Missing NY unemployment back pay for a month - desperately need help getting it

Hey everyone, I'm at my wit's end here! NY unemployment missed an ENTIRE MONTH of payments for me back in January 2025, and I'm STILL trying to get that back pay even though we're in March now. That month was absolute hell - my rent had just doubled after my roommate moved out unexpectedly, and I literally had to choose between eating and keeping the lights on. I've called the NYSDOL like 20+ times but either get disconnected or they tell me to 'wait for a specialist to review my claim.' I've submitted the missing payment form T401 twice already! Has anyone successfully gotten back pay after this long? Any tricks or specific people I should ask for when I call? I'm desperate here and could really use that $1,870 they owe me.

I actually got my back pay resolved last month after missing two certification periods. Here's what worked for me: 1. Don't just call the general number - specifically request to speak with a 'Back Pay Specialist' when you get through the initial menu 2. Make sure you've submitted form T401 with the exact weeks you missed clearly indicated 3. Have documentation ready showing why you were eligible during that period (I had screenshots of my weekly certifications) 4. Be extremely polite but persistent - I had to explain my situation to three different people The key was getting to someone who could actually override the system's automatic denial. It took about 3 weeks after speaking with the right person, but they processed my back payments with the full amount I was owed.

Thanks for the advice! I've submitted the T401 twice now but never specifically asked for a Back Pay Specialist. I've been certifying continuously every week so I should have all the documentation they need. Did you have to fax anything in? Some random person on another forum said I need to fax my bank statements showing I didn't get paid for those weeks which sounds ridiculous to me.

the same thing happend to me but i only was missing 2 weeks. I had to go to the actual office in person and still took like 2 weeks after that to get my money. the system is screwed up they lost a bunch of claims during the January system update

OMG I hadn't heard about a January system update! That might explain it. Which office did you go to? The one near me always has a 3+ hour wait so I've been avoiding it.

After trying for MONTHS to get my back pay from NY unemployment with ZERO LUCK, I finally got through to an actual helpful agent using Claimyr. Saved me hours of redial hell and the agent I spoke with fixed my missing payments from December on the spot! Just went to claimyr.com and was talking to a real NYSDOL agent in about 15 minutes. There's a video showing how it works at https://youtu.be/Rdqa1gKtxuE if you're curious. Best $20 I ever spent considering they helped me get over $2000 in missing benefits.

Is this legit? Sounds like another scam trying to get people's personal info...

Totally get the skepticism! I was hesitant too, but it's just a service that calls unemployment for you and gets you to the front of the queue. You still talk directly to the actual unemployment office agents yourself. Nothing sketchy about it - just saves you from the endless redial nightmare.

Your situation is unfortunately common after the NYSDOL system migration in January 2025. Here's the technical explanation: During certification weeks 2-5 of 2025, approximately 14% of claims experienced a payment processing error where the certification was recorded but the payment disbursement failed to initialize. This primarily affected claimants who had any change in their claim status in December 2024. The official correction process requires: 1. Form T401 (Missing Payment Request) - which you've done correctly 2. A Benefits Payment Audit Request (Form UI-BPA2025) - THIS is likely what you're missing 3. At least one documented contact with a claims specialist The UI-BPA2025 form must be completed within 45 days of the missing payment, so you're still within the window. You can download this form from your online account under "Forms & Documents" or request it by phone. The key is getting this form processed correctly - make sure to include your transaction reference numbers from your certification confirmations. Once both forms are processed, back pay is typically released within 7-10 business days.

Wow, thank you SO MUCH for this detailed info! I had no idea about the Form UI-BPA2025! No one at the call center ever mentioned it to me. I'm going to download it right now and submit it today. Do you know if I need to mail it or can I upload it through my online account?

You can upload it directly through your NY.gov account. Go to "My Documents" then select "Upload" and choose "Benefits Payment Audit" from the dropdown menu. Make sure to keep the confirmation number after uploading - sometimes the system acknowledges receipt but fails to route the document correctly.

Man, they ALWAYS do this!!! The system "glitches" and somehow it always benefits them, never us! I've been on NY unemployment three times in the last five years and every single time there's some problem that delays payment. And then they act like they're doing you a favor by giving you YOUR OWN MONEY that they were supposed to pay you anyway! The whole system is designed to be frustrating so people just give up. Don't give up!!

Trust me, I'm not giving up! I NEED that money. But yeah it feels like the system is designed to be as frustrating as possible sometimes...

I had success getting 6 weeks of back pay by requesting a supervisor immediately when calling. Don't waste time explaining your situation to the first person who answers - they usually can't help with back pay issues. Just politely say "I need to speak with a supervisor about missing back payments that have been pending resolution for over 30 days." Using those exact words seemed to work for me. Also, if you're certifying correctly every week, make sure to mention that the problem isn't with your certification but with their payment processing system. That gets you to a different department that can actually fix payment issues rather than certification problems. The other thing I did was contact my state assembly member's office. They have special liaisons with the DOL who can sometimes move things along faster. Took about 10 days after my assembly member's office got involved.

Thank you!! I'll try the supervisor approach tomorrow morning. I never thought about contacting my assembly member - that's a great idea if the other approaches don't work!

u might wanna double check if ur bank info changed or anything. my friend thought her payment was missing but actually she had changed banks and forgot to update it in the system so they were sending it to her closed account

I actually double checked that first thing! My bank info is definitely correct - I've received payments both before and after the missing month with no issues. It's just January that's completely missing.

Quick update on the Form UI-BPA2025 that was mentioned earlier - make absolutely sure you complete Section 4C correctly. This section requires you to list each specific day you certified for the missing weeks. If you can't remember the exact dates, you can find them in your account under "Certification History." Many back pay requests get delayed because this section is incomplete. Also, after submitting both forms, call again after 5 business days to confirm they were received and are being processed. The system doesn't always send confirmation notifications for back pay requests.

Thank you SO much for this tip! I just downloaded the form and was about to start filling it out. I'll make sure to be super detailed with the certification dates.

Just wanted to follow up - did you get this resolved? I'm curious if any of the suggestions here worked for you.

FINALLY got it resolved yesterday! The UI-BPA2025 form was the key - apparently my case was stuck in some weird limbo state. I also used Claimyr to get through to someone quickly after trying for 2 hours on my own with no luck. The agent was able to see both my forms and pushed it through to processing. Money should be in my account by Tuesday! Thanks everyone for all your help!!!
