NYDOL denied my claim bc I only worked 4 months - any way to appeal?

I'm so frustrated with the unemployment system. I worked for 4 months and made good money in the last quarter ($8000), but my claim was denied because I didn't make enough in the other quarters. It's ridiculous that they expect you to work a full year to qualify. I was actively looking for work and available, but faced ageism in my job search. Has anyone else dealt with this? Any advice on how to appeal or if there are special programs for older workers?

Ugh, that sucks. The system is so broken. Have you tried reaching out to your local rep? Sometimes they can help push things through.

I haven't thought of that. Good idea! Do you know how I can find my local rep's contact info?

Just google '[your county] state representative' and it should pop up. Good luck!

I feel ya, OP. The whole system is designed to make it as hard as possible to get benefits. It's like they think we're all trying to scam them or something 🙄

Have you looked into the alternate base period? Some states allow you to use more recent quarters if you don't qualify under the standard base period. Might be worth asking about.

I haven't heard of that. I'll definitely ask about it when I call. Thanks for the tip!

This is good advice. I used the alternate base period when I was laid off and it made all the difference. Def worth checking out

Hey, I found a way to actually get someone on the phone! I used this site's (claimyr.com) calling tool that dials the phone menu, stays on hold, waits for a live agent to pick up, then sends the call to my phone. It does cost $20, but it works. Here's a video about it: https://youtu.be/Rdqa1gKtxuE

Sounds too good to be true. Is this legit?

Yeah, it's totally legit. I was skeptical at first too, but it saved me hours of hold time. Worth every penny imo

How long did it take to get through?

It took about 2 hours for me, but I didn't have to sit there listening to hold music the whole time. The service called me when an agent picked up.

Here's what you need to do: 1. File an appeal ASAP. You usually have a limited time to do this, so don't wait. 2. Gather all your employment records, including pay stubs and any correspondence about your job search efforts. 3. Write a detailed letter explaining your situation, emphasizing that you were actively seeking work and available, but faced age discrimination. 4. Ask specifically about programs for older workers or those facing discrimination. Many states have special provisions for this. 5. If you can, get any documentation of the ageism you faced. Even if it's just notes you took about interviews or applications where you felt discriminated against. 6. Consider reaching out to your state's department of labor or an employment lawyer for advice. 7. Don't give up! The system is frustrating, but persistence often pays off. Good luck, OP. Keep us posted on how it goes!

have you tried calling? sometimes you can get more info or even overturn a denial if you talk to an actual person

I've been trying but it's impossible to get through. Always busy or on hold forever 😫

Pro tip: call right when they open. Like, start dialing 1 minute before. Sometimes you can get through that way.

Not sure if this helps, but I've heard some success stories of people reaching out to their state senators or representatives for help with unemployment issues. Might be worth a shot?

That's a great idea, thanks! I'll look into contacting my rep.
