NY unemployment stuck on 'we are reviewing' for weeks - green card holder work authorization issues
Seriously frustrated with NY unemployment right now! Since 03/16/2025 I've had the same message on my portal saying 'we are reviewing your claim' and the countdown hasn't moved at all - still stuck at zero days. I've called multiple times and finally got through once. First they said it was an issue with my employer, which eventually got resolved. Now they're saying there's a problem with my work authorization permit. I'm a Green Card holder, and apparently they had to contact Homeland Security, who supposedly approved my documents. But now I'm told I have to wait for the 'review of the review' and they mentioned backlogs in that department... I'm losing my patience waiting for payments that never come. Has this happened to anyone else with work authorization issues? Any advice on speeding things up?

This is unfortunately pretty common with green card holders and other work authorization situations. The NYSDOL has to verify your work authorization with DHS/USCIS before they can release benefits. In my experience working with clients, this verification process is taking 3-4 weeks right now due to backlogs. Make sure you uploaded clear copies of both sides of your green card to your NY.gov account. Sometimes the verification fails because the images aren't clear enough.

•Thanks for the info. It's already been 3 weeks so hopefully it'll resolve soon. I did upload both sides of my green card but maybe I should try uploading them again with better quality? The frustrating thing is they keep telling me different things every time I call.

•6 WEEKS?? I can't wait that long! Did you do anything that finally got it resolved or did it just randomly update one day?

I had a similar issue with my work authorization verification last year. What finally worked for me was getting through to a tier 2 specialist who could actually see the status of the homeland security verification. Regular agents just give you generic responses about "waiting for processing." After weeks of not being able to reach anyone helpful, I found this service called Claimyr (claimyr.com) that got me connected to a NY unemployment agent in about 20 minutes instead of spending days redialing. They have a video showing how it works: https://youtu.be/Rdqa1gKtxuE Once I got through to a specialist, they saw that my verification was actually stuck in their system and needed to be manually pushed forward. Got my payments within 3 days after that call.

•Thank you! I'll check out that service because I'm going crazy trying to get through to someone who can actually help. Did you have to provide any specific information to the tier 2 specialist to get them to push it through?

•Just have all your documents ready when you call - your green card, claim ID, and any correspondence numbers from previous calls. Ask specifically for a tier 2 specialist who handles work authorization verifications. Be polite but firm that you need someone who can actually see the verification status in their system.

Work authorization verification is a separate process from regular unemployment verification. Many agents don't understand the nuances of this process, which is why you're getting different answers. Here's what's actually happening: 1. NYSDOL sends your information to SAVE (Systematic Alien Verification for Entitlements), which is a DHS program 2. SAVE has three verification steps or "tiers" - if your information doesn't clear the first automatic check, it goes to manual review which takes longer 3. Once SAVE confirms your work authorization, NYSDOL still needs to review your case before releasing payments This process should typically take 2-3 weeks, but with current backlogs, it's often 4-6 weeks. If it's been over 4 weeks, you should request to speak with a supervisor who specializes in work authorization issues. They can sometimes expedite cases that have been stuck too long. Also, check if your name on your green card EXACTLY matches your name in the NY unemployment system. Even small differences can cause delays.

•This explanation makes so much more sense than anything the agents told me! I'll double-check the name matching. My middle name is on my green card but I didn't include it on my unemployment application - could that be causing the issue?

•Yes, that could absolutely be causing the problem. The SAVE system is very particular about exact name matches. Call back and explain this specific discrepancy to a tier 2 specialist. They can either update your unemployment application to match your green card exactly or add a note to your file explaining the discrepancy.

•This is actually good advice. I work for a state representative's office (not in NY) and we help constituents with unemployment issues all the time. Legislative offices often have direct contacts with special units at unemployment who can resolve issues faster. Just look up your state assembly member or state senator and call their district office.

Update: I tried calling again today using that Claimyr service someone mentioned and actually got through to a tier 2 specialist! They confirmed that my verification was completed by Homeland Security last week but was sitting in a queue waiting for final review. The specialist manually moved it to the payment processing stage and said I should see funds in 3-5 business days. Also, they're going to include all the backdated payments! Thanks everyone for your help!

•Great news! This is exactly why it's so important to keep following up. Make sure to check your payment history daily to confirm when the payments process.
