NY unemployment sent identical 1099-G forms for 2022 and 2023 to my daughter - tax nightmare
My daughter got her 1099-G for unemployment benefits and noticed something weird. The form for 2023 shows exactly the same amounts as her 2022 form. Same box 1 amount ($6,840) and same tax withholding ($684). This is impossible because she only collected benefits for about 2 months in 2023 vs almost 7 months in 2022. Called the ny unemployment office several times but can't get through to anyone. Tried emailing through their contact form three weeks ago but no response yet. She's trying to file her taxes and doesn't know what to report! Has anyone else had this duplicate 1099 issue? What did you do to fix it?

OMG YES!! This is happening to me too! My 2023 1099-G is identical to my 2022 one with $8,265 in benefits. But I only collected until March 2023 so it should be WAY less. I've been trying to get through on the phone for DAYS. This is going to mess up my taxes completely.

It's crazy right?? How are we supposed to file correctly? Did you try sending an email? I'm wondering if anyone has actually gotten a response that way.

I sent an email about 10 days ago but nothing back yet. I'm stressing cause I need to file my taxes soon for my FAFSA. Can't believe they messed this up 🤦♀️

You should both take screenshots of your payment history from your online accounts. That way you have proof of the actual amounts if the IRS comes knocking.

I finally fixed this issue last week! After countless attempts to reach ny unemployment by phone, I found this service called Claimyr (claimyr.com) that got me connected to an actual human at the DOL. Talking to an agent got my corrected 1099 issued within 48 hours. Best decision I made after wasting weeks trying to get through on my own. They have a video explaining how it works: https://youtu.be/Rdqa1gKtxuE

Is this for real? I've been calling for almost 3 weeks straight and can't get through.

Totally real. I was skeptical too but I was desperate after trying for so long. It was worth every penny to get this tax mess straightened out before I filed.

Wait so what exactly is this service? Just another way to call them or what?

It basically calls for you and stays on hold, then rings your phone when a real person picks up. Saved me from the endless hold music torture 😂 Check out their site claimyr.com and you'll see how it works.

Nah just sharing what worked for me after weeks of frustration. You can keep calling yourself if you want, but my corrected 1099 is already in my hands 🤷♀️

Y'all need to check your payment histories in your online accounts. Log in to your ny.gov account, go to unemployment services, and look at your payment history. Print that out or take screenshots showing what you ACTUALLY received in 2023. When you file taxes, use those REAL numbers, not the incorrect 1099-G. Then attach a statement explaining the discrepancy. I had to do this in 2021 when they messed up my form.

Good idea about keeping records, but won't the IRS flag it if what I report doesn't match what the state reported on the 1099?

They might, but if you have documentation showing the actual payments, you'll be able to prove your case. Better than reporting incorrect income and paying extra taxes!

This is a systematic error thats happening all over. My tax preparer said he's seen at least 12 clients with the same issue this year. Something went wrong with their system. Call the dedicated 1099-G hotline at 1-888-209-8124 and press 2 for tax form issues. Still a wait, but better than the regular line.

I spent 2 hours on hold today and FINALLY got through to someone. They said they're aware of the "duplicate 1099 situation" affecting "some claimants" and are working on sending corrected forms. The agent told me to wait for the corrected form before filing. If you haven't filed yet, WAIT!

how long did they say the wait would be for corrected forms?

Here's a detailed breakdown of what to do in this situation (I work in tax preparation): 1. First, document the correct amount you actually received in 2023. Print your payment history from your online account. 2. Try to get a corrected 1099-G. The fastest way I've seen clients get through is using claimyr.com - it's a service that waits on hold for you and connects you when a rep answers. 3. If you can't get a corrected form in time, file using the CORRECT amounts, not what's on the erroneous 1099-G. 4. Include Form 8275 (Disclosure Statement) with your return explaining the discrepancy. 5. Keep all documentation showing the correct amounts. 6. If you already filed using the incorrect amount, file an amended return (Form 1040-X). Don't pay taxes on money you never received! This is a known issue with the NY unemployment system this year.

This is super helpful, thanks! Do you know if getting a corrected 1099-G will trigger an audit?

Not typically. The IRS understands that corrected forms happen. Just make sure you're reporting the actual income you received and keep documentation.

Thank you so much for this detailed info! Going to try getting the corrected form first using the method you suggested.

I had this same issue and I just amended last year's taxes and got a fat refund. Thanks NY unemployment for the incompetence! 💰

Has anyone filed for an extension because of this yet? I'm thinking that's my safest bet at this point.

I'm planning to. Not worth the hassle of having to amend later. Extensions are easy to file with Form 4868.

This would only happen in New York 🙄 Every year some new disaster with unemployment. Last year they sent my form to my old address despite me updating it online.

CALL THE ADVOCATE OFFICE!! Regular customer service won't help. The advocate office number is (855) 528-5618. They specialize in difficult cases and tax issues. Took me 3 days but I finally got my corrected 1099.

Really? It worked for me last week. Maybe they changed it because too many people were calling? System is such a mess.

My tax accountant said this is happening with several clients. He recommends filing with the correct amounts (based on your payment history record) and attaching a letter explaining the situation. If you get a notice from the IRS later, you'll have documentation to respond.
