How long does employer have to respond to NYS Department of Labor unemployment claim request?
Filed my unemployment claim about 10 days ago and it's been stuck in adjudication ever since. I know they sent some kind of notice to my former employer but I have no idea how long they have to respond. My claim status just keeps saying 'adjudication in progress' and I'm getting really anxious about when this will be resolved. Does anyone know the actual timeframe employers get to respond to NYS Department of Labor? I need to know if I should be worried or if this is normal timing.

Employers typically have 10 business days to respond to the initial separation notice from NYS Department of Labor. However, if they request additional time or if there are complications with the case, the adjudication process can take longer. The system will show 'adjudication in progress' until they make a determination based on all the information they receive.

mine took almost 3 weeks because my old job waited until the last minute to send their response and then there was some back and forth about the details

The 10 business day rule is correct, but keep in mind that's just for the initial response. If your employer contests the claim or provides information that requires further investigation, NYS Department of Labor can extend the adjudication period. You should continue filing your weekly claims during this time - if you're approved, you'll get backpay for the weeks you were eligible.

Just want to say hang in there - the waiting is the worst part but most claims do get approved eventually if you were legitimately laid off or fired without cause.

I'm going through the exact same thing right now! Filed my claim two weeks ago and it's still showing "adjudication in progress." I called the main NYS DOL number multiple times but can never get through - it either hangs up or puts me on hold for hours. Has anyone had luck calling at specific times of day? I'm wondering if there are better hours to try reaching them. Also, @StellarSurfer, did you get laid off or was it a different separation reason? I'm hoping that makes a difference in processing time.
