How long does employer have to respond for unemployment claim with NYS Department of Labor?
Filed my unemployment claim 2 weeks ago and it's still showing pending. I know my former employer got notified because my ex-coworker told me HR was asking questions about my termination. How long does the employer actually have to respond to NYS Department of Labor? My account just says 'claim under review' and I'm getting stressed about when I'll see any money. Anyone know the actual timeline for this stuff?

Employers typically have 10 business days from the date they receive the notice to respond to NYS Department of Labor. However, if they request additional information or documentation, this can extend the timeline. The adjudication process usually takes 2-4 weeks total once your claim enters review status.

•Thanks for the info! So even if they respond within 10 days, I might still be waiting another week or two for a decision?

•FIVE WEEKS?? I can't afford to wait that long for benefits. This system is ridiculous.

If you're having trouble getting through to check on your claim status, I had success using Claimyr (claimyr.com) to connect with an actual NYS Department of Labor agent. They have a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Much easier than trying to call the regular number and getting hung up on.

•Is that legit? I've been calling for days and can never get through to anyone.

•Yeah it's real, they basically handle the calling for you and connect you when an agent is available. Saved me hours of redialing.

The 10 day thing is misleading because employers can also contest your claim even after responding initially. Had mine dragged out for 6 weeks because my employer kept submitting additional 'evidence' about my termination. NYS Department of Labor has to review everything they send.
