NY unemployment approved but no payments in 6 weeks - might lose home due to Chapter 13 bankruptcy
Filed for NY unemployment on 01/25/2025. Got my Monetary Determination Letter on 02/01 showing I qualify for the full $605/weekly benefit. Completed all my questionnaires digitally same day. Been certifying every week without fail, but ZERO payments after 6 weeks of waiting!! Called the governor's office yesterday (finally got through in under 5 mins to an actual human being at the claims center). They said everything looks clear on their end but there's "no way to escalate" until 10 WEEKS have passed for "entitlement review" - are you kidding me?? Here's my problem - I have an active Chapter 13 bankruptcy from 2022 that I've maintained perfectly until now. With no unemployment payments for 6 weeks and NONE coming for at least 4 MORE weeks, I'm in immediate danger of having my bankruptcy case dismissed and LOSING MY HOME. Is there ANY way to expedite this process? Can I file for temporary rent assistance somewhere? At least my SNAP & HEAP applications were approved immediately, so I have money for food, but I'm about to become homeless while waiting for benefits I'm 100% entitled to... Desperate for advice. This system is broken!!!

The 10-week entitlement review waiting period sounds unusual. I've gone through the NY unemployment system recently and while there are sometimes delays, 10 weeks is excessive especially when everything is 'clear on their end.' You have a few options: 1. Contact your state representative/assemblyperson - they can often intervene in these cases, especially with the housing situation 2. File for an emergency hardship review - call the NYSDOL back and specifically mention 'financial hardship' and 'risk of homelessness' - this should trigger an expedited review 3. The system is COMPLETELY BROKEN. I waited 8 weeks last year and almost lost everything too. They keep saying "everything looks fine" but won't actually pay you!! And then they have the nerve to say you can't escalate until TEN WEEKS?? That's insane. What worked for me was calling my state senator's office. They have special contacts at NYSDOL that can actually GET THINGS DONE. The regular phone reps are useless - they just read scripts and have no power to help anyone. Good luck - the system is designed to make people give up!!!

Hate to tell you but i went through excactly this last year. Everything "looked fine" but no payments for 8 weeks. Called 157 TIMES before getting through to someone who could actually help. The regular phone system is useless - they just tell you to wait and wait and wait. My situation got resolved in 3 days after I finally used Claimyr (claimyr.com) to reach a tier 2 agent who fixed everything. They charge a fee but you can see how it works in their video demo (https://youtu.be/Rdqa1gKtxuE). With your bankruptcy situation I wouldn't wait another day - get to an actual agent who can fix things now.

•Yes they got me through to an actual claims specialist who could see what was going on with my account. The regular phone system just connects you to the first-level reps who can't do anything but read what's on your account. The video shows how it works pretty clearly. With your bankruptcy situation it's worth getting to someone who can actually help immediately.

Have you checked if your claim got flagged for identity verification? This happened to me and I was waiting FOREVER with no payments. The weird thing was nothing in my account showed any problems - it just said "pending" for weeks. Go to your online account and look for any messages or "Action Items" that might be hidden. Sometimes they send letters in the mail that never arrive too. Also check if your previous employer is contesting your claim. That can cause super long delays.

And I know my employer isn't contesting because I spoke with them directly. That's what makes this so frustrating - there's literally NOTHING wrong with my claim according to everyone I talk to!

Use the phrase "financial hardship with risk of homelessness due to bankruptcy proceedings" - this exact wording can trigger priority handling And yes, I'd recommend trying the service someone mentioned or contacting your state representatives. Let me tell u something about NY unemployment from personal experience. I had to wait 7 weeks for my first payment in 2025. HOWEVER you will get all backpay at once when they finally approve you. So at least youll get a big lump sum of like $3,600 all at once. Doesnt help now I know but at least youll eventually get everything your owed.

•This is accurate - all approved benefits will be paid retroactively from your eligibility date. However, with a Chapter 13 bankruptcy at risk of dismissal, waiting isn't an option. The courts don't care that you'll eventually get backpay if you miss your current obligations.

BTW my neighbor had their bankruptcy case temporarily suspended because of unemployment issues. The court gave them 90 days of reduced payments until benefits kicked in. DONT listen to people saying you have to wait 10 weeks - that's the standard garbage they tell EVERYONE to get you off the phone. The system is designed to frustrate you into giving up!!!

•Yes they kept their home! The court understands when there's a legitimate reason for payment problems - especially when it's the STATE'S fault for not processing benefits on time. Just make sure your attorney files the right paperwork showing it's temporary and provide proof you've applied for unemployment.

•Quick update: I ended up using Claimyr yesterday and got through to a tier 2 agent who found the problem! Apparently my claim was flagged for "employer verification" even though my employer already verified everything. The agent was able to override this and said I should see payments in 3-5 business days for ALL back weeks. Also met with my bankruptcy attorney who's filing for temporary hardship modification. Feeling much more hopeful now!
