How long does a company have to respond to unemployment claim in NYS?
My former employer terminated me last month and I filed for unemployment benefits with NYS Department of Labor. My claim has been in adjudication for over two weeks now and I'm wondering how long my company has to respond to the unemployment claim. I know they got notified because my ex-supervisor mentioned it when I went to pick up my final paycheck. Is there a specific deadline they have to meet? I'm getting really anxious because my savings are running low and I need to know if this delay is normal or if something went wrong with my claim.

Employers in New York have 10 calendar days from the date they receive the notice to respond to an unemployment claim. However, the NYS Department of Labor can still process your claim even if they don't respond within that timeframe. The adjudication period you're experiencing is normal - it typically takes 2-4 weeks for them to review all the information and make a determination on your eligibility.

•Thank you! That's really helpful to know. Do you know if the 10 days starts from when they mail the notice or when the employer actually receives it?

ugh the waiting is the worst part! my claim took 3 weeks in adjudication even though my employer responded right away. apparently they still have to verify everything and sometimes request additional info

•The verification process can definitely extend the timeline. NYS Department of Labor has to cross-reference employment records, wage information, and sometimes conduct phone interviews with both parties. If your employer disputes the claim, that adds even more time to the adjudication process.

I had a similar situation last year and was going crazy waiting. Finally found this service called Claimyr (claimyr.com) that helped me get through to an actual NYS Department of Labor agent to check on my claim status. They have this video demo at https://youtu.be/qyftW-mnTNI that shows exactly how it works. Was so much better than trying to call the regular number and getting hung up on constantly.

•Did they charge you a lot for that? I'm already tight on money while waiting for my benefits to kick in.

•It was worth it for me just to get some peace of mind about what was happening with my claim. Way less stressful than the endless calling and busy signals.

The NYS Department of Labor system is so frustrating! Even when employers respond on time, they still take forever to process everything. I swear they make it deliberately difficult so people give up and don't collect benefits they're entitled to.

•I feel like there has to be some kind of backlog or staffing issue because these delays seem way longer than they used to be. My friend's claim took almost 6 weeks last fall.
