How long does it take for adjudication unemployment with NYS Department of Labor?
My unemployment claim went into adjudication status three days ago and I'm freaking out about how long this is going to take. I lost my job at a retail store last month when they said I was late too many times (which I disagree with but whatever). Filed my claim right away and was getting paid weekly for about 3 weeks, then boom - adjudication. The my.ny.gov portal just says 'claim under review' with no other details. I really need to know what to expect timeline-wise because I have rent due next week and this is my only income right now. Has anyone been through this recently? How long does adjudication usually take with NYS Department of Labor?

Adjudication timelines vary depending on the complexity of your case, but typically range from 2-6 weeks. Since yours involves a termination dispute (attendance issues), they need to contact your former employer for their side of the story. The NYS Department of Labor has to investigate whether the termination was for misconduct, which would affect your eligibility. During this time, continue filing your weekly claims even though you won't receive payment until the issue is resolved.

•6 weeks?? That's insane. I can't go that long without income. Is there anything I can do to speed this up?

•Unfortunately there's no way to expedite the process. The investigation has to be thorough. If you're ultimately approved, you'll receive back pay for all the weeks you were in adjudication, so keep filing those weekly claims religiously.

Mine took exactly 4 weeks and 2 days last year. Also was a termination issue but for different reasons. The waiting is brutal but like the other person said, you get all the back pay if approved. Just keep doing your weekly certifications!

•Did they ever tell you what was taking so long or did you just have to wait it out?

•Just had to wait. Tried calling but could never get through to anyone who could give me updates.

If you're having trouble reaching the NYS Department of Labor by phone to check on your adjudication status, I had success using a service called Claimyr (claimyr.com). They can actually get you connected to a real person at NYS Department of Labor without the endless hold times. There's a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Might be worth trying if you need to speak with someone about your case.

•Never heard of this before. Does it actually work or is it just another scam?

•It's legit - used it twice when I couldn't get through the regular way. Obviously can't guarantee they'll have updates on your adjudication since that process just takes time, but at least you can talk to someone.

THE WHOLE SYSTEM IS BROKEN!!! I've been waiting 7 WEEKS for my adjudication and still nothing. They don't care that people are starving while they take their sweet time. And good luck getting anyone on the phone - I've called 847 times (yes I'm counting) and gotten through exactly ZERO times.

•That's awful, sorry you're going through that. Have you tried contacting your state representative? Sometimes they can help with NYS Department of Labor issues.

I went through adjudication last fall and it took about 3.5 weeks for my case. The hardest part is definitely the uncertainty and not knowing when it will end. A few tips that helped me: 1) Keep detailed records of all your job search activities since you'll need to show you're actively looking for work, 2) Check your my.ny.gov account daily for any requests for additional information - sometimes they ask for documents and if you miss it, it can delay things even more, 3) Consider reaching out to local food banks or emergency assistance programs to help bridge the gap while you wait. The back pay really does come through if you're approved, so hang in there. I know it's scary when rent is due but you're doing everything right by continuing to file weekly.

•This is really helpful advice, thank you! I hadn't thought about the food bank option. Do you remember if they sent you any notifications when your adjudication was finally resolved, or did you just have to keep checking the portal? I'm checking multiple times a day but wondering if I'll get an email or something when there's an update.
