ESD overpayment credits still pending for months - anyone got updates?

Im so frustrated! I got hit with a $5,700 overpayment notice back in May and submitted all my paperwork for a waiver in July. It's now been 4+ months and I haven't heard ANYTHING from ESD about the status. My online account just says "waiver under review" but nothing else. Has anyone actually gotten credits applied to their overpayments recently? Or heard anything about how long the backlog is? I'm terrified they're gonna start garnishing my wages soon. My coworker said it took 12 weeks for his waiver to process but that was months ago...

I had an overpayment of $3,890 from 2023 and got my waiver approved last month after waiting since June. About 14 weeks total. The system is incredibly backed up right now - one of the agents eventually told me they're dealing with a huge influx of overpayment review requests because of some system audit they ran. Try calling the overpayment collections department directly at 866-697-4831 rather than the main ESD line. They actually pick up sometimes and can give you status updates.

Thanks for that number! I'll try calling them tomorrow. Did they send you a letter when it was approved or did it just show up in your online account?

still waiting on mine too, been 5 months. this is ridiculous!!!

Same boat, it's maddening. My rep told me last month they were processing June applications so you should be getting an answer really soon. Keep checking your online correspondence folder daily.

ESD is definitely behind on processing overpayment waivers right now. I work with clients dealing with this issue, and here's what you need to know: 1. The current processing timeframe is approximately 16-20 weeks from submission date 2. You should have received an acknowledgment letter when your waiver was received - check your correspondence folder 3. If you haven't received any acknowledgment, your waiver might not be properly in the system 4. While waiting, make sure you've documented financial hardship clearly - this significantly improves approval chances 5. Contact the Collections unit at 866-697-4831 to confirm they've received your waiver and to check status If you're worried about wage garnishment, you can request a temporary hold on collections while your waiver is pending. You'll need to call and specifically ask for this.

Thank you for all this detail! I did get an acknowledgment letter back in July, but nothing since then. I'll definitely call that collections number and ask about the hold. Do you know if they're approving most waivers or denying them? I'm so stressed about this.

U should just pay it back, thats what i had to do. they denied my waiver after 3 months and said i had to pay back 4200$ even tho the mistake was there fault in my opinion. started garnishing my check 2 weeks later..... the system is rigged against us!!! 😡

The system isn't rigged - your situation was probably different. Not all overpayments qualify for waivers. It depends on whether you received benefits you weren't eligible for through no fault of your own, and if repayment would cause financial hardship. Did you demonstrate both of these factors clearly in your waiver request? The approval rate is actually quite high for properly documented waiver requests.

I had a similar situation with a $6,230 overpayment from last year. After waiting 5 months for my waiver to process, I was getting desperate to speak with someone. Regular phone lines were useless - always busy or disconnected. I finally tried Claimyr (claimyr.com) and it actually worked! They got me connected to an ESD agent in about 20 minutes after I'd spent weeks trying to get through. The agent was able to see my waiver was actually approved but stuck in their system waiting for final processing. They expedited it and I got the confirmation letter 3 days later. They have a video showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 Definitely worth it to get answers instead of stressing for months.

does it really work? ive heard of it but never tried it

Yes, it really does. I was skeptical too but I was desperate after 5 months of waiting. The key is that once you get through to an actual claims specialist, they can see exactly what's going on with your case and sometimes fix things on the spot. My waiver was actually approved but stuck in processing limbo until I got someone to look at it.

I might try this if my call tomorrow doesn't get me anywhere. I'm willing to try anything at this point - the stress is making me sick. Thanks for sharing your experience!

Just to add my data point - I submitted my overpayment waiver in early May for $4,250 and got approval in mid-September. So about 18-19 weeks total. They sent a letter in the mail and it also showed up in my online account. The approval was retroactive too, so they refunded the $350 I'd already paid before submitting the waiver!

This is a good reminder for everyone - if you've made any payments toward an overpayment before getting a waiver approved, make sure you check that they refund those amounts! ESD is supposed to do this automatically, but it's always good to verify.

By the way, one thing I learned during my process - make sure you keep filing your weekly claims if you're still eligible for benefits. Even while your overpayment review is pending, continuing to file keeps your claim active and can prevent other issues down the line. Plus, if your waiver gets approved, you'll actually receive those benefits instead of them going toward the overpayment balance.

I'm not on unemployment anymore, thankfully found a job in September. But this is really good advice for others!

Based on current ESD processing timelines, here's what you should expect with overpayment waivers: * Acknowledgment letter: 1-2 weeks after submission * Initial review: 10-12 weeks after submission * Final determination: 16-20 weeks after submission The best strategy while waiting is to: 1. Request a hold on collections actions while your waiver is pending 2. Check your online correspondence folder at least weekly 3. If you approach the 20-week mark, that's when you should escalate by contacting your state representative In most cases, reaching out earlier won't expedite the process as they review applications in the order received. However, if you're facing imminent wage garnishment or tax intercept, that's considered a hardship case that can be prioritized.

This is excellent advice. I'd add that if you need to escalate to your state representative, include your ESD ID number, the date you submitted your waiver request, copies of any acknowledgment letters, and a clear timeline of your attempts to resolve the issue. This helps them intervene more effectively on your behalf.
