NY unemployment overpayment waiver email arrived again - already submitted last year

Just checked my inbox and found ANOTHER email from NY unemployment asking me to fill out an overpayment waiver form. I already did this about a year ago and thought it was resolved! Has anyone else received a second request for the same waiver? I'm confused whether I need to resubmit or if they lost my original paperwork. The email looks legitimate (same sender as before) but I'm hesitant to go through that whole process again if I don't have to.

This is actually a known issue with the NYSDOL system right now. They're sending duplicate waiver requests to people who already submitted them. I spoke with a representative last week about this exact problem. You should call to confirm they received your original waiver before completing a new one. Otherwise, you might create confusion in your case file with duplicate submissions. If your original waiver was approved, you should have received a confirmation letter. Did you get anything like that after your first submission?

I honestly don't remember if I got a confirmation letter! It was around March 2024 when I submitted it. I'll have to dig through my old mail. Should I just ignore this new email then?

I had this same issue and spent THREE DAYS trying to get through to someone at NY unemployment. When I finally reached a rep, they confirmed my original waiver was in their system but hadn't been processed yet due to backlog. The second email was automatically generated by their system. I'd definitely recommend verifying the status rather than assuming it's a mistake or resubmitting without checking first. Better safe than sorry with overpayment issues!

Literally called 27 times over three days. It was maddening. I finally used Claimyr.com which got me through to an agent in about 20 minutes. They have this system that holds your place in line and calls you when an agent is available. Saved me so much frustration! DONT IGNORE THESE NOTICES!!! I ignored one thinking it was a duplicate and ended up with a $4,250 overpayment on my record that went to collections!!! Now I'm fighting to get it removed and it's HELL. Definitely call and verify before assuming anything with NY unemployment.

My sister works at NYSDOL (not in the unemployment division tho) and she said they're migrating to a new system and lots of automated emails are being triggered incorrectly. But she also said you should ALWAYS call to verify rather than assume. Their internal systems don't always show the same information that's in your online account.

I got this same email yesterday and I also submitted my waiver last year (July 2024). I called this morning after trying for 2 hours and they confirmed my waiver was approved in September and these emails went out in error. The rep made a note on my account and told me to disregard the email. She said a lot of people are calling about this issue.

does anybody know if theres a deadline mentioned in the email? mine says i gotta respond within 30 days but if its a mistake i dont wanna waste time with this

Even if it's potentially a system error, I wouldn't ignore that 30-day deadline. If your notice has a deadline, you should at least contact them before that date passes to verify whether you need to respond or not.

this happened to my cousin too but she just submitted a new waiver to be safe. said she'd rather do extra paperwork than risk having to pay back $$.

Update from what I heard: NYSDOL is aware of the duplicate waiver emails and they're working on sending a clarification email to everyone affected. But don't wait for that email - if you're concerned, you should still call to verify your status. The new system migration has caused lots of headaches for both staff and claimants.

Thanks for the update! I managed to get through this morning after about an hour of calling. My original waiver was processed and approved, so I can ignore the new email. The representative said they're aware of the issue and working to fix it.
