NY unemployment denied me for base wages that look wrong - how to challenge their calculations?
Just got denied for unemployment benefits in New York because they said I didn't earn enough in my base period. This makes absolutely no sense to me. I worked steadily from August 2022 through November 2023 at the same company making around $780 per week. When I looked at the quarterly wage amounts they listed on my denial letter, the numbers seem way off from what I actually earned. For example, they show I only made $1,950 for July-September 2023 when I should have earned closer to $9,300 during that period. Who actually provides these wage numbers to unemployment? Is it my employer? The tax department? I've checked my pay stubs and the math doesn't add up at all. Has anyone successfully challenged these calculations and gotten their denial overturned? I really need these benefits after being laid off in a company downsizing.

Your employer reports those wages quarterly to the state. They might have messed up the reporting. Call DOL immediately and explain the situation! Also request your wage and employment history report from them - they can email it to you. You'll want to have all your paystubs ready to prove what you actually earned.

You'll need to request a reconsideration/redetermination. Tell them specifically that your employer reported incorrect wages. Have your W2 and paystubs ready.

they just call DOL for you and connect you when someone answers. you talk directly to DOL yourself, they just handle the waiting part

OP don't forget when you call, never select the option to file a new claim - that sends you to a different department. Always choose 'existing claim' options even though yours was denied.

what makes you so sure the wages are wrong tho? unemployment only counts certain types of income and there's also a lag in reporting. not all the money you think you made counts toward base period.

I'm positive because I worked the same job, same hours, same pay for all those quarters. There's no reason one quarter would show $9k and another would show $1.9k.

if your numbers are THAT far off, def sounds like employer error. ny unemployment uses the wages your employer reports on their quarterly tax forms. my company's hr screwed up mine too. took forever to fix but was worth fighting.

Check your W2 against what unemployment is showing. If there's a discrepancy, you need to talk to both your employer AND unemployment. Sometimes employers deliberately underreport wages to reduce their unemployment insurance costs (which is illegal btw).

I filed mid-December 2023 after being laid off in November. Shouldn't be a lag issue since my last two quarters show correctly, it's just random earlier quarters that are wrong.
