NY unemployment benefit rate dropped by $200 after review - anyone else?
I'm so frustrated right now! Was receiving my regular NY unemployment benefits at $504/week since February, then yesterday got a monetary determination letter saying they 'reviewed' my claim and are reducing my weekly benefit rate to $302. This is a huge drop! The letter mentions something about 'alternate base period calculation' and that they only counted my earnings from Q3-Q4 2024. But I've been working consistently for 2 years at the same job before being laid off in January 2025. I don't understand why they'd suddenly change my rate 3 months into my claim? Has anyone dealt with this kind of mid-claim reduction? What can I do to appeal this? I'm really counting on that full amount to cover my rent.

This happened to me last month. They sometimes recalculate benefits if there's a discrepancy between your reported wages and what your employer reported. You need to file a Request for Reconsideration (Form TC-403) within 30 days of receiving that determination letter. Include all your wage documentation - paystubs, W-2s, anything showing your actual earnings during the base period.

•Thank you! Do you know where I can find this form? Is it on the NY.gov website or do I need to call to request it?

After weeks of trying to reach someone at NYSDOL about a similar issue, I finally used Claimyr (claimyr.com) and got through to an agent in about 20 minutes. They have this service where they basically hold your place in line and call you when an agent is available. Saved me days of frustration. They have a video explaining how it works: https://youtu.be/Rdqa1gKtxuE The agent explained that my recalculation happened because one employer reported lower wages than what I claimed. I had to submit additional documentation to prove my actual earnings. It took about 2 weeks for them to review and restore my original benefit amount.

•Is this legit? Seems sketchy to use a third party service to reach unemployment. Don't they need your personal info?

•I was skeptical too, but it worked for me. They don't access your account or anything - they just connect the call. You still talk directly with the DOL agent for all the personal stuff. After weeks of trying on my own, I was desperate enough to try anything!

Benefit rate recalculations typically happen for one of three reasons: 1. Earnings discrepancy between what you reported and employer records 2. Missing wages from an employer that weren't initially counted 3. Application of different base period calculation methods For your specific situation, the mention of 'alternate base period' suggests they may have initially used your standard base period (first 4 of last 5 completed quarters), but then switched to your alternate base period (last 4 completed quarters) for some reason. To appeal, you need to submit Form TC-403 (Request for Reconsideration) along with documentation of ALL your wages during both potential base periods. Make sure to include a clear written explanation of why you believe the initial calculation was correct. Also important: Continue claiming weekly benefits at the reduced rate while your appeal is pending. If your appeal is successful, you'll receive retroactive payment for the difference.

•This is really helpful info, thanks! Do you know how long the appeal process usually takes? I'm worried about making ends meet at this lower rate while I wait.

•The official timeframe is 4-6 weeks for reconsideration requests, but in practice, it can take anywhere from 3-10 weeks depending on their current backlog. If you're experiencing financial hardship because of this, make sure to note that clearly in your reconsideration request - sometimes they'll prioritize cases with demonstrated hardship.

I had a similar issue where my benefits dropped suddenly. It turned out there was a data entry error on their end, and one employer's wages weren't showing up properly in their system. I spent forever trying to get through on the phone until I finally got some help. Something important to check: Look at the wage data listed on your monetary determination letter. Does it show ALL your employers from the relevant quarters? Are the wage amounts correct? If anything is missing or incorrect, that's what you need to focus on in your appeal. Also, when I was dealing with this, I found that sending a message through my online account messaging system wasn't effective. You really need to speak with someone directly.

•Thank you! I checked the letter and noticed it's only showing one employer, but I actually worked at two places during Q3 2024 (one was just for a month before I moved to my main job). Maybe that's the issue! How long did it take to resolve once you got through to someone?

•That's almost certainly the issue then! Missing employer wages would absolutely cause a recalculation. Once I finally spoke with someone who understood the problem, it took about 3 weeks for them to investigate and correct my benefit amount. They did pay me the difference for all the weeks I received the lower amount, so at least that part worked out in the end.

just wondering, did you receive any kind of overpayment notice with this? or are they just reducing going forward?

•No overpayment notice, thankfully! Just reducing the amount going forward. Still a major problem for my budget though.

•The NY Career Centers can help with some unemployment issues, but for benefit rate recalculations specifically, they'll usually just help you submit the same forms you can access online. They don't have the authority to make determinations on the spot. However, they can sometimes help ensure your documentation is properly submitted, which might speed things up slightly.

I'm going through almost the same thing right now! My letter said they excluded my highest earning quarter because of some technicality about when I filed my initial claim. I'm really nervous about the appeal process. Has anyone had success with getting their full benefit amount restored after appealing? Like what are the actual chances they'll fix this?

•I had success with my appeal last year. The key is documentation - they reversed my reduction because I could prove all my wages with paystubs and tax records. About 70% of monetary determination appeals are successful if you have proper documentation. Just make sure you file within the 30-day deadline.

Update: I tried that Claimyr service someone mentioned and actually got through to NYSDOL! The agent confirmed that they were missing wages from my second employer during Q3 2024. I need to submit my paystubs and W-2 from that job along with the Request for Reconsideration form. She said the processing time is currently about 4 weeks but could be faster. Thanks everyone for your help with this!

•Great news! Make sure you keep a copy of everything you submit and maybe even send it with some kind of delivery confirmation. And definitely keep claiming your weekly benefits while you wait for the reconsideration.

•Will do! And I'll update here once I get a decision in case it helps anyone else in a similar situation.
