NY unemployment keeps sending overpayment waiver emails even though I submitted it months ago
Just discovered that I got another email from unemployment asking me to fill out an overpayment waiver form. This is so frustrating because I already completed and submitted this exact same form back in August 2023. Has anybody else received multiple requests for the same paperwork? I've kept screenshots of my confirmation page from when I originally submitted it. Called their customer service line three times last week but couldn't get through to anyone. The system keeps saying I owe $3,800 which I don't think is correct since my original claim was approved without any issues. They're threatening to start collections if I don't respond within 14 days, but I literally already did this! Should I just resubmit the same form again or is there another way to get them to acknowledge my previous submission?

yep, welcome to the wonderful world of NY unemployment bureaucracy hell. i've gotten the same email 3 times now over 7 months. Every time I call and speak with someone they say 'oh it's in the system don't worry' but then another email comes. I'd resubmit it and DOCUMENT EVERYTHING - take screenshots, record confirmation #s, etc.

•Still in limbo, but i finally got someone on the phone who put a note in my file. Said the system sometimes auto-generates these emails even when youve already submitted. Super annoying but what else is new with govt systems 🤷♂️

•They don't ask for any personal info! They just call unemployment and when a rep answers, they connect you. You talk directly to unemployment. I was skeptical too but was desperate after weeks of trying

•Yep! Got it processed on the call. They marked my account that I had already submitted it back in July. Money well spent considering I was about to lose way more if collections started

OMG YES THIS IS HAPPENING TO ME TOO!!! I filed my waiver in October and they keep sending me emails saying I need to file it. I've resubmitted it THREE TIMES now and they still act like they never got it. The whole system is broken AF.

I work for a legal aid office (not giving legal advice here) but we've seen a lot of these cases lately. NY unemployment's system underwent an update last year and it seems to have created issues with tracking waiver submissions. If you've already submitted once, document EVERYTHING, including dates, confirmation numbers, and screenshots. Then resubmit again with a cover letter explaining this is a duplicate submission due to their system error.

Call them!!!! Like seriously, calling is the only way to fix these things. Email and online submissions go into what I call the "digital void" where nobody actually sees them. I know its a pain but you gotta talk to a human who can actually look at your file and make notes.

FYI - these waiver forms have an expiration date! Even if you submitted before, if theyre sending a new one, the old submission might not count anymore. The fine print says you have to reestablish your hardship every 6-12 months depending on the type of overpayment.

•It's not new but they don't advertise it. Read the very bottom of the waiver form - there's language about periodic review and re-certification of financial circumstances.

fun fact: ny unemployment has over 400,000 backlogged cases of various issues according to a report i read last month. ur paperwork is probably sitting in a digital pile somewhere with thousands of others. the system is a dumpster fire.

I had 6 seperate overpayment notices for a total of $7,655. Took me 3 months of fighting but finally got them waived after I could prove it was their mistake. Document EVERYTHING and dont give up!

This is a known issue their customer service reps are aware of but can't fix without supervisor intervention. The only way to resolve it is to speak directly with a tier 2 support person. Regular agents don't have access to the waiver submission database. Ask for a supervisor specifically when you call.
