What happens if former employer doesn't respond to NYS Department of Labor unemployment claim?
I filed my unemployment claim about 2 weeks ago and it's been sitting in adjudication status. From what I can see on my.ny.gov portal, NYS Department of Labor sent a request to my former employer for information but there's no response showing up. My ex-boss was pretty disorganized when I worked there and I'm worried they're just ignoring the request completely. Does anyone know what happens if they don't respond at all? Will my claim automatically get approved or denied? I really need these benefits to come through soon.

If your former employer doesn't respond to the NYS Department of Labor's request within the required timeframe (usually 10 business days), your claim will typically be decided based on the information you provided when filing. The employer's silence generally works in your favor - they lose their opportunity to contest your eligibility if they don't respond timely. However, the adjudication process can still take several weeks even without employer input because NYS Department of Labor needs to verify your employment history and wages.

•That's reassuring! Do you know if they send multiple requests or just the one? I'm hoping they didn't miss it entirely.

same thing happened to me last year - employer never responded and my claim was approved after about 3 weeks total. the adjudication took forever but once it went through i got all my back pay from when i first filed

•That gives me hope! Did you have to do anything special or just wait it out?

NYS Department of Labor usually sends one official request to the employer, but they might follow up with a phone call if it's a complex case. The key thing is to keep filing your weekly claims during adjudication - if you miss weeks you can't get that money back later. Also document everything on your end in case there are questions later.

•Wait, you have to keep filing weekly claims even when it says adjudication in progress?? I've been skipping weeks thinking I couldn't file until it was resolved!

•Yes! You absolutely must continue filing weekly claims. The system will hold those claims as pending until adjudication is complete, then release all the back payments at once if approved.

I had a nightmare trying to get through to NYS Department of Labor during my adjudication period - kept getting disconnected after waiting on hold forever. Finally used this service called Claimyr (claimyr.com) that actually got me connected to a real agent who could check my claim status. They have a video demo at https://youtu.be/qyftW-mnTNI showing how it works. Turned out my employer HAD responded but there was an issue with the dates they provided.

•How much does something like that cost? I'm already strapped for cash waiting for benefits.

•It was worth it for me to get answers instead of just wondering what was happening. Way better than spending hours trying to call and getting nowhere.

ugh the whole system is so frustrating!!! why does it take so long just to verify basic information?? my old job probably threw the letter in the trash and now im stuck waiting indefinitely

•I understand the frustration, but the process usually moves faster than it seems. Most non-response cases resolve within 3-4 weeks from filing.

I'm going through the exact same thing right now! Filed 3 weeks ago and it's been in adjudication the whole time. My former employer was terrible with paperwork when I worked there so I doubt they'll respond either. Thanks everyone for the info about continuing to file weekly claims - I had no idea that was so important. @Isabella hopefully both our claims get resolved soon! The waiting is the worst part when you're counting on these benefits.
