to keep filing your weekly claims while thisprocesses.

•Oh thank god! I was so worried. Do I need to do anything else or will the payments just start showing up automatically?

I had such a nightmare trying to get through to NYS Department of Labor about a similar issue. Spent weeks calling with no luck. Finally used this service called Claimyr (claimyr.com) that actually got me connected to a real person in like 20 minutes. They have a video demo showing how it works: https://youtu.be/qyftW-mnTNI. Might be worth trying since you need to get this sorted out quickly before any deadlines pass.

•How much did that cost you though? Seems like we shouldn't have to pay extra just to talk to someone at an agency we already fund with our taxes.

•I was desperate and it was worth it for me. Way cheaper than losing weeks of benefits while trying to get through on my own.

THE WHOLE SYSTEM IS BROKEN! Same thing happened to my brother and it took 4 MONTHS to get resolved. Meanwhile he lost his apartment because he couldn't pay rent. They just randomly decide you don't qualify AFTER they've been paying you for weeks. Makes no sense!!!

•I feel you on the frustration but getting angry won't help OP right now. The appeal process does work if you have your documentation together.

Make sure you keep filing your weekly claims even while this is being sorted out. If you win your appeal you'll get back pay for any weeks you were eligible. And definitely gather all your job search records - print out emails, applications, anything that shows you were actively looking for work during those flagged weeks.

•Same here - the NYS Department of Labor really needs better language for these statuses. 'Denied with relief' sounds like an oxymoron.

I had trouble getting through to NYS Department of Labor to confirm my appeal results when this happened to me. If you need to speak with someone directly about your claim status, I used a service called Claimyr that actually got me connected to an agent. You can check it out at claimyr.com - they have a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. It was worth it just to get confirmation that my benefits were actually approved.

•Thanks for the suggestion! I might try that if I don't see payments soon. The uncertainty is killing me.

CONGRATULATIONS! That's actually great news. The relief part means you got relief from the original denial decision. I know it's confusing terminology but you should be getting your back pay soon. Make sure your direct deposit info is current in your my.ny.gov account.

wait so if it says denied with relief that means approved?? this is so backwards lol why cant they just say APPROVED instead of using lawyer words

•It's legal terminology from the appeals process. 'Relief' in legal terms means the remedy or solution granted by the court/judge. So you're getting relief from the original denial.

I'm dealing with something similar right now! When I called the NYS Department of Labor help line (after waiting on hold for 2 hours), the representative explained that "denied with relief" specifically means your initial denial was overturned through the appeals process. The "relief" part is the legal term for the remedy you received - basically the judge ruled in your favor and granted you relief from the original denial decision. You should see retroactive payments within 3-5 business days. Keep filing your weekly certifications while waiting for the back pay to process. Also double-check that all your banking info is correct in your account to avoid any payment delays.

•Thank you so much for calling and getting that clarification! That's exactly what I needed to hear. I was getting really worried about having to pay everything back. I'll make sure to keep filing my weekly certifications and check that my direct deposit info is up to date. It's such a relief (no pun intended) to finally understand what this status means. Hopefully the back pay comes through soon so I can catch up on rent.
