Messed up my NY unemployment claims for 12 weeks - can I fix hours reporting?

Just realized I've been incorrectly reporting my hours for the past 12 weekends. I work at a hotel once a week (Saturdays only) for about 5 hours each shift. When claiming benefits, I've been selecting the '0-10 hours' option but I never specified that I actually worked those hours. I think I might have been getting full benefits when I should've reported partial employment. Need to know if I can call someone to fix or amend these past 12 claims? I'm worried about having to repay everything or getting in trouble for incorrect reporting. Starting a new full-time job in October so I'll be off unemployment soon, but want to make this right before then. Anyone know how to handle this situation?

You need to call them ASAP. like yesterday. Dont wait on this or it could turn into a big mess with them demanding all the money back later. They can help u fix it but it's way better if YOU come forward first instead of them catching it later.

Thanks for the advice. Been trying to reach them but keep getting the busy signal. Any tips for actually getting through to someone?

100% this. My cousin waited 6 months to report a similar issue and got hit with a $4900 overpayment notice plus penalties. Dont mess around with this!

The DOL is actually pretty reasonable if you self-report mistakes. They'll probably just have you pay back the difference, not the whole amount. But yeah call NOW

After spending days trying to reach someone at the unemployment office, I finally found this service called Claimyr (claimyr.com) and they got me connected to a live agent within 45 minutes. Talking to an agent got my benefits situation fixed so fast after weeks of stress. They just call for you and connect you when someone answers - honestly it was the only way I could talk to a live agent after trying for weeks. Check out their explainer video here: https://youtu.be/Rdqa1gKtxuE

Yeah it actually does work! I was super skeptical too but I was desperate after trying to call like 50 times a day for weeks. They just keep calling and then connect you when someone picks up.

yeah right, another 'miracle solution'... what's the catch? 🙄

No catch really. They just automated the calling/waiting process. You still talk directly to the same unemployment agents. It was worth it for me after wasting hours trying to get through myself.

I get being skeptical. I was too. But after 3 weeks of not getting through myself, I was willing to try anything. It worked for me and saved me so much stress.

Same thing happened to me about 8 months ago. I reported it and they made me fill out a form for each week I needed to correct. Had to pay back some money but no penalties since I came forward on my own. You're doing the right thing trying to fix it!

whats the form called? i need to do the same thing but keep getting different answers from everyone

I think it was called Request for Reconsideration form. They sent it to me after I called though, I don't think you can just download it.

Thank you! Did you have to physically mail it back or could you submit it electronically?

I had to mail it. And make copies of everything you send!!!!

When you certify every week, its asking about the previous week ending saturday. Since you work on Saturdays, you should report those hours/earnings for that certification period. They'll reduce your benefit amount based on what you earn. The threshhold is $504 per week - anything under that and you get partial benefits.

That makes sense. I honestly didn't understand the system properly. So for the past 12 weeks I've probably been overpaid, right?

NY unemployment system is such a joke! Deliberately confusing and then they act like its YOUR fault when you make a mistake. Ive been on hold with them for 5 hours today trying to fix a similar issue 🤮

FIVE HOURS?! omg I would lose my mind

Update: got disconnected after 5.5 hours. This system is designed to make people give up.

Here's exactly what you need to do to fix this situation with NY unemployment: First, document everything. Write down all the dates you worked, how many hours, and how much you earned each Saturday. Have this ready before you call. Second, you need to connect with a live agent. This is honestly the hardest part because their phone system is overwhelmed. Many people have success using claimyr.com to actually get through to someone. It's worth checking out if you've been struggling to connect. Third, explain that you made an honest mistake in reporting. Request to file amended certifications for each affected week. Be prepared to pay back any overpayment, but since you're self-reporting, they shouldn't impose penalties. Fourth, follow up with a written statement through their messaging system explaining your situation. Screenshot this for your records. Fifth, if they determine you've been overpaid, they'll send you a notice with payment options. You can usually set up a payment plan if needed. Don't panic! This happens more often than you think, especially with the confusing partial work reporting system. The important thing is that you're trying to correct it before they flag it as potential fraud. Good luck!

This is incredibly helpful, thank you so much for laying it out so clearly! I'll start documenting everything tonight.

This is solid advice right here. I'd add that you should keep copies of any paystubs from those Saturdays as proof.

Don't stress too much. I had to correct 8 weeks of claims last year. They were actually pretty reasonable about it and just had me pay back the difference (not the whole amount). Just be honest and they'll help you.

The 0-10 hours option means you DID work between 0-10 hours, not that you didnt work at all. So you selected the right option if you worked 5 hours each Saturday. Are you sure you messed up?

-

Faith Kingston

I selected 0-10 hours but I think I might have forgotten to put my earnings from those hours? The system is so confusing!

Oohhh, yeah that's different. You definitely need to report earnings. Call them asap.

i did something similar and when i called, they transferred me to the fraud department who reviewed my case. they put a hold on my benefits while they investigated. took about 4 weeks but ended up being fine. just had to pay back what i owed.

-

Faith Kingston

4 weeks?! That's so long! Did they set up a payment plan for you or did you have to pay it all at once?

0 coins

they gave me options. i could pay all at once or they could take a percentage of future benefits until it was paid back. since i was still partially unemployed, i went with the second option.

why even bother with ny unemployment? Its nearly impossible to get anyone on the phone and when you do they just transfer you around. honestly id just wait and see if they catch it later, but thats just me 🤷‍♂️

-

Liam Brown

This is terrible advice. If they catch it later they'll add penalties and possibly charge you with fraud. Always better to self-report mistakes.

You can also go in person to a NY career center! I did this when I had problems with my claim and they were able to help me fix stuff in the system. Much better than trying to get someone on the phone. Just google your nearest location

I wish they'd just fix the ridiculous certification system. It's so easy to make mistakes! Like why isn't there a warning if you're certifying differently from your usual pattern? Makes no sense.

Olivia Garcia

For real!! The UI on that website looks like it was designed in 1995 and never updated 😂

Exactly! And half the time the site crashes mid-certification and you have to start over. Such a broken system.

I'd reach out through their message portal too, not just by phone. Document that you tried to fix the issue. Screensnap the message so you have proof you self-reported the problem.
