How long does it take NYS Department of Labor unemployment to make a decision on my claim?
Filed my unemployment claim with NYS Department of Labor about 2.5 weeks ago and it's still showing pending adjudication. I had to submit some additional documents about my separation from my previous job (layoff situation was complicated due to restructuring). My former employer might be disputing it but I'm not sure. Does anyone know how long NYS Department of Labor typically takes to make a decision once they start the adjudication process? I'm getting really anxious about this because my savings are running out and I need to know if I should start looking into other options.

Adjudication timelines vary a lot depending on the complexity of your case. For standard separation issues, NYS Department of Labor usually takes 2-4 weeks. If your employer is disputing or there are complicating factors like yours, it can take 4-6 weeks or sometimes longer. The good news is if you're approved, you'll get back pay for all the weeks you were eligible.

•Thanks, that's somewhat reassuring. Do you know if there's any way to check if my employer actually filed a dispute or if it's just routine verification?

I had a similar layoff situation last year where the company was restructuring. Took about 3 weeks for NYS Department of Labor to make their decision. The key is making sure you submitted all the documentation they requested. If they need anything else, they'll usually send a notice or update your online account. Check your my.ny.gov portal regularly for any requests.

•I've been checking daily but haven't seen any new requests. Just shows 'adjudication in progress' still.

If you're having trouble getting through to NYS Department of Labor to check on your claim status, I used this service called Claimyr (claimyr.com) that helped me get connected to an actual agent. They have a video demo at https://youtu.be/qyftW-mnTNI showing how it works. Was way better than sitting on hold for hours just to get disconnected. The agent was able to tell me exactly where my claim stood in the process.

•How much does something like that cost? Seems like we shouldn't have to pay extra just to talk to someone about our own claims.

•I understand the frustration but honestly it saved me so much time and stress. The regular phone lines are just impossible to get through on.

The whole system is broken honestly. My friend waited 8 weeks for a decision and then they denied him anyway. NYS Department of Labor doesn't care how long you wait as long as they don't have to pay out benefits.

•That's frustrating but not entirely accurate. Processing times have improved significantly since 2021. Most claims are resolved within the timeframes I mentioned above.

Same boat here! Filed 3 weeks ago for a layoff and still waiting. At least I know I'm not the only one dealing with this uncertainty.

I went through something similar about 6 months ago with a complex layoff situation. NYS Department of Labor took about 4 weeks to resolve mine, but the wait was definitely nerve-wracking. One thing that helped me was calling my local career center - they couldn't speed up the process but they were able to connect me with some emergency assistance programs while I waited. Also, make sure you're continuing to certify for benefits each week even while it's pending, otherwise you might miss out on back pay if approved. Hang in there!
