NY unemployment denied claiming I didn't earn enough despite sending pay stubs

I'm at my wit's end with NY unemployment! On hold right now waiting for a supervisor (day 2 of actually getting through to someone). They're claiming I didn't earn the required $2,975 in my base period, but I KNOW I did - I've sent them my pay stubs already proving it! Now I'm sending everything AGAIN along with a Request for Reconsideration form. The rep I just spoke with is trying to get a supervisor to explain what's happening with my claim. I'm so stressed I'm literally getting physically sick over this. I've got arthritis and just need something to hold me over until I find a new job. Please let this work out! Anyone deal with them wrongly calculating your wages before?

This happened to me back in January. They miscalculated my base period earnings by over $4,000 because one of my employers reported my wages incorrectly. Make sure you're sending all your pay stubs organized by quarter, with a cover letter explaining exactly what the correct calculation should be. The Request for Reconsideration is the right form, but you should also specifically ask for a "wage investigation" when you talk to the supervisor. They can initiate that while your reconsideration is pending.

Hi there, I want to clarify a few important points about base period wage disputes: 1. The NYSDOL uses wage reports submitted by employers quarterly, so if your employer made reporting errors, this needs to be corrected through the wage investigation process. 2. For 2025, you need at least $2,975 in one calendar quarter, and total base period wages of at least 1.5 times your high quarter. So if your highest quarter was exactly $2,975, you'd need at least $4,462.50 total across your base period. 3. Make sure you're looking at the correct base period. For claims filed in 2025, the standard base period is the first 4 of the last 5 completed calendar quarters before you filed. Alternatively, the alternate base period uses the last 4 completed calendar quarters. 4. The Request for Reconsideration form (TC-403HA) must be submitted within 30 days of the monetary determination notice. I recommend sending your documentation via certified mail or the secure upload system on your online account, so you have proof of submission.

Thank you for explaining all this! I definitely meet both requirements - my highest quarter was about $5,800 and my total base period was over $18,000. That's why I'm so confused about why they're saying I don't qualify. I did upload everything through my online account, but maybe I'll try certified mail too just to be sure.

When you speak with a supervisor, ask them to verify which specific quarters they're looking at for your base period, and what wages they show for each quarter. YES but it took THREE WEEKS of calling EVERYDAY and finally getting someone who actually LOOKED at my documents instead of just telling me to wait. Keep fighting!!!

Yes! That's how I know there's an error. The letter shows I only made about $2,100 in my highest quarter, which is completely wrong. My pay stubs show I made $5,800+ that quarter. It's like they're missing entire paychecks from their calculation.

I used that Claimyr service you mentioned and FINALLY got through to someone in the monetary determination unit! They initiated a wage investigation and said it should take 7-10 business days.
