NYS Department of Labor - how long does it take for an employer to respond to unemployment claim?

I filed my unemployment claim about 10 days ago and it's been sitting in adjudication status ever since. The NYS Department of Labor website shows they sent a notice to my former employer but there's no update on whether they responded yet. I was laid off from my marketing job due to company downsizing so I don't think there should be any issues, but I'm getting anxious about how long this is taking. Does anyone know the typical timeframe for employers to respond to unemployment claims? My rent is due next week and I really need to know when I might see my first payment.

Employers in New York have 10 business days to respond to unemployment notices from NYS Department of Labor. However, some employers respond much faster - within 2-3 days. The adjudication process can take an additional 1-2 weeks after they receive the employer response to make a determination on your claim.

Thanks for the info! So I'm still within the normal timeframe then. Do you know if there's any way to check if my employer has responded yet or do I just have to wait for NYS Department of Labor to update my claim status?

my employer took the full 10 days last time i filed, some companies just dont prioritize these things even though people are waiting for money to live on

Unfortunately there's no way for claimants to see if the employer has responded through the my.ny.gov portal. You'll only see status updates when NYS Department of Labor makes their determination. If you're really concerned about the delay, you could try calling the employer directly to ask if they've submitted their response, though they're not required to tell you.

I've been dealing with this exact same situation! Filed 2 weeks ago and still in adjudication. Called NYS Department of Labor multiple times but can never get through to an actual person. It's so frustrating when you need the money and there's no way to get information about what's happening with your claim.

I had the same problem trying to reach NYS Department of Labor by phone until someone recommended claimyr.com. It's a service that helps you get through to actual agents at the unemployment office. I was skeptical at first but they got me connected within a few hours and I was able to get real answers about my claim status. They have a video demo at https://youtu.be/qyftW-mnTNI that explains how it works. Definitely worth checking out if you're stuck waiting with no information.

That sounds almost too good to be true but at this point I'm willing to try anything. The uncertainty is killing me more than the wait itself.

Just to add some perspective - even after your employer responds, NYS Department of Labor can take additional time to review everything and make their decision. In straightforward layoff cases like yours it's usually approved quickly, but they still have to go through their process. Hang in there!

I went through this same process about 6 months ago when I was laid off from my tech job. My employer actually responded within 3 days, but then it took NYS Department of Labor another 10 days to process everything and update my claim status. The whole thing felt like it took forever when you're stressed about money. One thing that helped me was setting up direct deposit ahead of time through the my.ny.gov portal so when the payment was finally approved, it came through faster. Also, if you were laid off due to downsizing like you mentioned, that's typically a pretty straightforward approval once they get through the paperwork. Try not to stress too much - you should be good!

Thanks Dylan, that's really helpful to hear from someone who went through the same thing! I hadn't thought about setting up direct deposit yet - definitely going to do that today. It's reassuring to know that even when employers respond quickly, there's still additional processing time on NYS Department of Labor's end. At least now I have a better idea of the timeline and know that 3-4 weeks total isn't unusual for this whole process.
