Getting emails about waiving overpayment but already completed it last year - NY unemployment confusion

I just got this weird email from ny unemployment telling me I need to waive an overpayment based on some letter they supposedly sent me. The thing is, I never got any letter in the mail about this. What's even more confusing is that I already filled out and submitted the overpayment waiver form back in August 2022 (and I have the confirmation email to prove it). I haven't collected a single penny of unemployment since then. Why would they suddenly ask me to do this again? Has the DOL forgotten that I already did this? Wondering if anyone else is getting these random emails or if there's some new rule I don't know about. Not sure if I should resubmit or if that would mess something up in their system. The last time I dealt with them it took forever to get things straight.

Yeah their emails are always a mess. I'd double check your spam folder for the letter they're talking about, sometimes important stuff gets filtered there. If you still can't find it, you might need to call them to figure out what's going on. It sucks but try using claimyr.com - that's how I finally got through to a real person after trying for weeks. Talking to an agent got my issues sorted out in like 10 minutes and saved me so much stress! They called me back with a live agent on the line. Check it out: https://youtu.be/Rdqa1gKtxuE

is that site actually work? I've been trying to reach them for 2 weeks straight 🤬

0 coins

100% worked for me! I was desperate after calling literally 30+ times and always getting hung up on. The callback came within a couple hours and the agent fixed my issue right away. Best decision I made during this whole unemployment nightmare.

0 coins

sounds too good to be true... what's the catch?

0 coins

No catch that I experienced. They just do the waiting for you and connect you with an agent. After spending days getting nowhere on my own, it was worth it to finally talk to someone who could actually help.

0 coins

hmm I've been burned by so many of these 'services' before... what makes this different? not trying to waste time on another wild goose chase 🙄

0 coins

What made it different for me was that it actually worked lol. I was super skeptical too, but I was at my wits end. The agent I got was able to fix the issue with my claim that had been pending for over a month.

Same thing happened to me! I got that email last week but already filled out the waiver form in September 2022. Called them (took me like 40 tries to get through) and they said there was a glitch in the system sending out automated reminders to people who already completed the process. The rep told me to ignore it if I have confirmation that I submitted before. Their system is such a disaster.

0 coins

40 calls is lucky. I've been trying for 3 weeks with no luck. Gonna eventually try something else cuz this is ridiculous

0 coins

Did they say if there might be any issues with ignoring it? I'm worried about getting penalized if I don't respond to the email.

The lady I talked to said as long as you have proof you submitted before (like an email confirmation or screenshot) you should be fine. But honestly, who knows with them...

The NY unemployment system is completely broken. I've been dealing with similar issues where they keep sending me confusing, contradictory notices about stuff I already took care of. What worked for me was going to my ny.gov account and checking my message inbox there - sometimes there are letters/notices in there that never arrive by mail or email. Might be worth looking to see if the letter they're talking about is in there.

I know exactly what ur going thru. This happened 2 me back in April. I ended up calling and waiting on hold for 3 hours only to be told that it was sent by mistake. Then a month later I got ANOTHER email about the same thing! Called again and they said 'oh just ignore it'. Their system is sending these out randomly to people who already completed the waiver. Such a waste of time and stress for nothing.

0 coins

That's frustrating! Did they ever send you anything else after that second email or did it finally stop?

0 coins

it finally stopped after the 2nd time. But I saved screenshots of everything + the agent's name/ID# just in case they try to come after me later claiming I ignored something important.

This is part of their new system update. The DOL is reviewing all past overpayment waivers from 2021-2022 and sending out new notices. Even if you already submitted one, they're asking some people to resubmit with updated documentation. My sister works for the state (not unemployment but another agency) and said they're trying to clear old cases before the end of the fiscal year. I'd call to confirm but you probably should resubmit just to be safe. I had to call about a different issue last month and I used claimyr.com to reach someone - it was the only way I could actually get through after weeks of trying on my own. Talking to a real person got everything fixed in one call. Their callback service connected me directly to an agent who explained exactly what I needed to do.

0 coins

wait hold up - does this claimyr thing actually work? I've been trying for days to talk to a human at unemployment 😩

0 coins

Yes! It saved me hours of frustration. They stay on hold for you and only call when there's an actual person ready to talk. I was skeptical but it worked perfectly.

0 coins

Do you think resubmitting could mess up the system more? Like what if they think I'm filing twice and that causes more problems?

0 coins

That's a valid concern. Maybe call first using the claimyr service to get confirmation before you resubmit anything. The agent I spoke with was really helpful and could see exactly what was happening with my account.

HEADS UP EVERYONE - this appears to be a MASSIVE issue affecting tons of people. There's a Facebook group for NY unemployment issues with over 4,000 comments about these random overpayment waiver emails going out this month. Most people already submitted their waivers ages ago. Some people called and were told to ignore it, others were told they need to resubmit. It's a complete disaster and nobody at the DOL seems to know what's happening. Classic NY unemployment chaos 🤦‍♂️

0 coins

can you share a link to that Facebook group? would be good to follow what others are experiencing

0 coins

cant post FB links here (against forum rules) but if you search "New York Unemployment Issues & Help" you'll find it. Tons of info there.

THIS!!! I'm in that group too and it's blowing up with these exact complaints. The DOL is a complete joke.

Here's what you need to do (I work in HR and have helped many employees navigate unemployment issues): 1) First, check your ny.gov account messaging center for the letter they're referring to 2) If nothing's there, you need to speak with a claims specialist who can see exactly what's happening with your account. Regular customer service reps often give wrong information. 3) Be prepared with your confirmation number/date from when you submitted the original waiver in 2022 4) Document everything - who you talk to, what they say, dates, times, confirmation numbers 5) If they tell you to resubmit, ask them to note in your file why you're submitting again Sadly, the fastest way to resolve this is to speak directly with a specialist. After years of dealing with the broken NY unemployment system, I've found that claimyr.com is absolutely the most efficient way to get through to an actual person who can help. The callback service saves hours of frustration and connects you directly with someone who can fix your issue. Don't panic - these system glitches happen regularly, but protecting yourself with documentation is key.

Thank you for such a detailed response! I'll check my ny.gov account right away. Do you know if the specialists are available on weekends or just weekdays?

0 coins

They're generally only available weekdays 8am-4pm. Earlier in the week is better - Mondays and Fridays are usually swamped. Good luck!

dont do anything!!! its a phishing scam not a real email from unemployment! check the sender address carefully, theres been a huge wave of fake unemployment emails lately trying to get people to click on links or submit personal info. I almost fell for one last month that looked super official

0 coins

OMG are you serious?? I already clicked the link in the email... 😱

0 coins

Change your passwords ASAP and check that the email actually came from a .gov address. If it wasnt from noreply@labor.ny.gov or something official like that, it was probably fake.

0 coins

I double checked and my email is definitely from the official NY DOL address, so I don't think it's a scam in my case, but this is really good to know! Thanks for the warning.

I've got a friend who works at the unemployment office (not saying which location for obvs reasons). She says their systems are a complete mess right now because they're migrating to a new platform and lots of automated emails are going out by mistake. Her advice is to call and speak to a tier 2 agent (you have to specifically ask to be transferred to tier 2) who can see if you're actually flagged for a new waiver request or if it's just a system error. Most tier 1 agents don't have access to the full history.

Anyone notice how these issues ALWAYS happen right before a holiday weekend or major system update? It's like they purposely create chaos when they know staffing will be low. I swear the whole department is run by clowns 🤡

0 coins

I've been saying this for YEARS! Remember last Thanksgiving when they sent out those mass overpayment notices right before the office closed for 4 days? Pure evil.

0 coins

It's not a conspiracy, it's just incompetence. They schedule system updates during off-hours/weekends when fewer people are filing claims.

0 coins

Incompetence doesn't explain why this happens EVERY. SINGLE. TIME. But whatever, keep defending them lol

0 coins

There was an article in the NY Times about this exact issue last week. Apparently, due to a system glitch, the DOL is re-reviewing all overpayment waiver requests from 2021-2023, even ones that were already processed. Some people are getting duplicate notices. Others are getting notices for the first time even though they should have received them years ago. Total administrative nightmare.

Dealing with NY Unemployment is the worst experience of my life. I spent 6 MONTHS trying to resolve an overpayment issue similar to yours. Endless phone calls, emails, and letters. Nothing worked until I found a way to reach a real person who actually had authority to fix things. After multiple failed attempts, I discovered claimyr.com and it changed everything. Within hours I was talking to an actual claims specialist (not just a call center rep) who resolved my issue on the spot. It was the best money I've ever spent to finally get my benefits situation straightened out. My advice: don't waste time with generic customer service. Go straight to someone who can access your full file history and make decisions. The peace of mind is worth it.

another day, another company promising to fix the unfixable unemployment system lol... is this an ad?

0 coins

Not an ad, just sharing what worked after months of hell. Before finding that service I was literally considering hiring a lawyer because I couldn't get anywhere on my own. Do whatever works for you.

0 coins

So I was about to throw my phone after 3 hours on hold when I saw this recommendation. Tried it out of desperation and it actually worked! Got a callback within 90 mins with an agent ready to help. Still mad I had to use a service just to reach my own state government but at least I finally got answers.

0 coins

you need to print out and mail them a letter with CERTIFIED mail (return receipt) stating that you already submitted the waiver and include copies of any proof you have. The DOL constantly "loses" electronic submissions but they can't ignore certified mail. I learned this trick from my lawyer after fighting with them for 9 months over a similar issue.

0 coins

Probably unpopular opinion, but just fill it out again. Yes, the system is broken. Yes, it's annoying. But fighting it will take 10x longer than just resubmitting the form. Pick your battles. I spent weeks arguing with them about a duplicate request last year before finally giving in and just doing it again. Form took 15 minutes, arguing took weeks.

0 coins

This is the most practical advice here. The system sucks but sometimes you just gotta play along to get it over with.

what email address did it come from? been lots of unemployment scams lately. make sure it's actually from the DOL before you do anything
