ESD pandemic overpayment waiver taking forever - submitted in April 2025
I submitted my pandemic overpayment waiver to ESD back on April 17th and haven't heard ANYTHING back yet. It's been over 3 weeks now! My account still shows I owe $4,850 from that period when my employer temporarily closed. Has anyone else applied for one of these waivers recently? How long did it take for you to get a response? Getting really stressed about this hanging over my head...

I applied for my pandemic overpayment waiver in March and just got my approval letter yesterday. So about 6 weeks total wait time. ESD is processing them, but they're moving slowly. Make sure you check both your eServices messages AND your physical mail. My approval came through regular mail even though I opted for electronic correspondence.

mine took NINE WEEKS!!! and i had to call them 3 times cuz they kept saying they needed more info but never contacted me about it. so frustrating!!!

•This is really common right now. ESD is severely understaffed in the overpayment department specifically. I work with clients dealing with these issues all the time. If you need to reach them quickly, I recommend using Claimyr (claimyr.com). They can get you through to an ESD agent without the endless hold times. The deadline for filing is July 31, 2025, so you still have time to apply for yours.

I don't buy that these waivers are anything but a scam to make people think they might get relief while ESD continues to collect. My brother applied for one in January and it's been "under review" for MONTHS with no updates. Meanwhile, they're still garnishing his tax returns and threatening collections. The whole system is designed to extract money from people who were already struggling during the pandemic.

•That's not entirely accurate. I literally just got my waiver approved yesterday after waiting 6 weeks. They waived the entire $3,780 I supposedly owed. They're definitely approving some of them, but the wait is long. Your brother should call and check on his status - it shouldn't take 4+ months.

Did you check your spam folder? I thought mine was being ignored too but turns out they'd sent me an email requesting additional financial documentation that went to spam. Once I provided that info, it was approved in 10 days.

One important thing to note: if you've already started a payment plan with ESD for your overpayment, make sure you continue making payments until you receive official waiver approval. If you stop paying and your waiver is denied, they can add penalties and interest to your balance. I've been helping people navigate this process in my job, and I've seen several cases where people assumed their waiver would be approved and stopped paying, only to end up with larger debts.

What I usually advise clients is to call ESD and request a temporary hold on collections while your waiver is being processed. Get the agent's name and ID number, and note the date and time of the call. This creates a record that you've been proactive.

btw has anyone had issues w/ ESD sending the waiver approval to their old address?? my friend just found out her waiver was approved a month ago but she never knew cuz they sent it to where she lived during the pandemic!! make sure ur address is updated in the system!!

They're specifically looking at your income-to-expense ratio to determine financial hardship. Include ALL regular expenses including housing, utilities, food, transportation, insurance, medical costs, and debt payments. If your expenses exceed or nearly match your income, that strengthens your case for a waiver.

Anyone else think it's INCREDIBLY SUSPICIOUS that ESD is suddenly offering these waivers right before the 5-year statute of limitations kicks in for pandemic unemployment claims??? It's like they're trying to get people to acknowledge the debts before they legally expire! Be careful what you sign!!!
