How long does adjudication take for unemployment NYS Department of Labor 2024 - still waiting 5 weeks
Filed my initial unemployment claim back in early November and it's been stuck in adjudication status for over 5 weeks now. My former employer is disputing the reason I left (they're claiming I quit but I was actually laid off due to restructuring). I've submitted all the documentation they requested through the my.ny.gov portal but the status hasn't changed at all. Is this normal for how long adjudication takes in 2024? I'm getting really stressed about my bills piling up and haven't received a single payment yet. Has anyone else experienced adjudication delays this long with NYS Department of Labor recently?

Adjudication timelines have definitely gotten longer since 2024. When there's an employer dispute about separation reason, NYS Department of Labor has to investigate both sides thoroughly. 5-6 weeks isn't unusual unfortunately, especially if your employer is being slow to respond to their requests for information. Make sure you keep filing your weekly claims even during adjudication - if you're approved you'll get backpay for those weeks.

•Thanks for the response! I have been filing weekly but it's frustrating not knowing when this will resolve. Did you go through something similar?

ugh same thing happened to me earlier this year - took 7 weeks for my adjudication to complete. the worst part is you cant get through to anyone on the phone to check status

•Actually I found a service called Claimyr that helped me get through to an actual NYS Department of Labor agent. You can check it out at claimyr.com - they have a video demo at https://youtu.be/qyftW-mnTNI showing how it works. I was able to get status updates on my adjudication case that way when I couldn't reach anyone through normal channels.

•Interesting, I'll look into that. At this point I'm willing to try anything to get some answers about my case status.

The adjudication process is completely broken in my opinion. I waited 8 weeks last year only to have them deny my claim based on incorrect information from my employer. Had to go through the whole appeal process which took another 6 weeks. NYS Department of Labor needs to do better - people are struggling to pay rent while they take their sweet time investigating basic employment separations.

•Did you win your appeal at least? I'm worried I might have to go that route too if they believe my employer's version of events.

Keep documenting everything! Save any emails, texts, or written communication about your layoff. If you have coworkers who were also laid off at the same time, get their contact info in case you need witnesses for an appeal. The adjudication officer will review all the evidence from both you and your employer before making a determination.

yeah adjudication sucks but at least you'll get backpay if approved. I had to wait 6 weeks but got like $4200 when it finally went through
