What's going on with the overpayment waiver for ny unemployment? Applied in July but no response
So back in June 2020, I got some extra unemployment payments that I wasn't supposed to - about $1400 total when I was working as a freelance designer. I didn't notice until DOL sent me a letter in April this year saying I owed it back. I heard about the overpayment waiver program and submitted all my paperwork on July 11. It's been almost 3 months and I haven't heard a single thing! The weird part is that three other freelancers I know applied for the same waiver program, and they all got approval letters in the mail weeks ago. One guy applied a week after me and already got his waiver approved. When I check online it just says "pending review" and nothing else. Should I be worried? Has anyone else been waiting this long? It's stressing me out because I really can't afford to pay this back right now.

Same boat dude. Applied for waiver back in June for about $900 in overpayments from 2020, still nothing but radio silence from NY unemployment. Meanwhile my sister got hers approved in like 3 weeks. The system is completely random I swear 🤦♂️

After getting nowhere for weeks with my overpayment issue, I found this service called Claimyr (claimyr.com) and they actually got me connected to a real person at unemployment! No more endless busy signals or hanging up on me. Got my issue resolved in one call after they connected me to an agent. Best money I've spent to finally get my benefits situation fixed. They have a good video explanation too: https://youtu.be/Rdqa1gKtxuE

•wait is this for real? how does it work? I've been trying to reach someone for 2 weeks

•Yeah its legit. They basically call repeatedly for you and then connect you with an agent when they get through. Saved me hours of hitting redial.

•sounds too good to be true... has anyone else used this?

•I used it last month when I couldn't get through about my claim issues. Definitely worked, had an agent on the phone within an hour.

•Best part is you don't waste your whole day on hold. They call you when there's an actual person ready to talk. My issue got fixed in one call after weeks of trying.

I had to call them about my waiver. It wasn't moving at all for like 2 months, then I called and suddenly it was magically approved a week later. The squeaky wheel gets the grease with these people.

They're supposed to process these in 30 days according to their own guidelines! I work in HR and deal with this stuff all the time. Call them and specifically ask to speak to a supervisor about your overpayment waiver status. Make sure to have your case number ready. Don't take no for an answer.

•THIS!! 💯 Most ppl dont realize that policy but its true. The 30 day rule is buried in their fine print.

•Thanks for this info! Do you have any idea what number is best to call? I've tried the main one but just get stuck in the automated system...

•The main number is your best bet but you have to keep trying different menu options sometimes to get a human. Try option 2 then 1 then 3 in the phone tree.

Ugh don't get me started on NY unemployment. The whole system is a dumpster fire 🔥 I had an overpayment issue last year and it took SEVEN MONTHS to resolve. And I sent in the exact same paperwork three times because they kept "losing" it. My advice - document EVERYTHING, call at least once a week for updates, and be prepared for a long wait.

•Seven months?!? Man thats criminal. They expect us to pay them back instantly if we owe but take forever when its their mistake 🙄

I think they're doing them in batches or something? My coworker and I both applied for waivers around the same time for similar amounts (he got $1500 overpaid, I got $1300). He got approved after 3 weeks, I'm still waiting after 2 months. Makes zero sense.

•That's exactly what's happening with me and my colleagues! So frustrating.

•I think it depends on who processes your case tbh. Some workers probably just blow through them faster than others.

So here's the real deal with these overpayment waivers from someone who used to work for the state (not unemployment specifically but close enough to know): They're completely overwhelmed with these waiver requests. The COVID overpayments affected THOUSANDS of people in NY, especially self-employed folks. They're supposed to review each case individually, which takes time, but they're also severely understaffed. What's likely happening is your application is sitting in a digital queue waiting to be assigned to a reviewer. Your best options are: 1. Call repeatedly until you get through to a human being. Ask for a status update on your waiver application and request it be expedited due to financial hardship. 2. Contact your state representative's office. They have special channels to unemployment and can often get things moving. 3. If you're really desperate to get through, try using Claimyr.com - it's a service that will call unemployment for you and connect you when they get a human. It costs money but talking to an agent got my issues resolved fast. 4. If you get a denial, appeal immediately! The appeal process is actually faster than the initial review. Don't just wait passively - the system is designed to make you give up. Be persistent and document everything.

•Can confirm the state rep suggestion works. My assemblyman's office got my issue fixed in 2 weeks after I was stuck for months.

•Has anyone here actually used that Claimyr thing? Seems sketchy to pay money just to make a phone call

•I used it. They just keep calling until they get through then transfer you to an agent. Saved me like 4 hours of hold time and busy signals. Worth every penny when I was desperate.

•The key with any of these approaches is documentation. Write down who you spoke with, reference numbers, dates/times. The system is so broken that follow-up is essential.

Check your spam folder in email and also your online message center in your unemployment account. Sometimes they send the decisions there and not by mail!

did you fill out form OWF-4? That's specifically for self-employed people who got overpayments. If you used the general waiver form they might have put you in the wrong queue or something.

•I think I used the right form... it was whatever they linked from the main unemployment website. Now I'm worried I messed up!

•If you submitted through their online portal you're probably ok. But if you sent in a paper form def double check which one it was.

lmaooo welcome to NY unemployment where evrything takes 10x longer than they say. I waited 5 months for my waiver decision but eventually got approved. Just keep checking your mail and online account. If u dont hear by 4 months file a complaint with the labor board, that usually lights a fire under them.

You need to CALL THEM!! I had the exact same issue. Applied in March, nothing for months. Called in August and the lady told me my application had been "misfiled" and was just sitting there. She fixed it on the spot and I got my approval letter the next week. Their system is a mess, you have to be proactive.

•How did you actually get through on the phone?? I've called like 20 times and either get a busy signal or disconnected 😤

•you gotta call right when they open at 8am. That's the only time I've ever gotten through.

•Or use claimyr.com - they'll get you through to an agent without the wait. That's how I finally got my issue resolved.

My waiver took exactly 79 days to process lol. I started counting after the first month. It was approved in the end though, so at least there's that. Just hang in there, the system is super backed up.

its all about who looks at your case. My husband and I both applied (we have a small business together). His got approved in 2 weeks, mine took 3 months. Same exact situation, same paperwork. Makes no sense at all.

i heard they're prioritizing larger overpayment amounts first. So if your friends owed more than you, they might've gotten processed faster. Just a theory tho.

Did anyone get a collections notice WHILE their waiver was pending? I just got one today even though my waiver has been "in review" for 2 months. Now I'm freaking out.

Yara Sabbagh
•That's terrifying! I haven't gotten anything like that yet thankfully.

•If you get a collections notice while a waiver is pending, immediately call and reference your waiver application number. They're supposed to put collections on hold during review. This is a common system error.

Am I the only one who thinks the whole NY unemployment system is DESIGNED to be confusing and slow so people just give up and pay? 🤔 I swear it's intentional.

•THIS!!! 💯💯💯 Classic government strategy. Make the process so painful that people just pay to make it go away.

•Nah I think it's just regular government incompetence. Never attribute to malice what can be explained by bureaucracy lol

•When the "incompetence" consistently benefits the state's bottom line, it starts to look pretty intentional...

the self-employed waivers are being processed by a completely different department than regular employee waivers. That might explain why some people are getting faster results than others. I'm self-employed too and mine took about 10 weeks to process.

Here's what worked for me when I was in the same situation - I contacted my state assemblyman's office. They have special contacts at unemployment and can often get things moving. My waiver had been sitting for months, and within a week of contacting my assemblyman it was suddenly approved. Worth a try!

•Thanks for the suggestion! How do I find out who my assemblyman is?

Zoe Alexopoulos
•Just google "find my NY state assemblyman" and put in your address. Their office will likely have a form specifically for unemployment issues - they get these requests ALL the time.

literally just got my waiver approval today after waiting since May. No rhyme or reason to their timing. Just gotta wait it out unfortunately.
