Any timeline for ESD waiver decisions? Waiting for weeks with no updates

I submitted an overpayment waiver application to ESD about 5 weeks ago, and my friend submitted hers around the same time. Neither of us has heard anything back yet. There wasn't any clear information about how long the review process takes when we applied. Has anyone successfully gotten an overpayment waived recently? How long did it take before you heard back? The $4,700 they want me to repay is giving me serious anxiety - I don't have that kind of money after being laid off from construction work. I check my eServices account daily but there's no status update showing.

From my experience helping clients with ESD waivers, there's no standard timeline they're required to follow. I've seen decisions take anywhere from 4-12 weeks depending on their current workload and the complexity of your case. The fact that both you and your friend are still waiting at 5 weeks is actually pretty normal. I suggest checking your correspondence tab in eServices, not just the main dashboard, as sometimes notices get posted there without triggering an email notification.

Thanks for the response. I've been checking the correspondence tab too and there's nothing new. Is there any way to get an update on where my waiver is in the process? I'm trying to figure out if I should start putting aside some money each month just in case they deny it.

That's exactly what I'm afraid of! Did you submit any additional documents with your waiver application? I'm wondering if I should send them more proof of my financial hardship even though I already included bank statements and bills with my initial application...

The official ESD guidance says they review waiver applications in the order received, but they don't publish specific timeframes. In my professional experience working with unemployment cases, several factors influence processing time: 1. Current department workload (usually heaviest January-March) 2. Complexity of your specific case 3. Whether they need additional information 4. Dollar amount of the overpayment (larger amounts often get more scrutiny) The best approach is to monitor both your eServices account and postal mail, as sometimes they send physical notices rather than electronic ones. Also, make sure you've submitted thorough financial hardship documentation if you're requesting a waiver based on inability to pay.

I appreciate the detailed response. My overpayment is for $4,700 so I guess that might take longer to review. I included three months of bank statements, utility bills, and rent receipts with my application. I'm just worried they'll make a decision without fully understanding my situation.

Have you tried calling them? Sometimes you can get info on your waiver status if you can actually reach someone. I know their phones are impossible but I used a service called Claimyr last month when I was desperate to reach ESD about my adjudication issue. It got me through to an actual person in about 25 minutes instead of calling for days. They have a video showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 The website is claimyr.com if you want to check it out. Might be worth it to get an update on your waiver.

I hadn't heard of that service before. I've called ESD directly at least 12 times and either get disconnected or told the wait time is over 2 hours. I'll look into that option because at this point I just need some kind of answer, even if it's just to know how much longer I need to wait.

This is so unhelpful. Not everyone has the same experience with ESD. I got my waiver approved in 6 weeks back in January. Different departments and different cases move at different speeds.

ESD waiver processing follows a pretty standard path, and here's the timeline I've observed both personally and from helping friends navigate the system: - Initial processing/assignment: 2-3 weeks - Review of financial documentation: 2-4 weeks - Decision making: 1-2 weeks - Notification of decision: 1 week So at 5 weeks, you're probably in the middle of the review stage. One thing that might help is submitting a secure message through your eServices portal asking for a status update. Be polite, provide your claim ID, mention when you submitted the waiver application, and simply ask if they can provide an estimated timeframe for a decision. I've found this approach sometimes gets you more information than calling.

Thank you for breaking it down like this! I just sent a secure message asking for an update. The weird thing is my friend got asked to provide additional documentation last week (proof of rent payments) but I haven't been asked for anything more. Does that mean they're processing hers faster or that mine might be denied without asking for more info? I'm overthinking everything at this point.

has anyone else notice that they seem to be denying more waivers this year??? i know 3 ppl who all got denied even with good reasons!! seems like they just want our $$

I haven't seen any evidence of increased denial rates. In fact, ESD published data showing they approved approximately 63% of waiver requests in Q1 2025, which is actually slightly higher than previous quarters. The key factors remain the same: whether the overpayment was your fault, your ability to repay, and how well you documented your financial hardship. Proper documentation is critical.

Update: I actually just checked my mail and received a letter from ESD requesting additional information about my income for the 3 months after my benefits ended. They're giving me 7 days to respond. My friend still hasn't heard anything beyond the request for rent verification. Seems like they're processing our waivers separately even though we applied around the same time. I'm relieved to at least know someone is looking at my application!

This is excellent news! When ESD requests specific additional information, it typically means your application is actively being reviewed. Make sure to provide exactly what they're asking for, and consider including a brief cover letter that references your waiver application number and summarizes the documents you're submitting. Send it with delivery confirmation if possible. The 7-day deadline is important - if you need more time, call immediately to request an extension rather than missing the deadline.
