How long after filing unemployment does it take to get approved by NYS Department of Labor?
Filed my initial unemployment claim last Tuesday and I'm getting anxious about when I'll hear back. My employer terminated me for what they called 'performance issues' but I think it was really because I asked for accommodations for my disability. Anyway, I submitted everything through the my.ny.gov portal and got a confirmation number but haven't heard anything since then. How long after filing unemployment does it take to get a decision from NYS Department of Labor? I'm really stressed about paying my rent next month.

Typically takes 2-3 weeks for NYS Department of Labor to process initial claims if there are no complications. Since you mentioned your termination involved performance issues, your claim might go into adjudication which can add another 2-4 weeks. You should receive a determination letter explaining their decision once they review everything.

•Oh no, what exactly is adjudication? Does that mean they don't believe I should get benefits?

Adjudication just means they need to investigate the circumstances of your separation from employment. Since your employer cited performance issues, NYS Department of Labor has to determine if you were terminated for misconduct or if it was through no fault of your own. Keep filing your weekly claims even during adjudication - if approved, you'll get back pay for those weeks.

•Thanks, that makes me feel a bit better. I was worried I did something wrong with my application.

I had a similar situation where I was dealing with NYS Department of Labor taking forever to process my claim. Could not get through on the phone for weeks - just constant busy signals or getting hung up on after waiting an hour. Finally found this service called Claimyr (claimyr.com) that helps you actually reach a live agent. They have a video demo at https://youtu.be/qyftW-mnTNI showing how it works. Got connected within a day and was able to check my claim status directly with someone who could see my file.

•How much does something like that cost? I'm already broke from being unemployed.

•They focus on just getting you connected to the right person rather than charging crazy fees. Way better than sitting on hold for hours every day.

THE WHOLE SYSTEM IS A JOKE! I've been waiting 6 WEEKS for my adjudication and they keep saying 'we're reviewing your case.' Meanwhile I'm about to lose my apartment. NYS Department of Labor acts like they're doing us a favor when WE PAID INTO THIS SYSTEM through our paychecks!

•I feel you. The stress is unreal when you're waiting and have bills piling up.

Just to add - make sure you're filing your weekly claims every Sunday even if your initial claim is still pending. Missing weekly certifications can delay your benefits even after approval. Also keep detailed records of any job search activities since you'll need to meet those requirements once approved.
